ORDINANCE NO. 1 0 09 8
AN ORDINANCE AMENDING THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED, BY REPEALING
IN THEIR ENTIRETY CODE SECTIONS 2-156,
2-157, AND 2-158 OF SAID CODE TO FORMALLY
ABOLISH THE TOURIST PROMOTION DEPARTMENT;
FURTHER PROVIDING THAT ALL REFERENCES IN THE
CODE OF THE CITY OF MIAMI. FLORIDA, AS
AMENDED, TO THE TOURIST PROMOTION DEPARTMENT
SHALL BE DELETED THEREFROM; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, Section 19A of the Charter of the City of Miami
provides that the Commission may create new departments of
discontinue any department and determine, combine, and
distribute the functions and duties of departments and
subdivisions thereof; and
WHEREAS, in adopting the Annual Appropriations Ordinance
for the year ending September 30, 1980, the Commission exercised
such authority and transferred to various City Departments
assigned personnel, functions and all duties theretofore
performed by the Tourist Promotion Department; and
WHEREAS, the general public was thereby served in a more
efficient and satisfactory manner; however, this ordinance will
appropriately memorialize the City Commission's prior action;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1, Sections 2-156, 2-157 and 2-158 of the Code
of the City of Miami, Florida, as amended, are hereby repealed in
their entirety.
Section 2. All references to the Tourist Promotion
Department appearing in the Code of the City of Miami, Florida,
as amended, are hereby deleted therefrom.
The transfer to various City Departments of
personnel, duties, functions and records previously assigned
separately to the Tourist Promotion Department is hereby
ratified, approved, and confirmed; said transfer having been made
pursuant to the adoption of Ordinance No. 9000 on October 17,
1979, the Annual Appropriations Ordinance for the fiscal year
ending September 30, 1980.
Section 3. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are hereby
repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

In accordance with the attached January 30, 1986 memorandum from
Manohar S. Surana, the Director of the Department of Management
and Budget, we have drafted an ordinance which will appropriately
amend the provisions of the City Code to reflect the City
Commission's prior action in adopting Ordinance No. 9000, the
Annual Appropriation Ordinance for the Fiscal Year ending
September 30, 1980.
While immediate placement on the Agenda is unnecessary, such
placement should not be unduly delayed.

Promotion ceased to functionally exist with the adoption of the FY 1979-80
— budget, this department still exists legally as established in Sections
2-156-158 of the Miami Code. If the Law Department determines that this
reference is unnecessary, legislation should be initiated to remove it from the
Code.

THE VOTERS BY THE OCTOBER 7, 1980, BOND ELECTION

Said proposed ordinance(s) may be Inspected by the public at the
office of the City Clerk, 3500 Pan American Drive, Miami, Florida,
Monday through Friday, excluding holidays, during the hours of 8:00
j A.M. to 5:00 P.M.
All Interested parties may appear at the meeting and be heard with
respect to the proposed ordinance(s).
Should any person desire to appeal any decision of the City Com-
mission with respect to any matter to be considered at this meeting,
that person shall ensure that a verbatim record of the proceedings is
made Including all testimony and evidence upon which any appeal
may be based.
