ORDINANCE. 110.
AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO.
9939, ADOPTED DECEMBER 20, 1994, AS A"ENDED, THE
CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY
ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT
ENTITLED: "OLYMPIC SAILING AND TRAINING
CENTER", APP?OPRIATING FUNDS FOR THIS PROJECT
IN THE AMOUNT OF $100,000 FROM THE DINNER KEY
ENTERPRISE FUND; AND BY INCREASING THE
APPROPRIATIONS FOR TWO EXISTING PROJECTS
ENTITLED: "DESIGN PLAZA STREET IMPROVEMENT" .AND
"NORTH RIVEP DRIVE STREET IMPROVEMENTS" IN THE
AMOUNTS OF $220,000 AND $400,000, RESPECTIVELY,
FROM 1980 HIGHWAY GENERAL OBLIGATION BONDS AND
1970 AND 1978 STORM SEWER GENERAL OBLIGATION
BONDS; CONTAI►IING A REPEALER PROVISION AND A
SFVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10080 on February 13,
1986, which amended Ordinance No. 9939, to establish appropriations for
capital improvements, continue previously approved capital improvement
projects, and establish new capital improvfinent projects to begin during
fiscal year 1985-86; and
WHEREAS, the City Commission adopted Resolution No. 86-49 on January 23,
1986, authorizing the City Manager to execute a use permit agreement with the
United States Yacht Racing Union and allocating $100,000 from the Marinas
Enterprise Fund to develop an olympic sailing and training center on the
southeasterly portion of David T. Kennedy Park; and
WHEREAS, the City Commission adopted Ordinance 410080 on February 13,
1986, appropriating $1,100,000 for the North River Drive Highway Improvement;
_ and
WHEREAS, the City Commission adopted Resolution No. 86-351 on May 7,
1986, awarding a bid of $1,268,988 to Southeastern Concrete Floor Company,
Inc. for the North River Drive Highway Improvement; and
WHEREAS, an additional $400,000 from the 1980 Highway General Obligation
Bond Fund is needed for this project; and
WHEREAS, the City Commission adopted Ordinance #10080 on February 13,
1986, appropriating $500,000 from 1980 Highway General Obligation Bonds and
$100,000 from 1970 and 1978 Storm Sewer General Obligation Bonds; and
WHEREAS, the City Commission adopted Resolution No. 86-383 on May 7,
1986, awarding a bid of $693,108 to FRE Construction Company for Design Plaza
Street Improvements; and
WHEREAS, an additional $150,000 from 19R0 Highway G.O. Bonds and $70,000
from 1970 and 197R Storm Sewer General Obligation Bonds are needed for this
project;
NOW, THEREFORE, BE IT nRDAINEn BY THE COMMISSION OF THE CITY OF MIAMI,
FLORI DA :
Section 1. Section 1 of Ordinance No. 9939, adopted necemb(, ?1) 1984,
is hereby amended in the following particulars: 1/

On January 23, 1986, the City Commission adopted Resolution No. 86-49
allocating $100,000 from the Marinas Enterprise Fund to develop an olympic
sailing and training center on the southeasterly portion of David T. Kennedy
park. On May 7, 1986, the City Commission adopted Resolution Nos. 86-361 and
86-362 which authorized the City Manager to issue a permit to the United
States Yacht Racing Union setting forth the terms and conditions for the use
of a portion of the Park. The proposed ordinance simply establishes this
project as a capital project for proper accounting purposes.
We are placing this project on the agenda as an emergency because the City is
entering into the aforementioned agreement with the United States Yacht Racing
Union which requires that the City have a usable training site for Olympic
sailing teams completed by October 1, 1986. It is necessary to bid the
construction work as soon as possible to meet this deadline.
The Public Works Department needs additional revenue to complete the Design
Plaza and North River Drive street improvements. On May 7, 1986, the City
Commission accepted a $1,268,988 bid from Southeastern Concrete Floor Company,
Inc., for North River Drive Highway Improvements and a $693,108 bid from FRE
Construction Company for the Design Plaza Street Improvements. The City
Commission needs to appropriate the necessary funds to cover the award of
these bids.
