SC -5 2 3: A RESOLUTION ISSUING A MAJOR USE SPECIAL PERMIT ATTACHED AS EXHIBIT "A"; APPROVING WITH CONDITIONS, THE MIAMI ARENA PROJECT LOCATED AT APPROXIMATELY 702- 798 NORTH MIAMI AVENUE, APPROXIMATELY 727-799 N.W. 1ST AVENUE, APPROXIMATELY 2-98 N.W. 8TH STREET, AND APPROXIMATELY 16-68 N.W. 7TH STREET (MORE PARTICULARLY DESCRIBED HEREIN AS TRACTS A & B OF CITY OF MIAMI TENTATIVE PLAT #12809 DATED APRIL 19869 REVISED APRIL 24, 1986); MAKING FINDINGS; INCORPORATING A DEVELOPMENT IMPACT STUDY BY REFERENCE; PROVIDING THAT THE MAJOR USE SPECIAL PERMIT SHALL BE BINDING ON THE APPLICANT AND SUCCESSORS IN INTEREST, AND DIRECTING THE CITY CLERK TO SEND COPIES OF THE HEREIN RESOLUTION TO AFFECTED AGENCIES AND THE DEVELOPER. WHEREAS, the proposed Miami Arena project is a Development of Regional Impact, as defined in Florida Statutes 380.06, and an Application for Development Approval has been submitted to the South Florida Regional Planning Council on April 11, 1986; and WHEREAS, a preliminary development agreement (see Chapter 380.06 F.S.) is being proposed to the Florida Department of Community Affairs which, if approved, will allow the project to preceed to construction; and WHEREAS, Cesar H. Odio, City Manager, has submitted an application for Mayor Use Special Permit for the Miami Arena; and WHEREAS, the Miami Large Scale Development Committee, at its public meeting of May 5, 1986, reviewed the application and made recommendations; and WHEREAS, the Miami Zoning Board, at its Public Hearing of June 2, 1986, reviewed the application and requests for the following variances: a variance from the open space requirements of Zoning District SPI-16.2 to permit 55 percent open space where 65 percent is required; a variance from setback requirements of Zoning District SPI-16.2 Sections 15166.2.2 and 15166.3 to permit a setback of 50 feet from N.W. 8 Street, where 0 feet is required; a variance from the Off -Street parking requirements of Section 15168.3 of Zoning Districts SPI-16.2, and Table 3 - "Standard Ratios By Land Use Intensity Sections" of the schedule of District Regulations, to permit 0 parking spaces where 341 spaces are required; and granted the requested variances by (Resolution ZB 63-86 )by a 9 to 0 vote, providing a 12-month time limit to obtain a building permit; and CITY COMMISSION ME&ING OF JUN 26 1980 1UN Nu. 86 --523: . WHEREAS, the Miami Zoning Board, at its meeting of June 2, 19869 by Resolution ZB 62-86 by a vote of 9 to 0 its official vacation and closure of a portion of N.W. 7 Street as a condition of approval of Tentative Plat #1280 - "Miami Arena Subdivision"; and WHEREAS, the Miami City Commission has pprow the vacation and closure of a portion of N.W. 7th Street in a companion item; and WHEREAS, the Miami Planning Advisory Board, at its meeting of June 4, 1986, following an advertised public hearing, adopted Resolution No. PAB 18-86 by a vote of 9 to 0, recommending approval of a Major Use Special Permit for the PROJECT; and WHEREAS, the City Commission, during a public hearing, has considered the Application for Major Use Special Permit; and WHEREAS, it is the intent that the Major Use Special Pemit shall be the instrument for implementing by one action, subsequent to City Commission authorization, all changes in the adopted Comprehensive Plan, zoning district classifications, other zoning actions or other City ordinances that would otherwise be necessary to the accomplishment of the objectives sought in the application for Major Use Special Permit; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to issue a Major Use Special Permit, as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A Major Use Special Permit, attached hereto as Exhibit "A" and made a part hereof by reference, is hereby issued, approving with conditions the proposed Miami Arena Project, to be developed by Decoma Venture and the Miami Sports and Exhibition Authority, at approximately 702-798 North Miami Avenue, approximately 727-799 N.W. 1st Avenue, approximately 2-98 N.W. 8th Street, approximately 16-68 N.W. 7th Street, being all of Block 44N, a portion of Block 57N, A.L. Knowlton MAP of Miami as recorded in Plat Block "B" at Page 41 of the Public Records of Dade County, Florida and a portion of N.W. 7th Street, being more - 2 - 86-523F . Section 2. The following findings of fact are hereby made with respect to the subject project: a. The project is in conformity with the adopted Miami Comprehensive Neighborhood Plan; and b. The project is in accord with the district zoning classification of Zoning Ordinance 9500; and The City Commission further finds that: (1) The project will have a favorable impact on the economy of the City; and (2) The project will efficiently use public transportation facilities; and (3) The