PAB 13-86, by a 8 to 0 vote, RE�,COMMEtJI)I[JCi APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA. Section 1. The Zoning Atlas of Ordinance No. 95UU, the zoning ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of approximately 1601 Northwest 8th Court: area bounded by Northwest 8th Avenue and Northwest 8th Court, between Northwest 16th Street and Northwest 16th Terrace, Miami, Florida, more particularly described as, Part of Tract "A" of Tentative Plat #1262 - "MEDICAL SUB" (AKA "PINE HEIGHTS PARK") of the Public Records of Dade County, Florida, from PR -PARKS AND RECREATION to 0-I/7 OFFICE INSTITUTIONAL. Section 2. Section 4. All ordinances, code sections, or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 5. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid the same shall not affect the validity of the ordinance as a whole. REQUEST To rezone a public park to 0I-7 Office - Institutional. BACKGROUND The Opthalmology Research Foundation, Inc. (ORFI), an affiliate of Bascom Palmer Eye Institute, has proposed to the City that the ownership of certain public and private land in the vicinity of N. W. 8th Avenue and N. W. 15th Street, on the east side of the Civic Center, be rationalized. Specifically, ORFI has proposed that the City abandon existing Pine Heights Park and adjacent streets and alleys; the vacated property would then revert to the adjacent property owners (ORFI and John Elliott Blood Bank). Through a new plat (tentative plat #1262), 14,932 square feet of property at the northwest corner of the intersection of N. W. 8th Avenue/N. W. 15th Street, would be dedicated as a public park. The advantages to the City are as follows: 1. The new park, located at the intersection of N. W. 8th Avenue and 15th Street would provide a larger, more usable, facility than the former park. PAB 4/16/86 Item #1 Page I 110118 2. The new park will be appropriately designed, developed and landscaped by ORFI, according to the requirements of the Parks and Recreation Department. 3. ORFI has agreed to maintain the park, in perpetuity together with adjacent Broward Circle park. A memorandum from the City Manager distributed at the City Commission meeting of February 13, 1986 is attached. The Zoning Board, on April 7, recommended (a) vacation of Pine Heights Park, b) vacation and closure of adjacent streets and c) change of zoning for the new park from 0-1/7 to PR. ANALYSIS Existing Pine Heights Park, together with adjacent streets, is proposed to be vacated and closed as a public park. These changed circumstances dictate a review of the zoning classification of the property. Plans for the east side of the Civic Center have been to accommodate the growth of the institutions and medical offices and to encourage residential development. The existing Miami Comprehensive Neighborhood Plan calls for special residential, commercial and industrial mixed uses while the proposed MCNP calls for residential/office use. The existing zoning -PR- is no longer appropriate. The zoning pattern is 0-1/7 Office Institutional within several blocks of the site; if this same zoning were applied to the site it would conform to the established zoning pattern and would accommodate the kinds and amounts of uses proposed in the plan. Odio City Manager em"OfuRtf, (For Commission Meeting of February 13, 1986 ) The relocation of Pine Heights Park as a part of a Tentative Plat entitled "Medical Subdivision" has been the subject of discussion between the Opthalmology Research Foundation and staff members from Public Works, Planning, Parks and the Law Departments since June of 1984. The major concern the staff members had was the abandoning of a small park approximately 8,400 square feet in area dedicated by the original plat. After some discussion, the Foundation agreed to relocation of the park within the subject property rather than total abandonment. The area of the relocated park is 1 1 ,000 square feet, approximately 2,600 square feet larger than the existing one. The new park is to be appropriately developed and landscaped according to the requirements of the Parks Department and will be located at the intersection of N.W. 8 Avenue and 15 Street. The Foundation has also agreed to maintain the park in perpetuity together with another small passive park area across the street, "Broward Circle". The Planning Department and Parks and Recreation Department are in agreement that the relocation of Pine Heights Park is desirable and would provide a more usable facility. Attached are copies of memoranda from these departments. Also attached is a fact sheet showing areas and values for the existing and new parks, and for right of ways involved in the tentative plat of "Medical Subdivision". This fact sheet also indicates the value to the City of improvements to be provided in the new park. Annual cost of maintenance of the relocated park and Broward Circle is to be borne in perpetuity by the applicant. The City of Miami Plat and Street Committee, at its meeting of September a; 1985 recommended approval of Tentative Plat #1262 "Medical Subdivision", subject to necessary public hearings. The Law Department has been satisfied that the legalities concerning this transfer of park lands have been addressed. With the approval of the City Commission, the plat may be moved forward for the necessary public hearings for street closures, park relocation and necessary changes in toning designation.
