HomeMy WebLinkAboutR-86-0614r J-$6-623 -0 # RESOLUTION No. 86-6i4, A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT TO AMENDED AND RESTATED LEASE AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED, BETWEEN THE CITY AND BAYSIDE CENTER LIMITED PARTNERSHIP FOR THE BAYSIDE SPECIALTY CENTER RETAIL PARCEL TO CLARIFY CERTAIN TERMS AND CONDITIONS AND TO INCORPORATE CERTAIN ADDITIONS. WHEREAS, on January 14, 1985, the City and Bayside Center Limited Partnership entered into a Ground Lease Agreement whereby Bayside will construct, operate and maintain a Specialty Center on a portion of Bayfront Park; and WHEREAS, on October 15, 1985, the City and Bayside Center Limited Partnership entered into an Amended and Restated Lease Agreement for the Bayside Specialty Center Retail Parcel to incorporate requirements for construction financing and all documents required for closing; and =ter WHEREAS, the City and Bayside Center Limited Partnership desire to hereby amend the provisions of said Restated Lease Agreement to clarify certain terms and conditions and to incorporate certain additions. i r NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF _ MIAMI, FLORIDA: Section 1. Odio For City Commission Meeting City Manager ENCLOSURES: of July 24, 1986 Resolution It is recommended that the City Commission adopt the attached Resolution authorizing the City Manager to execute the First Amendment to Amended and Restated Lease Agreement, in substantially the form attached, between the City and Bayside Center Limited Partnership for the Retail Parcel to clarify certain terms and conditions and to incorporate certain additions. It is recommended that the attached Resolution be adopted to authorize the City Manager to execute the First Amendment to the Lease Agreement for the Bayside Retail Parcel to clarify terms and conditions, specifically with respect to the WASA Agreement and the sale of alcoholic beverages, beer and wine, and to incorporate certain additions. 96--614
