RESOLUTION NO. 86-291
A RESOLUTION APPROVING THE REQUEST OF THE
BELLE MEADE HOMEOWNERS` ASSOCIATION INC. THAT
THE PROHIBITION OF VEHICULAR ACCESS TO N.E.
72 TERRACE, N.B. 73 STREET, N.E. 74 STREET,
N.B. 75 STREET AND N.E. 77 STREET AT THE
EASTERLY SIDE OF THEIR INTERSECTION WITH N.E.
6TH COURT IN THE CITY OF MIAMI, FLORIDA, BE
IMPLEMENTED ON A PERMANENT BASIS; REQUIRING
THE CITY PUBLIC WORKS DEPARTMENT WITHIN 30
DAYS, TO REPORT BACK TO THE CITY COMMISSION
WITH A PROPOSED NEIGHBORHOOD INTERNAL RE-
ROUTING PLAN TO SLOW THE SPBED AND REDUCB THE
VOLUME OF VEHICULAR TRAFFIC ON N.E. 76 STREET
IN ORDER THAT NO SINGLB STREET

IN AC
WHEREAS, the Belle Meade Homeowners' Association Inc., a
Florida not -for profit corporation, hereinafter referred to as
Association, was founded to promote the welfare and safety of the
residents of the Belle Meade neighborhood; and
WHEREAS, on September 26, 1985, the City Commission passed
Resolution No. 85-1013 authorizing the Association to oonstruct
and maintain, for a 90-day trial period, temporary barricades in
the Belle Meade area of the City, subject to certain conditions
which have been met; and
WHEREAS, the Association has requested a permanent
restriction of vehicular access to the Belle Meade neighborhood
by the ereotion of immovable landscaped barriers across N.B. 72
Terrace, N.E. 73 Street, N.B. 74 Street, N.E. 75 Street and N.E.
77 Street at the east side of their intersection with N.B. 6th
Court; and
WHEREAS, the Police Department, Fire, Rescue and Inspection
Services Department and Solid Waste Department have evaluated the
effects of the vehicular access restriction upon their respective
operations during the 90-day trial period and have expressed no
objections to the permanent restriction of vehicular access to

the Belle Meade neighborhood provided that access for emergency
vehicles be allowed at all times; and
WHEREAS, Section 84-17 of the Code of the City of Miami,
Florida► gives the City Commission the power, after a properly
advertising public hearing, to require that vehicular access to a
partioular street be prohibited at an intersection where such
prohibition is found to be in the best interest of the public;
and
WHEREAS, pursuant to due public notice, a public hearing was
held before the City Commission on April 10, 1986, as to any
objections to the permanent prohibition of vehicular access at
N.B. 72 Terrace, N.B. 73 Street, N.B. 74 Street, N.E. 78 Street
and N.B. 77 Street at the easterly side of their intersection
with N.E. 8 Court and no objections were sustained by the
Commission; accordingly, the City Commission has approved the
Assooiation's request that the prohibition of vehicular access at
the above intersections be implemented on a permanent basis
while, at the same time, the City Commission has required the
City Publio Works Department within 30 days,to report back to the
City Commission with a proposed neighborhood internal re-routing
plan to slow the speed and reduce the volume of vehioular traffic
on N.B. 78 Street in order that no single street in the
neighborhood be burdened with the effect or impact of the changed
traffic flow resulting from such implementation; and
WHEREAS, the City Commission finds that the herein.
prohibition is in the best interest of the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
