RESOLUTION NO. 86-627;
A RESOLUTION APPROVING THE ISSUANCE OF A REQUEST FOR
PROPOSALS FOR A DAYCARE FACILITY AT MUNICIPAL
GARAGE NO. 51 270 N.W. SECOND STREET
WHEREAS, the City Commission on July 10, 1986 has approved in
concept the utilization of ground floor space in Municipal Garage No. 5 for
a daycare facility, with the understanding that the City of Miami and the
Department of Off -Street Parking will jointly develop a Request for
Proposals for the lease and management of the facility; and
WHEREAS, the Department of Off -Street Parking has developed
the Request for Proposals after consultation from the Planning Department,
Development Department and appropriate daycare related agencies;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA
Section 1. The Request for Proposals for lease of space at
Municipal Garage No. 5 is hereby approved in final form acceptable to the
City Attorney.
Section 2. The subject Daycare Facility is to be properly
leased and managed in accordance with the requirements of the City of Miami,
State of Florida Department of Health and Rehabilitative Services and all
other applicable governing standards.
Section 3. The facility is to be leased and managed in
accordance with all specifications as indicated;
Section 4. The City Manager and the Department of Off -Street
Parking are hereby authorized to distribute the Request for Proposals for
the lease and management of a daycare facility to the daycare industry.

The Commission, in the July 100 1986 meeting, approved in concept the
proposal to place a daycare facility in Municipal Garage No. 5. The City and
the Department will jointly issue the Request for Proposals for lease and
management of space in Municipal Garage No. 5. The proposer is expected to
provide financing for the project with a minimum annual guaranteed lease
payment and a percentage of gross revenues above the guarantee.
Proposers must meet specific minimum criteria including, but not limited to,
the following:
o Financial capability to perform.
o Minority participation of the daycare and development team.
o Demonstrated daycare experience and qualifications of team members.
o Licensing and education requirements in line with State of Florida,
Department of Health and Rehabilitative Services (HRS) guidelines.
The bid will be awarded to the proposer meeting all qualifications set forth
In the Request for Proposals and providing the highest financial return to
the City.
The attached Resolution will approve the issuance of the Request fork
Proposals in a form acceptable to the City Attorney. With approval, the
Request for Proposals will be circulated to the daycare industry during

The City of Miami, Florida, through the Department of Off -Street Parking is
seeking the services of a qualified and experienced developer/lessee or
group of professionals to design, finance, lease, construct and manage a
daycare facility in Municipal Garage No. 5 located in the Downtown
Government Center area. A firm with experience in the construction of
shell space and operation/management of a daycare facility is desirable.
Interested persons and/or firms must contact the City of Miami Department
of Off -Street Parking, 190 N.E. Third Street, telephone (305)579-6789, for
the Request for Proposals document. This document contains detailed and
specific information about the scope of services being requested and
submission requirements. The deadline for submission is September 9, 1986
at 2:00 p.m. A pre -proposal conference will be held at the above address

1. 11MMARY
The City of Miami, Florida and the Department of Off -Street Parking welcome
proposals for a developer/daycare operator to design construct, finance,
lease and manage a daycare facility at Municipal Garage No. 5, 270 N.W.
Second Street, Miami, Florida. The site contains approximately 15,013
square foot in ground floor space, and 1,568 square foot low overhead
storage space, and is located on the east and southern portions of the
garage. (See Exhibit 1). Dade County owns a parcel of land to the east
immediately adjacent to the ground floor space. This parcel is
approximately 26,598 square feet and is currently paved and used for
surface parking.
The City and the Department of Off -Street Parking are seeking a proposer or
combination of proposers that will provide a aclu lity daycare facility open
to the public, servicing the downtown workforce. The City and the
Department of Off -Street Parking are seeking a a�u lity affordable facility
that is accessible to the downtown amenities and offices. The facility
Will assist in solving logistical problems by allowing working parents to
be closer to their children during the workday.
The successful developer will be selected as a result of this Request for
Proposals to begin negotiations for a lease agreement. Proposals shall
include and will be evaluated based on the concept, desigr., financing
strategy, feasibility and potential return to the City and the Department
of Off -Street Parking. The Department encourages potential proposers to
discuss possible contracts with major employers to support the facility.

The proposer is expected to provide financing for all building and site
improvements. City owned property is held in public trust and cannot be
mortgaged or subordinated in any way as a part of the lease agreement,
however the leasehold may be mortgaged. The initial term of the lease
agreement is expected to be ten (10) years with three (3) year renewal
periods. All improvements upon the site will revert to ownership by the
City at the expiration of the lease term.
The City owns Municipal Garage No. 5 and the facility is managed by the
Department of Off —Street Parking under a management agreement. The City
and Department would expect to derive payment from a lease agreement with
the successful proposer. Proposals are required to state a minimum annual
guarantee to be paid monthly and a percentage of gross revenues above the
guarantee as an annual lease payment. (See Bid Proposal Section, 6D).
Minority participation is required to be an interral part of the design/
development/management team. This includes participation in construction
jobs and contracts and in comprising a portion of the permanent management/
equity team, and work force created by the development. Utilization of the
facility must be non —discriminating.
The Review Committee will carefully study the qualifications and past
performance of the owner and/or operator and will determine their ability
to carry out and meet the City and Department's expectations.

II. CONDITIONS OF REQUEST _FOR PROPOSALS
s" 1. The Department reserves the right to waive irregularities or reject
x s any or all Request for Proposals, or any part of the Request for

Proposals, or to re -advertise for all or any part of Request for
_r Proposals, as it deems best for the interest of the Department.
2. In case of default of the awarded Request for Proposals, the
Department may procure the services from other sources and charge
the proposer as liquidated damages any excess cost or damages as

sublet or otherwise dispose of this contract, or of any of its
rights, title or interest therein, or its power to execute such

written consent of the City and Department or unless otherwise

4. No proposal will be accepted from, nor will any contract be awarded
to any person or firm which is in arrears to the City of Miami or
the Department of Off -Street Parking; or who has failed to perform
faithfully on other previous contracts.
5. The City and/or the Department of Off -Street Parking reserve the
right, before awarding the contract, to require a Proposer to
submit evidence of qualifications as the City and/or Department
deem necessary.

this Request for Proposals shall be retained by the Department.

III. EQUAL EMPLOYMENT OPPORTUNITY
All services and performances in connection, with this contract shall
provide Equal Employment Opportunity and shall agree not to discriminate
against any employee or applicant for employment because of race, religion.,
color, age, sex, national origin, or handicap except where based or a
bonafide occupational qualification. This provision shall include, but not
be limited to the following: employment, upgrading, demotion., transfer,
layoff, termination, recruitment, advertising, rate of pay and selection
for training.
IT IS THE POLICY OF THE CITY OF MIAMI AND THE DEPARTMENT OF OFF-STREET
PARKING THAT MINORITY BUSINESS ENTERPRISE SHALL HAVE THE MAXIMUM
PRACTICABLE OPPORTUNITY TO PARTICIPATE IN THE PERFORMANCE OF CONTRACTS
AWARDED BY THE CITY AND THE DEPARTMENT.
The term "Minority Business Enterprise" means a small business concern
which is:
a) At lease 51 percent owned by one or more socially and
economically disadvantaged individuals or in the case of a
publicly owned business, at least 51 percent of the stock of
which is owned by one more socially and economically
disadvantaged individual, and
b) Whose management and daily operation are controlled by one or
_ - more of the socially and economically disadvantaged individuals
who own it.

Small Business Concern .. means a small business as defined pursuant to
Section 3 of the Small Business Act and relevant regulations promulgated
pursuant thereto.
Socially and Economically Disadvantaged Individuals - means those
individuals Who are citizens of the United States (or lawfully admitted
permanent residents) and who are Black Americans, Hispanic -Americans,
Native Americans, Asian -Pacific Americans or Asian Indian Americans and any
other minorities or individuals found to be disadvantaged by the Small
Business Administration pursuant to Section 8(A) of Small Business Act.

V. BID PROPOSAL
Proposers shall provide the following information regarding developer/
operatorts desire and ability to design, construct, finance, lease and
manage the daycare facility with maximum qualifications, ability to
complete on a timely basis, and ability to provide the City and Department
with specific satisfaction of aug litter daycare needs.

o Construction experience and/or
o Daycare experience

b. Provide a description of the contractor relevant project
experience.

floor space including:
o Architectural features
o Method of construction
o Proposed use of space

o Play area location and design

b. Schematic drawings by an architect licensed to practice in the
State of Florida illustrating the proposed facility are
required. Specifically, the following are required: project
site plans; project elevations; project floor plans; schedule of
project amenities; project and construction implementation
schedule.
c. The design and construction plan should include information on
how construction will be contracted and if a general contractor
or construction manager will be involved. Describe extent of
involvement with key City and Department personnel in reviewing
and monitoring the construction plans and implementation,.

4. a. Describe the operation, of the daycare facility. The description
should include:
o Philosophy of daycare and child development
o A brief outline of operating procedures
o The organization chart
o Job descriptions of key positions
o Hours of operation
o Proposed occupancy including ratio of staff per at each level
o Sample plans for work activities for children at each age level
o Proposed fee schedules at each age level
o Nutritional/kitchen use plans
o Plans for an accredited kindergarten program
(This is a requested but not required by the operator)
5. 1he design/construction team and operator/manager shall indicate
understanding for, and willingness to comply with the following
standards:
a. South Florida Building Code (latest edition.).
b. Life Safety Code
c. State of Florida, Department of of Health and Rehabilitative
Services, Child Day Care, Florida Administrative Code

d. Physical standards for proposed private educational
facilities in Dade County/City of Miami.
e. ANSI standards, Occupational Safety and Health Act.
f. Designer shall comply with all other local and rational
codes.
g. Architect(s) shall obtain written approval from Dade County/
City of Miami Health Department, City of Miami Fire
Marshalls, and all other appropriate local authorities.

6. Discuss the economic feasibility of the project as follows:
a. Development of the total cost of the project, amortization
of project costs and source of financing.

current and past Affirmative Action efforts, willingness and past
history of subcontracting efforts with local minority firms and
proposed minority equity participation.
g. Discuss willingness to develop "creative" programs such as
cooperative work programs with local schools and colleges;
development of educational programs for parents in child
development; and cooperative programs with local businesses and
government agencies.

VI. EVALUATION CRITERIA
The City and Department will appoint a Selection Committee to review and
evaluate proposals.
The following Criteria will be used by the Selection Committee to evaluate
qualifications; percentages to the left indicate the relative weight that
will be placed on each of the criteria.
20x — Experience of the Development Team, including specific
experience on similar projects.
20% — Overall project design.
20% — Quality of daycare service proposed including understanding and
conformance to proposal requirements.
20% — Demonstrated experience in providing quality daycare service.
10% — Financial capability and level of financial commitment and

10% — Extent of minority participation.
Proposers are encouraged to have their proposals conform to the following
factors to be utilized by the Review Committee in evaluating the proposals:

The Committee will review all proposals and invite qualified proposers to
make a presentation of services to the Committee. Qualified proposers will
be determined by a Certification Committee of persons with experience in
development projects and the daycare field.
When the final selections are made, the Bid Proposal will be the basis for
negotiation of a contract to be entered into with the successful firm.

VII. GENERAL CONTRACT TERMS:
Upon authorization of the City Commission and the Off -Street Parking Board,
the Off -Street Parking Director in conjunction with a designated City
representative shall negotiate all aspects of a contract for Development
and Lease with the successful proposer. The contract shall be subject to
review and approval by the City Manager and the City Commission.

DAYCARE REQUIREMENTS
The developer/operator/manager shall acknowledge and address facility
structural, educational, safety and health requirements. These include but
are not limited to those addressed in the sections below.
GENERAL REQUIREMENTS!
1. During the hours of operation, no portion of the building shall be
used for any other purpose than specified (daycare) and/or any other
purpose which may endanger the health and safety of the children
enrolled in such daycare facility.
2. The successful proposer must be qualified and eligible to receive a
contract award under applicable public policy laws, Florida
Administrative Code Chapter 10 M-12, Child Day Care Standards.
3. Prior to issuance of the daycare license the applicant shall comply
with Section 10M, 12.001, 2(f) of the HRS standard requiring a bond
In the amount of $100,000 issued by a surety company admitted to do
business in the State of Florida. In lieu of the bond, the
applicant must provide proof of maintaining a liability insurance
policy in the amount of $100,000 or deposit $100,000 in cash or
securities with the Department of Health and Rehabilitative Services
in accordance with Chapter 85-54 Laws of Florida.

4. The facility must have, at a minimum, provisions for the following:
a) Space (indoor and outdoor) for 75 children.
b) Infant care beginning at six weeks of age.
c) Hours of operation:
1. Daily Care — 7:00 a.m. —7:00 p.m.
2. After Care — 1:00 p.m. — 7:00 p.m•
3. Hourly Care — (optional)

STRUCTURAL REQUIREMENTSe
1. A minimum of 35 square feet net per child shall be provided for
indoor space and a minimum outdoor play area of 75 square feet per
child must also be provideds (outdoor play are should provide both
sun and shade) . The outdoor play are shall have a safe and adequate
fence or wall in compliance with City of Miami standards.
2. The facility shall supply:
a. Adequate number of bathroom and shower facilities and drinking
fountains accessible for all children. the shower should be
adequate for an adult to wash a child and sinks should have
foot operated pedals.
b. Handicap facilities.
c. Kitchen facilities in accordance with City of Miami and in
compliance with HRS and City standards for daycare facilities.
d. Hot and cold running water for all medical facilities.
e. Toilet facilities including facilities for the outdoor play
area.
3. The rooms occupied by children must have a minimum of 20 foot
candles of natural or artificial light in all parts of the room and
at child's eye level.
4. Noise control considerations will be a factor in the design of the
facility.

5. The classroom and space should serve a multitude of functions (i.e.
eating, sleeping, dancing, teaching, painting, etc.) and surface
areas should reflect consideration of use.
6. The facility require??the use of oversized doors (gt 6" wide) to
facilitate movement of large equipment and groups of children. In
addition doors should have low viewing panels for children's use.
7. The facility should have mirrors in the infant crawling area to
allow for V13U81 stimulation. Furniture and equipment should be
designed with soft edges to avoid injuries to children and the
infant area should have a private area for nursing mothers.

proper exits, signage, safety equipment (blankets, extinguishers,

It is very important to maximize visual control by the daycare staff
of the facility for safety of the children. This includes
4� entrances/exits, classrooms, offices, reatrooms, kitchen facilities
and play areas.

4. All areas and surfaces accessible to children shall be free of toxic
substances and hazardous materials. Lead paints are prohibited.
5. In case of fire, exits should allow for exit of 4.5 children per
minute at a time, to be wheeled out (cribs with wheels or
handicapped) if necessary.
3 HEALTH REQUIREMENTS.
1. Health and Sanitation regulations include:
a. Conformance to state and local sewage disposal standards and
building standards for daycare.

b. Provision for adequate screening to prevent entrance of

c. Drinking water shall be freely available to all children.
d. Infant care requirements to be in accordance with HRS and City
standards.
2. Admission and record keeping standards shall be in accordance with
HRS (including immunizations, health records, etc.).
3. First aid treatment facilities shall be provided in accordance with
HRS and City of Miami standards.
4. An air conditioned environment providing adequate ventilation with
compliance to HRS minimal temperature standards must be adhered to
(10H-12.003 Physical Facilities-2b).

DAYCARE FACILITY
The Commission, in the July 10, 1986 meeting, approved in concept the
proposal to place a daycare facility in Municipal Garage No. 5. The City and
the Department will jointly issue the Request for Proposals for lease and
management of space in Municipal Garage No. 5. The proposer is expected to
provide financing for the project with a minimum annual guaranteed lease
payment and a percentage of gross revenues above the guarantee.
Proposers must meet specific minimum criteria including, but not limited to,
the following:
o Financial capability to perform.
o Minority participation of the daycare and development team.
o Demonstrated daycare experience and qualifications of team members.
o Licensing and education requirements in line with State of Florida,
Department of Health and Rehabilitative Services (HRS) guidelines.
The bid will be awarded to the proposer meeting all qualifications set forth
In the Request for Proposals and providing the highest financial return to
the City.
The attached Resolution will approve the issuance of the Request fori
Proposals in a form acceptable to the City Attorney. With approval, the
Request for Proposals will be circulated to the daycare industry during
August, with proposals due in early September.
