A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO EMPLOY TWO LAW FIRMS TO PERFORM LEGAL SERVICES RELATIVE TO THE SOUTHEAST t `i OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT PROJECT AND THE DOWNTOWN DEVELOPMENT OF REGIONAL IMPACT AT FEES DEEMED REASONABLE AND APPROPRIATE BY THE CITY ATTORNEY WITH FUNDS THEREFOR NOT TO EXCEED $25,000 FOR EACH OF SAID FIRM'S ALLOCATED FROM THE CITY OF MIAMI'S 1976 GENERAL OBLIGATION HOUSING BONDS, THE SECTION 108 LOAN FROM THE U.S. DEPARTMENT HOUSING AND URBAN DEVELOPMENT, THE OPERATING BUDGET OF THE DEPARTMENT OF DEVELOPMENT, THE COMMUNITY DEVELOPMENT BLOCK ( GRANT FUNDS AND SPECIAL PROGRAMS AND ACCOUNTS CONTINGENT FUND. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: r ; Section 1. The City Attorney is hereby authorized to retain the professional services of (a) Eugene Shy, Jr . , and the Law Offices of Beatty and Shy, 25 Southeast 2nd Avenue, Suite 247, ¢�k Miami, Florida, 33131 and (b)the professional services of Robert N. Sechen, and the firm of Blackwell, Walker, Fascell & Hoehl, xTM 2400 AmeriFirst Building, One Southeast Third Avenue, Miami, { + Florida 33131 to perform legal services including but not limited to respectively: (a)the issuance of title insurance binders and policies for negotiated transactions and the rendering of opinions of title; and, (b)the acquiring of a Development Order for the Southeast Overtown/Park West Redevelopment Project as a Development of Regional Impact and participation at trial during condemnation proceeding for the Southeast Overtown/Park West Redevelopment Project; and to provide assistance in the acquiring of a Development Order for the Downtown Development of Regional Impact. Section 2 (a) . The hourly rate for the services provided by Eugene Shy, Jr., and the Law Of f ices of Beatty & Shy shall be that rate previously set by the City Commission in Resolution No. 85-617 passed on June 13, 1985, said rate being deemed reasonable and appropriate by the City Attorney. Sechen and the firm of Blackwell, Walker, Fascell & Hoehl shall be negotiated by the City Attorney at a rate deemed reasonable and appropriate by the City Attorney and shall not exceed $125.00 per hour. Section 3. An amount not to exceed $25,000 for each of said law firms is hereby allocated for the services authorized by this Resolution from the City's 1976 General Obligation Housing Bonds, the Section 108 Loan from the U.S. Department Housing and Urban Development, the operating budget of the uepaLuuciiL. The effect of the negotiated sales, while increasing the cost of outside counsel providing title insurance and closing services, essentially means a substantial saving to the City in that legal counsel for condemnation proceedings will not be necessary for these the parcels. The hourly rate for the services has- been set by Y Commission in Resolution 85-617. The legal services to be rendered by Beatty & Shy shall be as dewed appropriate by this office. ��.