project will efficiently use necessary public facilities; and (4) The project will not negatively impact the environment and natural resources of the City; and (5) The project will not adversely affect living conditions in the neighborhood; and (6) The project will not adversely affect public safety. Section 3. A Development Impact Study entitled "Application for Development Approval --Development of Regional Impact, Miami Arena", dated April, 1986, is incorporated herein by reference. Section 5. The Major Use Special Permit, as approved, shall be binding upon the applicants and any successors in interest. Section 6. EXHIBIT "A" ATTACHMENT TO RESOLUTION 86-523 June 26, 19"81i `-` MAJOR USE SPECIAL PERMIT Let it be known that the Commission of the City of Miami, Florida, has considered in public hearing on June 26, 1986; the issuance of a Major Use Special Permit: for the Miami Arena development to be located in the City of Miami, at approximately 702-798 North Miami Avenue, approximately 727-799 N.W. 1st Avenue, approximately 2-98 N.W. 8th Street, approximately 16-68 N.W. 7th Street, Miami, Florida being All of Block 44N, a portion of Block 57 N, A.L. Knowlton Map of Miami as recorded in Plat Book "B" at Page 41 of the Public Records of Dade County, Florida and a portion of N.W. 7th Street, being more particularly described as Tracts A and B in City of Miami Tentative Plat #1280, Dated April 1986, revised April 24, 1986. ALL OF THE FOREGOING SUBJECT TO any dedications, limitations, restrictions reservations or easements of record. And after due consideration of the recommendations of the Planning Advisory Board takes the following action: Authorization to Issue a Major Use Special Permit subject to the following modifications: FINDING OF FACT WITH MODIFICATIONS Development 1. Production - maintenance and engineering - team office - press - ticket offices - administrative offices - food service - five truck loading berths - one dumpster space - event services Concourse Level - 6,000 ± lower bowl seats - concessions Upper Level - 8,000 ± upper bowl seats - 1,782 ± concert configuration seats - mechanical equipment Skybox Level - 16 skyboxes - mechanical equipment Sf-523; . Page 2 of 8 The project will be constructed in one phase. The project conforms to the requirements of Zoning Districts SPI-15, SPI-16.2, and CG-2/7, Sheet 5 of 6 of the Schedule of District Regulations as contained in Zoning Ordinance 9500. The project also reflects suggestions received at the Miami Large Scale Development Committee meeting of May 5, 1986. The project will be constructed pursuant to conceptual plans and design schematics on file entitled Miami Arena Sheets E1 through E10, prepared by Lloyd Jones Fillpot, Associates, Architects, dated April 29, 1986. The project will include approximately 172,980 square feet of open space and 117,966 square feet of pedestrian open space. No off-street parking spaces are provided; the parking needs of the project will be met by the use of approximately 5,000 spaces in public and private lots and garages located within a ten minute walking distance. The applicant has also received the following variances from the requirements contained in Ordinance 9500: A variance from open space requirements of Zoning District SPI-16.2 to permit 55 percent open space where 65 percent is required; a variance from setback requirements of Sections 15166.2.2 and 15166.3 to permit a setback at 50 feet from N.W. 8th Street, where 0 feet is required; a variance from the off-street parking requirements of Section 15168.3 of Zoning District SPI-16.2, and Table 3 - "Standard Ratios 8y Land Use Intensity Sectors" of the Schedule of District Regulations, to permit 0 parking spaces where 341 spaces are required. A resolution has provided for the vacation and closure of a portion of N.W. 7th Street. This exhibit is applicable to the entire project, and constitutes the conditions for a Major Use Special Permit per Article 28 of Zoning Ordinance 9500. THE APPLICANT SHALL: 2. Use only native and other non-invasive species adapted to South Florida climatic conditions in project landscaping. (Attachment 3) 3. Notify State and local archaeological officials of construction schedules, delay construction up to three months in any area where potentially significant historic or archaeological artifacts are uncovered, and permit State and local historic preservation officials to survey and excavate the site. SG --523'.. -1 Page 3 of 8 4. Implement best management practices to minimize air pollution. 5. Provide mass transit information, such as bus and metrorail schedules and routes, to project tenants and the public. 6. Incorporate the following measures into project design and operations: * An integrated energy management system will be provided for start/stop of mechanical and electrical equipment. * Natural gas or other non -electric energy sources for water heating. * Hot water temperatures set at or below 105OF where allowed by health codes and equipment requirements. * Lavatory water flow of 0.8 gallons per minute or less, spring -loading water faucets in public restrooms, and water closets that use no more than three and one-half gallons per flush. * Light -reflecting and/or light colored wall and roof surfaces, with solar absorption coefficients less than or equal to 0.50. * Use of flow restricting shower heads. 7. Incorporate into the development, by restrictive covenant and, as applicable, in lease or sales agreements, hazardous materials accident prevention, mitigation, and response standards to be met by the Applicant and all tenants classified by a SIC code listed in Attachment 1 that use, handle, store, display, or generate hazardous materials (ignitable, corrosive, toxic, or reactive), including those identified in Attachment 2; provided, however, that the uses in Attachment 1 and the wastes in Attachment 2 shall be simultaneously amended upon the addition or deletion of any or all listed uses, materials, or wastes by amendment to the "County and Regional Hazardous Waste Assessment Guidelines" incorporated by reference into Rule 17-31.03(2), Florida Administrative Code. At a minimum, these standards shall require: * That areas within buildings where hazardous materials or hazardous wastes are to be used, displayed, handled, generated, or stored shall be constructed with impervious floors, without drains, to ensure containment and facilitate cleanup of any spill or leakage. * prohibition of outside storage or hazardous materials or hazardous waste. * all hazardous waste generators to contract with a licensed public or private hazardous waste disposal service or processing facility and to provide to the County copies of one of the following forms of documentation of proper hazardous waste management practices: SC-52X . Page 4 of 8 J-86-522 6/26/86 Revised - a hazardous waste manifest; - shipment to a permitted hazardous waste management facility; or - a confirmation of receipt of materials from a recycl er or a waste exchange operation. * the developer(s) to notify any tenant generating wastes of the penalties for improper disposal of hazardous waste pursuant to Section 403.727, Florida Statutes. * provisions of reasonable access to facilities for monitoring by the County and Florida DER to assure compliance with this condition and all applicable laws and regulations. 8. Collaborate with the City to incorporate security measures and systems into the design and operation of the project; security systems and construction documents to be reviewed by the Miami Police Department (at their option). The applicant shall report within sixty (60) days of the issuance of this Major Use Special Permit how and to what extent security systems and measures have been incorporated. 9. Obtain all necessary permits from Dade County Water and Sewer Authority Department pertaining to the provision of water and wastewater services to serve the project. 10. Work with the City to prepare a Minority Participation and Employment Plan to be submitted within ninety (90) days of the issuance of this Major Use Special Permit. 11. Work with the City to develop a Minority Contractors/Subcontractors Participation Plan to be submitted within ninety (90) days of the issuance of this Major Use Special Permit. 12. Obtain a Class "C" permit for site plan review prior to the issuance of a building permit. THE CITY SHALL: 13. 44, Collaborate with the Applicant to ensure the incorporation of security measures and systems into the design and operation of the project. Page 5 of 8 SG-523; . i, k; 14. 46, In its reconstruction of N.W. 1st Avenue, North Miami Avenue and N.W. 8th Street, permit the Arena developer to install decorative sidewalks within the public right-of-way adjacent to the Arena property so that these sidewalks match the Arena plaza area sidewalks. The developer shall bear the cost of constructing any such decorative sidewalk, however, in no event is the developer of the Arena to be responsible for the cost of construction of any other improvements within the public right-of-way adjacent to the Arena property. This is not intended to relieve the Arena developer from responsibility for expansion, reconstruction or relocation of utility lines occasioned by the construction of the Arena itself. GENERAL 15. 44, The Applicant shall submit a report, to the Planning Director, City of Miami Planning Department, twelve (12) months from the date of issuance of this Major Use Special Permit and each twelve (12) months thereafter until a final Certification of Occupancy is issued. * A general description of construction progress in terms of construction dollars and employment. * A cumulative list of all permits or approvals applied for, approved or denied. * A statement as to whether any proposed project construction changes in the ensuing twelve (12) months are expected to deviate substantially from the approvals included in this Major Use Special Permit. The Planning Director, City of Miami Planning Department, or a project director to be named later, is hereby designated to receive this report, and to monitor and assure compliance with this Major Use Special Permit. 16. 17, The conditions contained in this Major Use Special Permit may be supplemented by additional conditions to be subsequently contained in the Miami Arena Development of Regional Impact Development Order, for the mitigation of local and regional impacts of this project which are not addressed in this Major Use Special Permit. 17. The Major Use Special Permit ("permit") approved herein shall take effect upon the City of Miami Manager's approval of the "Miami Arena Contract". No building permits for the project shall be issued unless and until this Major Use Special Permit becomes effective as provided herein. This permit is issued subject to the City Manager's approval of the "Miami Arena Contract" between Decoma Venture and the Miami Sports and Page 6 of 8 8(;--523, Exhibition Authority and execution of the "Miami Arena Contract" by the Decoma Venture and the Miami Sports and Exhibition Authority. Issuance of this permit by the City Commission, in and of itself, shall not be construed to afford or create any legal rights for Decoma Venture to be the Developer of the Arena unless and until the City Manager approves the "Miami Arena Contract" and that contract is executed by Decoma Venture and the Miami Sports and Exhibition Authority. The City Planning Department will closely monitor adjacent land use activities, including the provision of public and private parking facilities, to assure that only compatible uses are estabished in the surrounding area. CONCLUSION OF LAW The Miami Arena Project, proposed by Cesar H. Odio, City Manager, complies with the Miami Comprehensive Neighborhood Plan, is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations being Zoning Ordinance No. 9500; And The proposed development does not unreasonably interfere with the achievement of the objectives of the adopted State Land Development Plan applicable to the City of Miami. BACKGROUND In order to be eligible for a National Basketball Association (NBA) franchise, groundbreaking for the proposed Miami Arena must occur by August 31, 1986. To meet this NBA deadline, the City administration is expediting the necessary approval process. Recent amendments to state legislation (Chapter 380.06(8)) allows for the possibility of a preliminary development agreement; the purpose of such an agreement is to allow expedited construction of major projects and to allow the lengthy Development of Regional Impact process to "catch up" following the inception of construction. A preliminary development agreement for the Miami Arena has been recommended to the City Commission. This Major Use Special Permit is also required by the City of Miami before the inception of construction. ANALYSIS RECOMMENDATIONS PLANNING DEPARTMENT This fall, the Miami Arena will be considered, in public hearing, by the South Florida Regional Planning council, the Planning Advisory Board and the City Commission, as a Development of Regional Impact. The Development Order to be issued at that time may address other regional and local impacts which have not been identified in the Major Use Special Permit. (See Analysis attached) Approval. SUBJECT Analysis and Recommendation - Miami Arena/Decoma Venture REFERENCES ENCLOSURES The Decoma Venture has proposed a 5.38 acre project bounded by North Miami Avenue and N. W. 1st Avenue, between the Florida East Coast Railroad right-of-way/N. W. 7 Street and N. W. 8 Street. The site is in a commercial area, with the site zoned SPI-15, SPI-16.2 and CG-2/7. The arena structure will contain approximately 300,000 gross square feet of enclosed floor area. The playing floor, or concourse level, will have approximately 16,000 square feet available for a variety of sport and concert uses. The concourse level will contain 6,000 lower bowl seats and concessions and the upper level will provide 8,000 upper level regular seats and approximately 1,782 concert seats. At the top level there will be 16 skyboxes and certain mechanical equipment. There will be a number of ancillary spaces provided which are customary for a facility of this type including: television production, maintenance and engineering, team office, press room, ticket office, administration offices, and food services. This project meets the criteria for a major use per Article 28 of Ordinance 9500, as it is a recreational facility involving in excess of 1,500 offstreet parking spaces. Analysis For projects subject to the requirements of Section 2305 Zoning Ordinance 9500, Special Permit - General, the following considerations have been addressed by the Applicant: Parking Because there are currently approximately 15,000 public and private parking spaces available within a 10-12 minute walking radius of the project site, the applicant is requesting a variance to permit zero spaces on -site. It is further estimated that approximately 5,300 parking spaces are available within an 8 minute walk of Page 1 of 6 86 -S23. the arena, and that approximately 9,700 spaces are available via Metromover, and a 20,600 person capacity is available on Metrorail (based upon 3 minute headways and six car trains). Additional factors indicating adequate mass transportation and parking space capacity is the projected use primarily during evenings and = weekend hours. Based on both applicant and City analysis there is currently more than adequate capacity to handle a sellout crowd of up to 16,592 persons. As the analysis figures indicate, there exists a huge margin of currently available parking spaces beyond the convenient three block radius. Projected use of the Metrorail and Metromover systems and park -and -ride facilities will also tend to minimize the need for additional parking spaces. Off Street Loading Five full size, 55 foot, loading bays and one dumpster bay are located at the southeast corner of the structure at ground level, with immediate access to North Miami avenue. No problems are expected in connection with deliveries of commodities or large size display articles common to these types of events. There are a number of on - site areas suitable for temporary truck holding areas in the event the bays are fully occupied. Proper loading scheduling can minimize the need for holding periods. No backing out onto any public right-of-way will be permitted. Scale of the Facade The massive appearance of the facade must be overcome by the use of appropriate design elements which should include multiple colors, texture changes, different types of glazing, transparent or translucent glass, various lighting forms, (including neon lighting) and architectural canopies, rustications and reveals. These design features should be incorporated into each elevation, with emphasis on strengthening the currently weak entrances and improving the quality of the users' experience. At the time of issuance of a Class C permit for site review, elevations accurately portraying these design concepts shall be submitted to the City along with a pallet of all materials, including color, texture, form, etc. For those materials for which samples cannot be furnished, a detailed description accompanied by photographs must be submitted. Site Development To provide a more harmonious relationship with the areas urban, high -volume, pedestrian spaces, the ground plane should be a mixture of pavement and landscaping. Trees and palms should be surrounded by grates, or paving which can accommodate lighting, irrigation, and pedestrian traffic. Trees should be hardwood varieties at least 18-20' in height, with a 12'-15' spread, 7' clear trunk and a minimum 4" caliper, planted at least 20' on center to create a shaded canopy over the paved areas. Trees and shrubbery directly adjacent to the building will serve to buffer the impact of the massive base of the structure. The tree canopy should be illuminated by well lights to accentuate pedestrian activity zones. Uplighting of plant materials and the structure proper will Page 2 of 6 further downplay the abrupt verticality of the external walls. Tree landscaping of the 8th Street frontage, and pedestrian walkway improvements to the Overtown Metrorail Station, will be required. Extending the planting of shade trees within _ the public walkways along First Avenue and Miami Avenue should also be considered. It is understood that an agreement with the Florida East Coast Railway for an easement to improve a decorative walkway connection between the Arena and the Overtown Metrorail Station, at Decoma Venture's expense is now being completed to carry out the site plan of April 1, 1986. Future plan submissions for Class 'C' permit - site plan review - should include planting, paving, irrigation, drainage, lighting and site amenities such as trash receptacles and kiosks. Ingress and Egress It is projected that the majority of the patrons will use the extensive number of public and private parking lots and garages within a short walking distance. Buses and cabs will have access via the boundary streets. Only trucks for concessionaires, special events, utilities, garbage, police, and fire service, will have access to the site proper. Refuse and Solid Waste Dade County's Solid Waste Disposal Division is presently capable of handling the projected daily volume of 0.88 tons. In addition, the Solid Waste Disposal Division is in the process of expanding their facilities. The proposed project is within the service area of the Central Transfer Station, and readily accessible from that station, Utilities The Miami -Dade Water and Sewer Authority Department has informed the applicant that they have sufficient capacity to provide both potable water and sewer services. There are existing water and sewer mains in the portion of N. W. 7 Street that will be closed and vacated, and the arena structure will be built above that street. The applicant will be required to provide, at applicant's expense, alternative lines. A similar situation exists in regard to electric, gas and telephone lines. Drainage The playing area has been designed with the average level of all footings being above the average water table for the site. This design factor will tend to reduce flood drainage, in that all habitable areas are above flood elevations. No land fill will be necessary. Page 3 of 6 86 -523: Roads It is projected that the majority of events will occur in evening and weekend hours and not impact normal peak hour travel. Acceptable traffic operation is expected throughout the year based on a typical attendance of 14,500 persons, all arriving within a one hour period during the busiest day of traffic. A portion of N: W. 7 Street between North Miami Avenue and N. W. 1st Avenue must be closed and vacated to accommodate the project. The closing will have no adverse impacts upon traffic movement, or public safety. Separate from the platting process, a series of street improvement items will be the responsibility of the City. Miami Comprehensive Neighborhood Plan The proposed Miami Arena Project is in conformance with the Miami Comprehensive Neighborhood Plan, and the Southeast Overtown/Park West Community Redevelopment Plan which provides for various special uses, including residential, commercial and industrial. Subsequent supporting zoning, per Zoning District SPI-16, further broadens the •range of appropriate uses and includes public recreational facilities. Zoni ng The proposed development has been planned within the parameters of the following zoning districts: SPI-16.2, Southeast Overtown/Park West Commercial -Residential district; SPI-15 Southeast Overtown/Park West overlay district; CG-2/7 - general commercial district. No rezoning will be required. However, variances have been requested for setbacks, open space and off street parking, which the Department supports. Economy Construction costs for the project are estimated at $49.8 million, with approximately 97 percent of that amount being spent within the region. The average annual wage will be $28,900, with a total of 347 persons employed in construction for a total of 330 employee years. Permanent employment will total _ 41 persons, with 23 between $15-25,000 per year, 16 between $25-50,000 per year, and 2 above $50,000 per year. The annual salaries are estimated to total approximately $1,202,000. An additional 281 persons will be employed part-time, receiving either an hourly wage or a sum per event. Public funding is estimated at $42.7 million, and private funding at $7.12 million. The development will have a favorable impact upon the economy of the City. The Department recommends a minority employment and subcontracting plan. Public Transportation The site is located immediately across N. W. 1 Avenue from the Overtown Metrorail Station and one block directly north of the State Plaza Metromover Station. These stations will provide excellent access to the site. Only for a crowd exceeding 5,000 would Metrorail be required to deliver supplemental service, and only at the Page 4 of 6 8 -523:. 16 conclusion of an event. Metromover would be scheduled to run the same hours as Metrorail. Metrobus will provide special park -and -ride service from selected locations, in addition to their regular service. Additional park and ride _ services could originate from West Dade and from Miami Beach. Housing The Miami Arena Project proposes no dwelling units, and will not be required to contribute to the Affordable Housing Trust Fund. Public Facilities The Miami Arena Project will efficiently use public facilities. The Metromover will provide ready access to a wide variety of private and public services located in the Central Business District. Environment The project will complement the natural resources and environment of the City. The preliminary site and landscape plan proposes extensive landscaping, trees, exterior building decorative treatment, special pavement and street treatment, and decorative banner arrangements. The design guidelines of the Southeast Overtown/Park West Redevelopment Program will ensure that the final plans will complement adjacent multiple unit housing projects being proposed immediately north of the arena. (Please refer to previous sections entitled Scale of the Facade, and Site Development.) Neighborhood Living Conditions The proposed area will serve as a magnet for additional development expanding northward from the City core. Supporting services will be attracted to the area to serve new residents in the Southeast Overtown/Park West area, and a variety of office activities projected for the area south and east of the site. Public Safety The Police Department does not foresee any problems in providing routine public safety services. The department will continue to work with the applicant to minimize any future problems concerning traffic flow and capacity, parking, security, communications, physical design, and environmental considerations. The Fire Department is also conducting on -going discussions with the applicant, particularly in the areas of emergency medical services and on -going safety inspections. Recommendation As the Miami Arena Preliminary Development Agreement provides that any new regional impacts of the Miami Arena, which may not happen to be identified in Tie Miami Arena DRI Development Order this fall, but which are identified in the Page 5of6 86 --523 IPA Southeast Overtown Park West DRI Project, will be the responsibility of the Southeast Overtown Park West DRI Development Order, the Department recommends ` incorporation of the converse language in this Major Use Permit, as follows: °If any new regional impacts of the Miami arena, not identified in the Miami Arena DRI Development Order, are subsequently identified in the Southeast Overtown Park West DRI, then the Developer and Owner of the Miami Arena must bear the responsibility for the new regional impacts." After consulting with Decoma Venture, the Planning Department concurs that Condition 13 is open-ended and recommends that that condition be deleted. The City is nevertheless protected in that the Applications for Development Approval for the Southeast Overtown/Paris West and Miami Arena Developments of Regional Impact will be moving forward concurrently this fall. The Planning Department recommends the addition of a new Condi ti on ' 17 to the Major Use Special Permit, as follows: Condition 17. The Major Use Special Permit ("permit") approved herein shall take effect upon the City of Miami Manager's approval of the "Miami Arena Contract". No building permits for the project shall be issued unless and until this Major Use Special Permit becomes effective as provided herein. This permit is issued subject to the City Manager's approval of the "Miami Arena Contract" between Decoma Venture and the Miami Sports and Exhibition Authority and execution of the "Miami Arena Contract" by the Decoma Venture and the Miami Sports and Exhibition Authority. The developer shall bear the cost of constructing any such decorative sidewalk, however, in no event is the developer of the Arena to be responsible for the cost of construction of any other improvements within the public right-of-way adjacent to the Arena property. This is not intended to relieve the Arena developer from responsibility for expansion, reconstruction or r relocation of utility lines occasioned by the construction of the Arena itself. GENERAL 15. 46, The Applicant shall submit a report, to the Planning Director, City of Miami Planning Department, twelve (12) months from the date of issuance of this Major Use Special Permit and each twelve (12) months thereafter until a final Certification of Occupancy is issued. * A general description of construction progress in terms of construction dollars and employment. * A cumulative list of all permits or approvals applied for, approved or denied. * A statement as to whether any proposed project construction changes in the ensuing twelve (12) months are expected to deviate substantially from the approvals included in this Major Use Special Permit. That Major Use Special Permit consisted of eight (8) pages, several of which were amended during the referenced public hearing. Attached to this memorandum are the revised pages carrying the inscription that they have been "revised" on 6/26/86. These pages should be substituted for the present original pages that you now have in your possession. Therefore, remove pages 5, 6 and 7 of Exhibit "A", which is identified as the "Major Use Special Permit," and substitute with the attached new pages 5,6 and 7.
