AN ORDINANCE AUTHORIZING THE CITY
MANAGER, ON SPECIAL OCCASIONS AND FOR
SPECIAL EVENTS OR PROGRAMS, TO PERMIT
THE SALE OR DISPENSING OF WINE OR BEER
IN SOFT CONTAINERS IN CERTAIN CITY
PARKS; FURTHER ESTABLISHING A PERMIT FEE
OF $300 PER DAY FOR SAID SALE OF WINE
AND BEER.
WHEREAS, the City of Miami encourages and supports the use
of City Parks for recreational events by the convention industry
as well as civic -minded organizations; and
WHEREAS, it is appropriate on special occasions and in
conjunction with special events or programs that the dispensing
of wine or beer be authorized in City Parks;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. a. Notwithstanding any provision in the City
Code of the City of Miami, Florida, to the contrary, the City
Manager or his/her designee, on special occasions and for special
events or programs, is hereby authorized upon execution of the
application/permit form as attached, to permit tine sale or
dispensing of wine or beer in soft containers in the following
City Parks:
Bayfront Park
Bicentennial Park
FEC Property
Jose Marti Park
Peacock/Myers Park
Watson Island Park
There shall be no permits issued in
connection with any musical event or program of the type which
historically requires extraordinary security measures, based upon
prudent police protection (commonly referred to as "rook
concerts").
b. The City Manager or his/her designee is
further authorized to permit the dispensing of beer and wine in
soft containers at no charge during social functions in
Wainwright Park.
c. Such sale or dispensing of beer and wine
is subject to compliance with all applicable State laws and the
criteria set forth on the attached form.
Section 2. A fee of $300 per day is hereby established for
permits to sell beer and wine in said City Parks. Said fee shall
be paid for all permits obtained from the City Commission or the
City Manager or his/her designee; said payment of $300 shall not
be required where the permit has been issued before the effective
date of this ordinance.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 5. It is the intention of the City Commission that
the herein provisions shall become and be made part of the Code of
the City of Miami, Florida, as amended, all of which provisions
may be renumbered or relettered and the word "ordinance" may be
changed to "section", "Article", or other appropriate word to
accomplish such intention.

1. If permit is to sell beer or wine, the applicant will have
valid vendor's occupational licenses issued by the City of
Miami and Dade County unless this requirement is deemed
inapplicable by the City Manager, or his/her designee.

United States of America now existing or established in

3. Applicant shall save and hold harmless the City of Miami
in the event of any claim or legal proceeding arising
under this permit or any tort resulting from applicant's

4. Applicant shall have in force, at all times during this
permit period, Liability Insurance on a Comprehensive
General Liability Coverage Form or its equivalent, with a
combined single limit of at least $1,000,000 for bodily
injury liability and property damage liability. Products
and Completed Operations coverage, Personal Injury,
Contractual Liability, and premises Medical Payments
coverage must be included. The City of Miami must be
named as an Additional Insured on the policy.

Criteria:
A. To sell beer anti, or wine, either cii` event
producers or the charity must he a not -for -
profit organization chartered In cr.e State of
Florida.
B. if the event producer is raising tends for
another organization, there must be written
documentation describing the rel«tionship and
the portion of revenues to be doni.tec:.
2. The hiring of off -duty police officers based on
the anticipated attendance will be a requirement
for all event producers Selling bee.:: or wine.
3. Pre -payment for all City charges, including permit
tees and off -duty police, will b= required or
event producers. Payment, by cashier's check or
money order, must be made two (2) weeks in "dvanc:e
of the event.
4. city Staff will prepare aii permits.
5. The producers will be issued a permit upon their
provision of any required State permits, insurance
certificates, and proof of advance payment for all
City services. All documentation must be
submitted at least two (2) weeks in advance of the
event.

BACKGROUND:
_ Uver the past caiendar year, the City Commission has been asked
for permission to sell or dispense beer and wine for 28 events in
City Parks or other City properties. Often, these requests were
made as pocket items or personal appearances only days prior to
the events and without contacting the Parks and Recrudtion
Department, leaving little or no time to adequately monitor the
events or plan staff assignments.
The delegation of authority to the City Manager or his designee
to approve requests for social events or fund raisers will
greatly reduce the administrative processing time currently
required, and will establish criteria to be uniformly applied to
all applic,.:.-its .

events produced by either non-profit organizations or by for -
profit groups to raise funds for charities. Requests for
permission to sell beer and wine for any event which is riot a
fund raiser should continue to be presented to the City

limited to events in Bayfront, Bicentennial, FEC, Jose Marti,
Peacock/Myers, Watson island and Wainwright Parks. Permits for

This ordinance authorizes the City Manager to permit the sale or
dispensing of beer or wine in certain City Parks and establishes
a permit fee of $300 per day for said sale. In the ordinance
which was distributed in your packet there was uncertainty as to
the requirement for payment of the fee for events approved by the
Commission prior to the effective date of this ordinance. In
Section 2 language has been added setting forth the fact that the
$300 payment shall only be required for permits granted after the
effective date of this ordinance. The attached ordinance should
be substituted for the one in your packet.
ITEM #46
This ordinance authorizes the issuance of up to $60,000,000 of
special construction revenue notes. In the draft distributed in
your packet the following language appeared in Section 1:
"Contingent upon the adoption of favorable Federal Tax
Legislation....". After consultation with Bond Counsel the
{ language has been changed to read as follows: "Contingent upon
the structuring of a program that meets the requirement for tax
exemption in the Federal Internal Revenue Code....". This
attached revised ordinance should be substituted for the one in
your packet.

The attached Ordinance concerning a city-wide Beer and Wine
Policy was approved on First Reading at the February 13, 1986
Commission Meeting. Pursuant to the expressed concern of the
Commission, language has been added to the Oridinance (Section 1)
to preclude the issuance of such permits in connection with
events known as "rock concerts". The Ordinance also contains
more specific provision for the effective date of the permit
fee.
