HomeMy WebLinkAboutR-86-0197it I J-86-260 3/18/66 RESOLUTION NO . 8 6 -1 9 7 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS OF DADE COUNTY, FLORIDA, TO ESTABLISH A FIFTEEN (18) YEAR NON -AD VALOREM SPECIAL ASSESSMENT PROJECT AREA FOR THE METROMOVER STAGE I COMPLETION - OMNI AND BRICKELL EXTENSIONS (METROMOVER EXTENSION); STIPULATING NET BOND PROCEEDS AND PRESCRIBING PROJECT AREA BOUNDARIES AS SET FORTH IN ATTACHED EXHIBITS A AND B; FURTHER SETTING FORTH CONDITIONS UPON SUCH AUTHORIZATION. WHEREAS, the Charter of Metropolitan Dade County, Florida, has empowered the Board of County Commissioners of Dade County, Florida, with the exclusive authority to create and establish taxing and assessment districts and projects within Metropolitan Dade County; and WHEREAS, the Laws of Florida and the code of Metropolitan Dade County, Florida, require the governing body of a municipality to approve the creation of a special taxing district s or project if said district or project lies within the geographical or territorial limits of a municipality; and WHEREAS, Dade County has a duty to provide for the health, safety, welfare, and general comfort of its citizens; and t< WHEREAS, the Omni and Brickell Corridors of the City of Miami are centers for hotel/convention activities and professional services; and WHEREAS, certain civic and business associations have expressed a need and a desire to facilitate the orderly movement 1 of people and traffic along the City's streets and ways by the establishment of a northern and a southern extension of the a F existing Metromover system; and WHEREAS, the City finds and determines a need for rendering financial assistance to the development of the Metromover Extensions in order to provide an orderly movement of pedestrians r and vehicular traffic upon its streets and ways; CPt CONMIS"SION MEETING OF x MAR I8 1980 �Mwn(w n..g NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. With regard to approving the creation of a Special Assessment Project Area (Project Area) for the Omni and Brickell Extension of the Metromover system located entirely within the City of Miami, the City Commission hereby approves the creation of said Project area pursuant to Section 18-2 of the Dade County Code and as described in the attached map designated as Exhibit A and made a part hereof. Section 2. The Board of County Commissioners of Dade County, Florida, is hereby authorized and urged to levy said fifteen (15) year non -ad valorem based assessment which is to be determined based on the net leasable square foot located in the Project Area. The revenues generated by the special assessment will support and carry an issue of revenue bonds sufficient to net $23,000,000 to be used to finance a portion of the Special Assessment Project which will consist of the construction, systems, and equipment necessary to operate the planned Metromover Extension as the County Commission may determine. Section 3. The Boundaries of the said Special Assessment Project Area shall be described generally as set forth in the attached schedule designated as Exhibit "B" and made a part hereof. Section 4. The herein approval is conditioned upon the following: a. The City shall be exempt from any proposed assessment levied in connection with the North and South leg of Phase II of the Metromover Project. b. The City shall retain control and final approval over the direction of the guideway alignment of the proposed Metromover extension. Commission may authorize the Board of County Commissioners of Dade County (BCC) to establish a Special Assessment Project Area for the Metromover Stage I - Omni and Brickell Extensions. The ordinance creating the Special Assessment Project Area is scheduled for consideration by the BCC at its March 18, 1986 meeting.
