AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE 'ZONING ORDINANCE OF
THE CITY OF MIAM I, FLORIDA, BY CORRECTING A
SCRIVENER'S ERROR AFFECTING PROPERTY LOCATED
AT APPROXIMATELY 2601 SOUTHWEST 28TH STREET,
MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED
HEREIN), 13Y INCLUDING THE APPLICATION OF THE
SPI-3 COCONUT GROVE MAJOR STREETS OVERLAY
DISTRICT 0MITT ED IN ORDINANCE NO. 10074,
JANUARY 23, 1986; AND CONFIRMING ITS
REZONING FROM RS-2/2 ONE FAMILY DETACHED
RESIDENTIAL TO CR-2/7 COMMERCIAL RESIDENTIAL
(COMMUNITY) AND APPLYING THE SPI-3 COCONUT
GROVE MAJOR STREETS OVERLAY DISTRICT ORDAINED
BY ORDINANCE NO. 10074, JANUARY 23, 1986;

ZONING ATLAS MADE A PART OF ORDINANCE
NO. 9500, BY REFERENCE AND DESCRIPTION IN
ARTICLE 3, SECTION 300, THEREOF; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
November 25, 1985, Item No. 3, following an advertised hearing,
adopted Resolution No. ZB 156-85, by an 8 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification and recommending
the application of the SPI-3 Coconut Grove Major Streets Overlay
District, as hereinafter set forth; and
WHEREAS, the subject property was properly rezoned to CR-2/7
Commercial Residential (Community) by Ordinance No. 10074 on
January 23, 1986; and
WHEREAS, a scrivener's error resulted in the omission from
said Ordinance of language which provided for the application of
the SPI-3 Coconut Grove Major Streets Overlay District; and
WHEREAS, it was never the intention of this Commission to

omit the application of the SPI-3 Coconut Grove Major Streets
Overlay District; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
correct the scrivener's error and designate the zoning
classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA.
Section 1. That OrdinancN No. 10074, passed and adopted
by this Commission on January 23, 1986, mistakenly contained a
scrivener_'s error by it-,i omission of the application of the SPI-3
Coconut Grove Major Streets Overlay District for the subject
property located at approximately 260.1 Southwest 28th Street,
Miami, Florida, more particularly described as Lots 30 through 42
inclusive, Block 3, SILVER BLUFF 13USINESS CENTER, Plat Book 14,
Page 76, of the Public Records of Dade County, Florida.
Section 2. The rezoning of the subject property
contained in Ordinance No. 10074, passed and adopted on
January 23, 1986, is hereby reaffirmed in its rezoning of said
parcel from RS-2/2 One -Family Detached Residential to CR-2/7
Commercial Residential (Community), including the application of
the SPI-3 Coconut Grove Major Streets Overlay District.
Section 3. Page 43 of the Zoning Atlas, made part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by amending the Ordinance to include the
application of the SPI-3 Coconut Grove Major Streets Overlay
District.
Section 4. All ordinances, code sections, or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

It is recommended by the City Attorney that the correction
of a scrivener's error which omitted language that provided for
the application of the SPI-3 Coconut Grove Major Streets Overlay
District from the rezoning for the property located at
approximately 2601 Southwest 28th Street from RS-2/2 One Family
Detached Residential to CR-2/7 Commercial Residential (Community)
per Ordinance No. 10074, passed and adopted on January 23, 1986,
be approved through your adoption of the attached ordinance.
Since the Zoning Board's action was based on the matters
contained in this proposed ordinance, it is unnecessary to have
the Zoning Board consider this matter further.
