ORDINANCE NO. 1 0 0 29 A
AN ORDINANCE CREATING THE "CITY OF MIAMI
YOUTH ADVISORY COUNCIL", PROVIDING FOR
- THE COMPOSITION OF THE COUNCIL AND THE
QUALIFICATIONS AND TERMS OF MEMBERS;
PROVIDING FOR THE POWERS AND DUTIES OF
SAID COUNCIL; PROVIDING A METHOD OF
SELECTION OF OFFICERS; FURTHER PROVIDING
FOR MEETINGS, QUORUMS AND VOTES;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the youths of the City of Miami are an important
asset to the community; and
WHEREAS, the youths of the City represent a large segment of
the total population of the City; and
WHEREAS, the City Commission recognizes the problems of
youths within the City and the importance of finding solutions to
those problems; and
WHEREAS, the City Commission adopted Resolution. No. 73-801
on September 26, 1973 which created the Youth Advisory Board, but
said Board has been inactive for many years;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. CREATION.
There is hereby created a "City of Miami Youth
Advisory Council".
Section 2. COMPOSITION; terms of members and advisor;
filling of vacancies; expenses and compensation.
(a) The Council shall be composed of fifteen
(15) members between the ages of sixteen (16) and twenty-four
(24) years, all of whom shall reside in the City of Miami or have
parents that have a business in the City of Miami and serve
without compensation. Each City Commissioner shall nominate
three (3) members to the Youth Advisory Council.
(b) The term of each member shall be two (2)
years.
(c) Should there be a vacancy on the Council,
before expiration of a full term, the City Commissioner or
his/her successor who first nominated the former member shall
nominate a member to serve the remainder of the term of the
original appointee. Each member shall be eligible for
reappointment. No expenses shall be incurred by the Youth
Advisory Council, nor any expenses of Council members paid
without prior approval of the City Commission.
Section 3. POWERS AND DUTIES.
The powers and duties of the Youth Advisory
Council are:
a. (1)
to serve in an advisory capacity to the City
Commission;
(2)
to show young people where and how to avail
themselves of the legislative and judicial
processes available to them under the law;
(3)
to educate young people on how to use the
rights and responsibilities secured by the
Federal and State Constitutions, statutes and
City and county ordinances;
(4)
to assist in seeking solutions to any problems
faced by the youth of the City of Miami;
(5)
to serve the community in any significant

matters which affect the rights and privileges
of its youth;
(6)
to promote athletic, musical, and cultural
activities and events for the youth of the
community; and
(7)
to become involved in any community projects in

its capacity as a quasi -governmental body.
b. In
all community activities, the Council may involve
as many people
as it wishes to work with it in effeotuating a
better understanding in the community between the youth, the
general public,

and local government.

c. The Youth Advisory Council shall communicate the
needs, goals, objectives and results of the youth activities in
the community to the City Commission and report to the citizens of
the City of Miami through the use of the media.
Section 4. ORGANIZATION OF OFFICERS AND COMMITTEES•
RQLE OF THE ADVISOR.
(a) The chairperson shall be selected by a
majority vote of the entire Council. Officers shall be selected
by the chairperson. The officers to be selected by the
chairperson are: vice -chairperson, secretary, and public
relations officer.
(b) The chairperson shall be the presiding
officer and official spokesman at all official meetings and
activities of the Youth Advisory Council. No meeting shall
commence unless the chairperson or vice -chairperson is present.
(c) No standing committee shall be created.
All committees shall be created and staffed as are deemed
necessary to perform its duties.
(d) The City Commission shall allocate funds
to meet the needs for all such items, including special projects,
as it may deem necessary.
Section 5. MEETINGS. QUORUM, AND VOTES.
(a) Meeting places and times shall be
established by the Youth Advisory Council and shall be arranged
and held as often as the Council determines necessary, but at
least once a month.
(b) The Council shall adopt its own order of
business and rules of parliamentary procedure.
(c) A quorum shall consist of nine (9)
members. Any decision of the Council shall be made only upon an
affirmative vote of the majority of those members in attendance.
(d) Agendas and minutes shall be published and
distributed to the City Commission, the City Manager, the City

