HomeMy WebLinkAboutR-86-0153J-86-209 2/26/86 RESOLUTION NO. 86r153 A RESOLUTION AUTHORIZING THE CITY MANAGER TO PROCEED WITH A REQUEST FOR FUNDS FROM THE FLORIDA INLAND NAVIGATION DISTRICT TO STABILIZE THE SHORELINE OF CITY OWNED PROPERTY AT THREE LOCATIONS ALONG THE MIAMI RIVER A14D ONE LOCATION ON BISCAYNE BAY ON A MAXIMUM 50/50 MATCHING FUND BASIS; AGREEING TO ABIDE BY CERTAIN CRITERIA SET FORTH BY THE FLORIDA INLAND NAVIGATION DISTRICT BOARD OF COMMISSIONERS. WHEREAS, the City of Miami is responsible f'or shoreline maintenance and repair of City owned property along Biscayne Bay and the Miami River; and WHEREAS, erosion due to winds, wave action and tidal currents nas resulted in property loss and damage to City owned waterfront property; and WHEREAS, there is an urgent need to repair and maintain the present unstable shorelines along the Miami River and Biscayne Bay at Kennedy ParK, Curtis ParK, Sewell ParK, N.W. 5 Street Bridge; and WHEREAS, Tne Florida Inland Navigation District is receiving requests for funds under the provisions of Chapter 85-200, Laws of Florida, on a maximum 50/50 matening fund basis; and WHEREAS, certain criteria must be met for consideration of requests f'or funds to the Florida Inland Navigation District; and CI'P� C7T•�,�i':SIOI�i rkEETING OF FEB 27 IM WHEREAS, The City desires to apply to the Florida Inland Navigation District for funding of snoreline stabilization construction of City owned property along the Miami River and Biscayne Bay; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is nereby authorized to proceed with a request for funds from the Florida Inland Navigation District for snoreline stabilization construction along the Miami River and Biscayne Bay at Kennedy Park, Curtis Park, Sewell Park, and N.W. 5 Street Bridge. Section 2. The City nereby agrees to abide by the following criteria sec fortn by the Florida Inland Navigation District Board of Commissioners: a. For the life of the project, to manage and maintain the facility to the same standards of other local facilities. b. Keep the project available on a non-exclusive basis to the general public without regard to age, sex, race, otner condition or the political subdivision in whien the user resides. C. Design and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons as well as all otner federal, state and local laws, rules and requirements. d. To make available to the Florida Inland Navigation District a post -audit of expenses incurred on the project prior to, or in conjunction witn, a request for the final 10% of the funding agreed to by the Florida Inland Navigation District Board of Commissioners. - 2 - 86-1.5a . Odio City Manager BACKGROUND TILE SUBJECT RESOLUTION REGARDING FLORIDA INLAND NAVIGATION DISTRICT GRANT PROGRAM REFERENCES ENCLOSURES (For Commission Meeting of February 27, 1986) It is recommended that a Resolution be adopted authorizing the City Manager to proceed with a request for funds from the Florida Inland Navigation District to stabilize the shoreline of City -owned property located at three locations along the Miami River and one location on Biscayne Bay on a maximum 50/50 matching fund basis; agreeing to abide by certain criteria set forth by the Florida Inland Navigation District Board of Commissioners. The Florida Inland Navigation District (FIND) is composed of the 11 coastal counties, including Dade, Broward, Palm Beach, Duval, Brevard, Volusia, St. Lucie, Martin, Indian River, St. Johns and Flagler Counties. The FIND board is comprised of one Governor - appointed Commissioner for each county; Dade County is represented by Mr. Stanley Goodman. Recent legislative authority has increased FIND's powers and it may now participate financially or otherwise in the following programs: * Projects authorized and undertaken by the U.S. Army Corps of Engineers. * Beach renourishment projects providing that the dredging of beach renourishment material is a benefit to public navigation in the District. * Local government projects in planning and carrying out public navigation, public recreation and boating safety projects, whether waterway -wide or of a purely local nature. Honorable Mayor and Members of the City Commission (Cont.'d) * Local, State or Federal research, study or test programs relating to waterway construction, use, operation, or maintenance, or relating to wildlife, wildlife habitat, fisheries, water quality, vegetation erosion, accretion or similar environmental issues and values. FIND's primary source of revenue has been the ad valorem taxing power of up to .10 mil in each of the district's 11 counties. From 1928-1970 the District collected $4.95 million from Dade County ad valorem taxes. The District has purchased over 1,100 acres of land adjacent to the intercoastal waterway, however, no land has ever been purchased in Dade County. The District currently has $3.5 million in funds which will be used to finance water -related projects on a 50/50 matching grant basis. If the District elected to reenact the tax which was last collected in 1970, it could raise up to $12 iillion per year. CURRENT FIND PROGRAM In order to appropriate the funds currently available to FIND, the District has asked the 11 member counties to submit project applications by March 1, 1986. The District has also established the following priorities to assist counties in their applications. In descending order, they are: * in-house expenditures * acquisition of spoil island * maintenance of existing properties * new improvements to navigation * 'recreation The City of Miami received notice in .January, 1986 that the Florida Inland Navigation District is receiving proposals from municipalities and counties for various types of improvements to waterways. Erosion due to winds, tidal action and currents has resulted in property loss and damage on several properties along the Miami River and Biscayne Bay. i Below are four areas in urgent need to repair this unstable condition with rip rap. Preliminary cost estimates are also included. M Kennedy Park $ 75,000 N.W. 5th Street Bridge $ 60,000 Sewell Park $145,500 Curtis Park $ 85,500 i Total $366,000 ' The Florida Inland Navigation District has provisions for funding such improvements on a 50/50 matching fund basis. The City's financial contribution would be approximately $185,000.
