AN ORDINANCE AMENDING ORDINANCE
NO. 10021 ADOPTED ON JULY 18, 1985 ESTABLISH-
ING RESOURCES AND APPROPRIATIONS FOR THE LAW
ENFORCEMENT TRUST FUND RECEIVED AND DEPOSITED
PURSUANT TO ORDINANCE NO. 9257, ADOPTED APRIL
9, 1981 WHICH CREATED SAID FUND, BY INCREASING
THE RESOURCES AND APPROPRIATIONS IN THE AMOUNT
OF S549,877 AS A RESULT OF ADDITIONAL MONIES
DEPOSITED IN SAID FUND DUE TO SUCCESSFUL
FORFEITURE ACTIONS;CONTAINING A REPEALER
PROVISION AND A SERVERBILITY CLAUSE.
WHEREAS, The Florida Legislature amended section 943.41 through
943.44, the "Florida Contraband Forfeiture Act"; and
WHEREAS, the amendments to the "Florida Contraband Forfeiture
Act" were designed to aid law enforcement agencies by providing in
part for municipal law enforcement agencies to pursue forfeiture
actions at law against seized property; and
WHEREAS, the amendments of the "Florida Contraband Forfeiture
Act" provided that proceeds of all successful forfeiture actions at
law be deposited into a special "Law Enforcement Trust Fund" to be
utilized as prescribed by law for law enforcement purposes only; and
WHEREAS, by Ordinance No. 9257 adopted April 9, 19811 the City
Commission fulfilled the requirements of sections 943.44(3)(9) and
943.44(5), Florida Statues(1980), relating to the proceeds from the
sale or other aquisition of forfeited property; and
WHEREAS, Ordinance No. 10021 adopted on July 18, 1985
established resources and appropriations for the "Law Enforcement
Trust Fund in the amount of $1,896,825; and
WHEREAS, The Police Department has notified the Department of
Management and Budget that as a result of successful forfeiture
actions there is an additional $549,877 available to be deposited in
the "Law Enforcement Trust Fund";
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 10021, adopted July 18,
1985, is hereby amended in the following particulars:1/
"Section 1. The following resources and appropriations are
hereby established for the 'Law Enforcement Trust Fund':

Section 2. The resources and appropriations for the "Law
Enforcement Trust Fund" are hereby increased by $549,877 as a
result of additional monies deposited in said Fund due to
successful forfeiture actions.
Section 3. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are hereby
repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

DEPOSITED PURSUANT TO ORDINANCE NO.

In 1980, the Florida Legislature amended section 943.41 through 943.44,
the "Florida Contraband Forfeiture Act".
Said amendments to the "Florida Contraband Forfeiture Act" were
designed to aid law enforcement agencies by providing in part for
municipal law enforcement agencies to pursue forfeiture actions
against seized property.
The amendments of the "Florida Contraband Forfeiture Act", provided
that proceeds of all succesful forfeiture actions at law be deposited
into a special "Law Enforcement Trust Fund" to be utilized as
prescribed by law for law enforcement purposes only.
Ordinance No. 10021 adopted July 18, 1985 established resources and
appropriations for the "Law Enforcement Trust Fund" in the amount of
$1,896,825. The attached Ordinance increases said amount by S549,877
as a result of successful forfeiture actions initiated by the Police
Department. The new total is $2,446,702.
The attached proposed ordinance is scheduled for the March 19, 1986
City Commission meeting.
