APPROVAL of a change of zoning as hereinatt�r set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter_ deems it advisable and in the best interest of ttie
general welfare of the City of Miami and its inhabitants to
grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of the property located at
approximately 831 Northwest 15th Street, Miami, Florida, also
described as "PUBLIC PARK", as per Tentative Plat #12' of
"MEDICAL SUBDIVISION", from 0-1/7 office -institutional to PR
Parks and Recreation.
Section 2. It is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;

(1) Will not be a deterrent to the improvement or
development_ of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 24 of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts tiiereof
in conflict herewith are hereby repealed insofar as they are in
conflict.
Section 5. Should any part of provision of this Ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of tine ordinance as a
whole.

Zoning Ordinance of the City of Miami to PR
Parks and Recreation.
RECOMMENDATIONS
PLANNING DEPARTMENT
APPROVAL. Change of Zoning of the subject
property from 0-I/7 Office -Institutional to PR
Parks and Recreation is needed for the
relocation of Pine Heights Park. Existing
district boundaries are illogically drawn in
relation to existing conditions on the property
proposed for change. There are substantial
reasons why the property cannot be used in
accord with existing zoning. The new public
park will be located in close proximity to an
existing park, "Broward Circle". The two park
areas together would provide a more meaningful
and usable facility. The Ophthalmology Research
Foundation Inc. has voluntarily proffered to
maintain both parks in perpetuity.
PUBLIC WORKS
No dedication is required.

ZONING BOARD At its meeting of April 7, 1986, the Zoning

ITEM 9: STATEMENT EXPLAINING WHY PRESENT ZONING
DESIGNATION IS INAPPROPRIATE AND THE
PROPOSED DESIGNATION IS APPROPRIATE
Ophthalmology Research Foundation, Inc. (the "Research
Foundation"), a not -for -profit Florida corporation, owns
several parcels of land in Highland Park Subdivision near
Jackson Medical Complex in the City of Miami. The parcels are
located close to one another, but there is a small park
situated in the center of the area, known as Pine Heights Park.
South Florida Blood Service, a not -for -profit corporation, owns
an adjacent parcel on which its Dade County facilities are
located. The Research Foundation and the Blood Service have
determined that it would be in their best interests to replat
their properties jointly; therefore, they submitted a tentative
plat to the Street and Plat Committee named the Medical
Subdivision. The tentative plat contemplates the closure of
several streets and the relocation of Pine Heights Park from
the center of the area to the south end of the property, thus
permitting the Research Foundation and the Blood Service to
develop the remaining contiguous parcels. The tentative plat
was approved by the Street and Plat Committee on September 4,
1985, subject to certain revisions which have already been
made. The City Commission approved the park relocation on
February 13, 1986. When the plat is implemented, the Research
Foundation will relocate Pine Heights Park to a new 14,932
sq.ft. site which will be landscaped and maintained at the
Research Foundation's expense. The new park site is presently
owned by the Research Foundation.
As part of the park relocation, the Planning and Zoning
Board's Administration Department has requested that the site
of the new nark be rezoned to PR.

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.
