IMPLEMENTATION OF THE FIRST SOURCE
HIRING ORDINANCE ADOPTED SEPTEMBER 12,
1985, AND PROVIDING FOR APPLICATION OF
THE ORDINANCE DURING THE NEXT SIX
MONTHS TO CONTRACTS REQUIRING CITY
COMMISSION APPROVAL AND/OR LOANS
GRANTED BY MIAMI CAPITAL DEVELOPMENT
CORPORATION.
BE IT RESOLVED BY THE COMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1.
The City Commission approves
the guidelines
established by the City Manager and
set forth
in the attached
memorandum, for
implementation of
the First
Source Hiring
Ordinance adopted
September 12, 1985.
Section 2.
During the next six months, the First Source
Hiring Ordinance
shall apply only
to contracts
requiring City
Commission approval and/or loans
granted by
Miami Capital
Development Corporation.

Development Corporation.
This memorandum provides a status report on implementation of the
City of Miami's First Source Hiring Ordinance and includes
recommended guidelines for implementation of the Ordinance.
BACKGROUND
The First Source Hiring concept has been successfully implemented in
several cities throughout the country as a viable means of providing
employment opportunities for unemployed or underemployed persons.
This is accomplished by coordinating various development projects
with training and employment programs, thereby providing job
placement opportunities for persons so qualified.
More specifically, jobs created as a result of service contracts for
facilities, services and/or receipt of grants and loans are subject
to first being filled by participants of City of Miami training and
employment programs, 'and/or other residents of the City of Miami.
The positions most often filled are entry-level.
In other jurisdictions where the concept has been employed, it has
been voluntary in nature. In addition, it usually applies to
economic development projects and/or loans, and in some cases applies
only to smaller contracts. On the other hand, the City of Miami
ordinance is unique in that it encompasses a broader range of
contracts and REQUIRES First Source agreements be negotiated prior to
executing a contract with the City unless an agreement is found to be
infeasible by the City Manager, and approved for exemption by the
City Commission. In all cases, the First Source can be of
substantial benefit to contractors in finding entry level employees.

_Role of the PIC/SFETC
The PIC/SFETC is the organization through

participation plans, i.e., Southeast Overtown Park West Employment
Plan, and the overall Minority Procurement Ordinance.
t Administrative Procedures for Implementation
It should be noted that the comprehensive nature of the City's First
Source appears to be without precedent, in that it encompasses a
broad range of contracts. Following is the list included in the
Ordinance:
*Service contracts for the procurement of services including
professional services.
*Facilities include all publicly financed projects --unified
development projects, municipal public works and municipal
improvements financed through public money, services, or the use of
publicly owned property.

*Services include public works improvements, facilities, professional
services, commodities, supplies, materials and equipment.
*Grants and Loans --include Urban Development Action Grants (UDAGs),
Economic Development Agency construction loans, loans from Miami
Capital Development, and all federal and state grants administered by
the City of Miami.
This list includes contracts that do not require City Commission
approval. Therefore, it is recommended that during the first six
months, implementation be applied to all contracts requiring City
CTission approval and loans made through Miami Capital Development
om
Cor oration. This will enable staff to determine procedures for
monitoring smaller contracts (not requiring Commission approval), and
to evaluate the implementation of the procedures in effect.
It is recommended that the coordination of the First Source occur in
the Department of Community Development, due to the wide range of
contracts .involved, and the Department's experience in administering

and monitoring a wide range of grants and contracts.
The following procedures would apply to all Departments administering

contracts covered by the First Source Ordinance.
*First Source information should be included in bid packages and/or
specifications. This information sheet would serve as farmal
notification that the execution of contracts resulting in the

First Source hiring agreements unless found to be infeasible icy the

*As contracts in any of the categories noted above are negotiated,
Departments provide information on the contracts to the Department of
Community Development which would review for sufficiency, then
forward to the PIC/SFETC. it is important that the information
provided give an accurate picture of the project to be undertaken and
the number of jobs likely to be created. The information provided
with vary dependent on the nature of the contract, however, at a
minimum the following should be included: Name of and a dress ctf
potential contractor; contract amount; purpose ;
background information on the contractor; background information on
the project to be undertaken; employment information --current and
projected by type and number of positions.
*PIC/SFETC would contact potential contractor, explain the

*If it is determined that there are positions that could be included
in a First Source Agreement, the PIC/SFETC would prepare information
profiles on these positions and forward these to the Department of
Community Development. In addition, the PIC/SFETC proceeds with
negotiating a First Source Agreement with the condition that
execution of such depends on execution of the contract with the City
of Miami. The PIC/SFETC would provide the draft agreement to the
Department of Community Development, which in turn would forward to
the administering Department. It should be noted that language would
also be included in the contract with the City referencing the

Overtdwn Jobs Program and Miami Job Development Program. The City

PIC/SFETC for certification. Following certification, the PIC/SFETC
will refer all qualified applicants back to the referring City
operated job placement program. The placement program will refer the
applicants to the contractor, who would actually make the
determination on whether to hire the applicant(s).
*In the event the City operated job placement programs are unable to
refer applicants for First Source positions, the PIC/SFETC would
provide the opportunity for not for profit operators serving City
residents to refer clients.