Clerk, the Department of Communications and others designated by
the Youth Advisory Council. The City Manager shall provide
reasonable secretarial and administrative aid in preparation and
distribution of agendas and minutes, and other items requested by
the Council.
(e) Failure of a member to attend three (3)
consecutive meetings without justifiable excuse or reasons, as
determined and recorded by the chairperson, shall automatically
disqualify said member from Council membership.
(f) The City administration shall assist the
Youth Advisory Council and make City facilities available to it
when Council use does not conflict with other scheduled
activities.
Section 6. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed. Resolution No. 73-801 dealing
with this subject matter is hereby repealed and rescinded in its
entirety.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 8. It is the intention of the City Commission that
the herein provisions shall become and be made part of the Code of
the City of Miami, Florida, as amended, all of which provisions
may be renumbered or relettered and the word "ordinance" may be
changed to "section", "Article", or other appropriate word to
accomplish such intention.

The proposed ordinance in oonnection with this matter has been
extensively edited subject, of course, to your approval: there
is a blank provision for the method of selecting the chairperson
of the Council (Section 4); unless you instruct us otherwise, the
Commission will determine that method when it considers the
matter on first reading.
Since the legislation creating the previous dormant body (Youth
Advisory Hoard, attached Resolution No. 73-801) had no structure
whatever, and accepted as members individuals residing outside
the City, we have added the elements of noncomrensation and City
residency for membership service. The voting status of the adult
advisor has been clarified and the the minimum age of 21 for the
adult advisor has been inserted; also, the quorum required for
this 10 member body has been set at 6 members with a further
provision that no meeting may commence unless the chairperson or
vice -chairperson of the Council is present. A decision of the
Council on any matter coming before it shall be made only upon an
affirmative vote of the majority of Council members in attendance
at any meeting.
After you review, please call me and we can make any changes you
wish and distribute the ordinance to the Commission, if you so
desire. -

Notice is hereby given that the City Commission of the City of
Miami, Florida, on March 18, 1986, commencing at 9:00 A.M. in the
City Commission Chamber, City Hall, 3500 Pan American Dr., Miami,
Florida, will consider the following Ordinance(s) on final reading and
the adoption thereof:
ORDINANCE NO. ___.
AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED: "HISTORIC PRESERVATION: DOWNTOWN",
AND APPROPRIATING FUNDS FOR THE OPERATION. OF
SAME IN THE AMOUNT OF $30,000, CONSISTING OF A
$15.000 GRANT FROM THE STATE OF FLORIDA: DEPARTMENT
OF STATE; AND $15,000 FROM FISCAL YEAR 1985/86 GENERAL
FUND: PLANNING DEPARTMENT; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.

SPECIAL OCCASIONS AND FOR SPECIAL EVENTS OR
PROGRAMS, TO PERMIT THE SALE OR DISPENSING OF
WINE OR BEER IN SOFT CONTAINERS IN CERTAIN CITY
PARKS; FURTHER ESTABLISHING A PERMIT FEE OF $300
PER DAY FOR SAID SALE OF WINE AND BEER.

FORTY MILLION DOLLARS ($40,000,000) OF SPECIAL
CONSTRUCTION REVENUE NOTES OF THE CITY OF MIAMI,

PROGRAM THAT MEETS THE REQUIREMENT FOR TAX
EXEMPTION IN THE FEDERAL INTERNAL REVENUE CODE;
IDENTIFYING THE MANAGING UNDERWRITER OF SAID ISSUE
AND FIXING THE TERM OF SAID NOTES; AUTHORIZING
THE USE OF A COLLATERAL FUND SECURED BY A PLEDGE

meeting, that person shall ensure that a verbatim record of.the
