RESOLUTION NO. 86-409
A RESOLUTION CLOSING, VACATING? ABANDONING
AND DISCONTINUING THE PUBLIC USE OF THE
UTILITY EASEMENTS LOCATED + 105' NORTH OF THE
NORTH RIGHT-OF-WAY LINE OF NORTHWEST 36TH
STREET AND RUNNING EAST -WEST FOR A DISTANCE
OF + 1701, AS INDICATED ON THE PLAT OF
"HANSON SUBDIVISION," RFCORDED IN PLAT BOOK
123 AT PAGE 7, OF THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, AS A CONDITION OF APPROVAL
OF TENTATIVE PLAT NO. 1269-A - "2ND REVISED
PLAT OF HANSON SUBDIVISION."
WHEREAS, the Miami Zoning Board, at its meeting of
March 17, 1986, Item No. 4, following an advertised hearing,
adopted Resolution No. ZB 25-86, by a 8 to 0 vote, RECOMMENDING
APPROVAL of the official vacation and closure of a utility
easements, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
grant the vacation and closure of the utility easements in
question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The utility easements located + 105' north of
the north riqht-of-way line of Northwest 36th Street and running
east -west for a distance of + 170' , as indicated on the Plat of
"HANSON SUBDIVISION," recorded in Plat Book 123 at Page 7, of the
Public Records of Dade County, Florida, as a condition of
APPROVAL of Tentative Plat No. 1269-A - "2ND REVISED PLAT OF
HANSON SUBDIVISION," is hereby closed, vacated, abandoned and
discontinued for public use.

Street Committee approved the above tentative
plat subject to the following:
A. Public hearing for approval to close utility
easements.
B. Correct reference to previous subdivision in
title.
C. Revise Lot lines to coincide with City limit
lines.
D. Clarify "purpose of plat" to indicate
closure of utility easements only.
E. Suggest property owner obtain change of
zoning in County portion to coincide with
City zoning
F. Any necessary utility easements.
G. Alteration, relocation or installation of
utilities at the property owner's expense.
H. Provision for subdivision improvement
requirements.

December 4, 1985, approved the above tentative plat subject to
the following revisions being made to the tentative plat,
additional information being provided and/or variances being
granted. Please be advised that the processing of your
tentative plat cannot proceed until these conditions have been
satisfied.

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water: etc., caused by this plat will be at the property
owners expense. Also, utility easements may be required
on the property being platted.
3. A building permit
will not be issued on the property

platted until the final plat is recorded. Also,

Certificate of Occupancy
for any building construction

be issued only
after all the required subdivision
improvements have
been completed.

flow requirements must be obtained

and Inspection Services Department

time it was approved.

EASEMENTS LOCATED + 105' NORTH OF THE NORTH
RIGHT-OF-WAY LINE aF NW 36 STREET AND RUNNING
EAST -WEST FOR A DISTANCE OF + 170, AS A
CONDITION OF APPROVAL OF TENTATIVE PLAT
#1269-A - "2ND REVISED PLAT OF HANSON
SUBDIVISION".
Upon being seconded by Mr. Arsenio Milian, the motion
was passed and adopted by the following vote:
