A RESOLUTION CLOSING, VACATING, ABANDONING
AND DISCONTINUING THE PUBLIC USE OF NORTHEAST
66TH STREET BETWEEN THE WEST RIGHT-OF-WAY
LINE OF NORTHEAST 5TH AVENUE AND THE EAST
RIGHT-OF-WAY LINE OF NORTHEAST 4TH COURT, AS
INDICATED ON THE PLAT OF "AMENDED PLAT OF
MORNINGSIDE", RECORDED IN PLAT BOOK 15 AT
PAGE 15, OF THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, SUBJECT TO THE CONDITIONS
ESTABLISHED BY THE PLAT AND STREET COMMITTEE;
ALL AS A CONDITION OF APPROVAL OF TENTATIVE
PLAT NO. 1266, "MORNINGSIDE ELEMENTARY SITE".
WHEREAS, the Plat and Street Committee, at its meeting of
October 9, 1985, approved Tentative Plat No. 1266 - "MORNINGSIDE
ELEMENTARY SITE" subject to the following:

Separate tracts must be provided to coincide with the
zoning boundary;
Any necessary utility easements be provided;

WHEREAS, the Zoning Board, at its meeting of April 21, 1986,
Item No. 5, following an advertised hearing, adopted Resolution
No. ZB 38-86, by a 9 to 0 vote, RECOMMENDING APPROVAL, in accord
with the conditions established by the Plat and Street Committee,
of the official vacation and closure of the streets and right-of-
way, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
the vacation and closure of the streets and right-of-way in
question;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

RESOLUTION NO. 83-38
OF THE SCHOOL BOARD OF DADE COUNTY, FLORIDA, FOR THE PURPOSE
OF CONSTRUCTING THEREON AN ELEMENTARY SCHOOL AND ACQUISITION
OF CERTAIN LANDS FOR THE EXPANSION OF THE MORNINGSIDE ELEMEN-
TARY SCHOOL SITE.
WHEREAS, after due consideration and consultation it
has been found and determined that the construction of a new
elementary school in the Edison -Little River area of Dade County
is necessary due to the over -crowding of the elementary schools
serving this area; and
WHEREAS, The School Board does not own any suitable
land in the area to be served by said riew school; and
WHEREAS, it has also been found and determined that
the expansion of the Morningside Elementary School site is neces-
sary due to its undersized site size and over enrollment; and
WHEREAS, the lands described below are located in the
area to be served by said new school and the other lands lie in
the area of the Morningside Elementary School site expansion.
NOW, THEREFORE, BE IT RESOLVED THAT:
(1) It is hereby determined and found necessary in
order to provide proper school buildings, playgrounds, recrea-
tional and other facilities for the proper and adequate mainten-
ance of a new Elementary School and the expansion of an existing
undersized Elementary School site to acquire the following des-
cribed lands situated in Dade County, Florida, to wit:
Blocks 1 and 2 of Rockmoor Part Tract,
according to the Plat thereof as recor-
ded in Plat Book 4 at Page 190 of the
Public Records of Dade County, Florida.
Blocks 6 and 7 of Morningside Amended,
according to the Plat thereof as recor-
ded in Plat Book 15 at Page 15 of the
Public Records of Dade County, Florida.
(2) The Board's attorneys be, and they are hereby
authorized and directed to institute and prosecute to conclu-
sion condemnation proceedings by which to acquire said last
above described lands -with all convenient speed.
(3) The said attorneys be, and they are hereby auth-
orized and directed to incur all necessary expenses by way of
surveys, appraisals, abstracts of title, and in acquiring of
other information necessary to institute and maintain said
condemnation proceedings.

At the May 22, 1986 City Commission meeting, the Commission
requested the Department of Public Works to hold an evening
meeting with the affected property owners on the proposed closure
of N.E. 66 Street between N.E. 4 Court and N.E. 5 Avenue. The
Dade County School Board is proposing to close this street in
order to construct an addition to the existing Morningside
Elementary School.
The property owners within 375 feet of the proposed street
closure were invited by letter to attend a 7:00 P.M. meeting at
Morningside Elementary School on June 12, 1986. City of Miami
Department of Public Works staff, Dade County School Board staff
and their architect for the school expansion were present at the
meeting. However, no property owners attended this meeting.

PROPOSED CLOSURE OF N.E. 66 STREET BETWEEN N.E. 4 COURT AND N.E.
5 AVENUE
The Dade County School Board is proposing to improve the
Morningside Elementary School at 6620 N.E. 5 Avenue. The
proposed improvements include the construction of an addition to
the existing school building that will be in the present right of
way of N.E. 66 Street between N.E. 4 Court and N.E. 5 Avenue.
The School Board is in the process of replatting the Morningside
Elementary School site and has requested approval from the City
of Miami Commission to permanently close N.E. 66 Street between
N.E. 4 Court and N.E. 5 Avenue. At the May 22, 1986 City
Commission meeting, the Commission requested this Department to
schedule an evening meeting at Morningside Elementary School to
discuss the proposed street closure with the neighbors.
Accordingly, we have scheduled a meeting for 7:00 p.m. on
Thursday, June 12, 1986 in the school auditorium. School Board
staff and their architects will be present at the meeting to
discuss the proposed school improvements in detail.

MEETING WITH NEIGHBORING PROPERTY OWNERS
Dear Property Owner,
As you are probably aware, the Dade County School Board recently
completed the acquisition of properties adjacent to the present
Morningside Elementary School site for purposes of constructing an
addition to the existing facility. The Board is in the process of
replatting the expanded site in preparation for construction. This
process entails the closure of NE 66th Street between NE 4th Court
and NE 5th Avenue.
A search of the Dade County Public Records indicates that you own
property within a 375' radius of the aforementioned site. In an attempt
to address any concerns you may have concerning this project and the
proposed street closure, a meeting has been schedule for March 27,
1986 at 7:30 p.m. to discuss the project with you. It will be held
at Morningside Elementary School located at 6640 NE 5th Avenue, in
the cafeteria.

The City of Miami Plat and Street Committee, at its meeting of
October 9, 1985, approved the above tentative -plat subject to the
following revisions being made to the tentative plat, additional
information being provided and/or variances being granted.
Please be,advised that the processing of your tentative plat
cannot proceed un-til these conditions have been satisfied.
-Public hearing for approval to close right-of-way.
-Separate tracts must be provided to coincide with
the zoning boundary.
-Any necessary utility easements.
-Alteration, relocation or installation of utilities
at the property owner's expense.
-Provision for Subdivision improvement requirements.
In addition to the above requirements, you should be aware of the
following:
1. State and local laws require the installation of various
physical improvements in the public rights -of -way when
property is platted. These subdivision improvements inclu4e
paving, drainage, landscaping, sidewalks, etc. In some cases
this could represent a substantial investment on your part.

2. The alteration, relocation or installation of utilities such
as storm and sanitary sewers, electric, telephone, water,
etc., caused by this plat will be at the property owner's
expense. Also, utility easements may be required on the
property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the
Fire, Rescue and Inspection Services Department prior to the
issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is submitted
to the City Commission for approval. You will be notified in
writing as to what these items are after the amount of the
bond has been determined for the necessary subdivision
improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.

refer to the attached sheet for the appropriate person to
contact.

OF THE OFFICIAL VACATION AND CLOSURE OF NE
66TH STREET BETWEEN THE WEST RIGHT-OF-WAY
LINE OF NE 5TH AVENUE AND THE EAST RIGHT-OF-
WAY LINE OF NE 4TH COURT AS A CONDITION OF
APPROVAL OF TENTATIVE PLAT #1266 -
"MORNINGSIDE ELEMENTARY SITE".
Upon being seconded by Mr. Alvaro Romero, the motion
was passed and adopted by the following vote:
