WHEREAS, Section 19A of the Chir.ter of the City Of Miami
provides that the City Commission may create new departments or
discontinue any department and dt� ermine, combine, and distribute
the functions and duties of departments and subdivisions thereof;
and
WHEREAS, it is the desire of the City Commission to exercise
such authority and to create a new department to be known as the
Housing Conservation and Development Agency and to distribute and
transfer to it all of the functions and duties heretofore
performed by the Housing Division of the Department of Community
Development; and
WHEREAS, the general public will be served thereby in a more
efficient and satisfactory manner;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Paragraph (5) of Section 2-178 of the Code of the
City of Miami Florida, as amended, is hereby repealed in its
entirety.
Section 2. The following new provisions are hereby added to
the Code of the City of Miami, Florida as amended:
"Section . Created.
A department to be known as the Housing Conservation
and Development Agency is hereby created.

The Housing Conservation and DQve.lopme11t. Agency,

(l) develop, implement and manage al l programs related to
provi(3ing housing assistance initiated by the City
Commission, not including public housing.
(2) evaluate and recornmen(l priorities for an annual. Housing
Assistance Plan, provi(le for staEf review and the
evaluation and coordination of said review;
(3) plan and implement projects to preserve, improve and
expand the City's housing stock including but not
limited to the utilization of r(-sources provi(ie,_1 by the
Federal, State and County government;
(4) assist private developers in preserving, improving
and expanding the City's housing stock; and
(5) develop and coordinate the implementation of citywide
housing improvement strategies and recommend programs to
further the goals of the strategy.
Section . Special Assignments
The department director, subject to specific
authorization by the City Manager., is also empowered to
carry out special assignments in matters not expressly set
forth herein.
Section Establishment of operating procedures and
responsibilities.
The City Manager may, from time to time, issue
directives setting forth operating procedures to be followed
and responsibilities to be discharged by the department
director.
Section 3. All funds, personnel, records, and equipment
currently budgeted for. the Housing Division in the budget of the
Department of Community Development are hereby transferred and
assigned to the Housing Conservation and Development Agency.
Section 4. All ordinances or parts of ordinances, insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance, are hereby repealed.
Section 5. If any section, part of a section, paragraph,
clause, phrase, or word of, this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. It is the intention of the City Commission that
the provisions of this Ordinance shall become and be made a part

Florida, as amended; containing a
repealer provision and a severability
clause.
On February 13, 1986, through Resolution No. 86-124, the City
Commission approved, in principle, the establishment of a department
of city government to be responsible for the conservation of Miami's
existing inventory of housing affordable to low and moderate income
families and the expansion of housing resources within the
affordability range of families of low and moderate income.
On April 10, 1986, the City Commission passed, on first reading, an
_ ordinance creating the Miami Housing Conservation and Development
Agency to fulfill these function. The second reading of the
Ordinance has been scheduled for the City Commission meeting of May
7, 1986.
For the remainder of the current fiscal year, the Housing
Conservation and Development Agency's work program will involve
continuation of the work program of the Housing Division of the

Department of Community Development (see Exhibit A, attached). The
Housing Conservation and Development Agency's FY 86-87 work program
will involve continuation of the Housing Division's current work
program and expansion into new housing conservation and development
programs and projects. (see Exhibit B, attached).
The Housing Conservation and Development Agency's operating budget
will not require an infusion of General Funds. All programs and
projects operated by the Agency will be self-sustaining. Attached as
Exhibit C is the Agency's proposed operating budget for FY 86-87,
indicating the sources and uses of program funding.
Also enclosed is a summary report outlining the advantages to the
City of establishing a housing conservation and development agency.
City Commission approval of the Ordinance on second reading is
recommended.

INTRODUCTION
One of the major problems confronting the City of Miami is the
lack of availability of an adequate supply of standard housing
affordable by families and individuals of low and moderate
income. With the federal government's termination of most housing
assistance programs, the mainstay of both public and private
sector assisted housing development efforts, the task of meeting
Miami's present and future housing needs will be difficult, at
best.
It is clear that any progress in meeting Miami's present and
future housing needs will require direct involvement by the City
to a far greater degree and in a different capacity than has
previously been the case. Rather than serving as local
administrator for federally regulated housing assistance
programs, the City must assume the new role of promulgator of
local housing development assistance programs using limited
federal and state assistance dollars as they become available in
partnership with the private sector. Where the actual production
of needed housing resources can only be accomplished by the
private housing industry, the City's role must be to provide an
atmosphere conducive to the profitable investment of capital by
the private sector in housing through land assembly and cost
write -down, tax-exempt project financing, and streamlining of the
local housing project development approval process.

Moreover, with scarce resources available to finance new housing,
the City must place increasing emphasis on conservation of the -
existing housing inventory, including a continuation of ongoing
efforts to recycle deteriorating housing through low-cost
financing and cyclical enforcement of housing quality standards
to prevent the deterioration of now standard housing units;
rental housing units in particular. -
THE NEED FOR A UNIFIED APPROACH IN HOUSING CONSERVATION AND
PRODUCTION
The magnitude of the housing problem in Miami, as best
illustrated by the fact that approximately 50,000 low-income
families are now living in substandard or overcrowded housing or
are paying excessive shelter costs, dictates the need for a
unified response by the City if real progress is to be made in
ameliorating the housing shortage.
- At present, there are several agencies and departments of City
and County government with different but mutually supportive and
interdependent roles involved in the conservation and production
of housing in City. These include Metropolitan Dade County's
Department of Housing and Urban Development, the City's public
and Section 8 housing administrative agency and the county -wide
agency for administering the Documentary Surtax program; Dade
County's Office of Minimum Housing, responsible for enforcing the
City's minimum housing code; the Southeast Overtown/Park West
Office, charged with providing public sector assistance to
private sector developers of low and moderate income housing in

the Overtown/Park West Redevelopment Area; the City of Miami
Fire, Rescue and Inspection Service Department, with housing
regulatory responsibilities and powers; and the City's Department
of Community Development, which is responsible for administering
Citywide housing rehabilitation financing programs, the provision
of technical assistance and funding direction to developers of
non -luxury housing, performing site reviews for public housing
and privately developed federally subsidized housing, and
administering the City's Housing Assistance Plan.
THE CASE FOR A CITY HOUSING CONSERVATION AND DEVELOPMENT AGENCY
While individually and in combination these departments and
agencies of City and County government have made a significant
contribution in the provision of housing for Miami's low and -
moderate income families and individuals, opportunities for
providing housing in a timely manner have also been lost due to
time lags inherent in the existing interdepartmental -interagency
project approval and implementation process.
The objective of meeting Miami's housing needs can best be served
through the establishment of one office of City government,
centralizing the planning and administration of all housing
conservation and housing development activities. The advantages
of establishing such an office are many. Limited federal, state,
and local housing development resources will be more efficiently
used through streamlined project administration. The elimination
of interagency -interdepartmental project approvals will allow
planned housing projects to move forward with greater speed.
Non-profit and private developers of housing will benefit from

the elimination of the existing maze of agencies and departments,
all of which have a responsibility in approving most housing
development ventures. Federal and state agencies will be
provided with a single office to which to communicate information
on available project funding.
For these reasons, the establishment of a high visibility housing
office is recommended. Such a housing office would not require
general fund revenue from the City for operational purposes.

available, including:

Section 8 Certificate and Voucher administrative fees
General Obligation Housing Bond income
Compliance standards fees
Documentary Surtax Funds
