A RESOLUTION AUTHORIZING AN INCREASE IN
THE CONTRACT AMOUNT OF $430,528 IN THE
CONTRACT BETWEEN THE CITY OF MIAMI,
FLORIDA AND PNM CORPORATION DATED JANUARY
24, 1986 FOR THE CONSTRUCTION OF BAYFRONT
PARK REDEVELOPMENT PHASE II SAID FUNDS TO
BE PROVIDED FROM UDAG GRANT FUNDS ALREADY
ALLOCATED TO THE BAYFRONT PARK PROJECT;
FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING THAT THE HEREIN INCREASE
RESULTED FROM EMERGENCY CIRCUMSTANCES BY
AN AFFIRMATIVE VOTE OF TWO-THIRDS OF THE
MEMBERS OF THE CITY COMMISSION, AND
ADOPTING THE FINDINGS AND CONCLUSIONS SET
FORTH IN THE PREAMBLE OF THIS RESOLUTION.
WHEREAS, there exists a contract dated January 24, 1986
between the City of Miami, Florida and PNM Corporation for the
construction of Bayfront Park Redevelopment Phase II; and
WHEREAS, an increase in contract of $430,528 is
required to cover the cost of additional water mains, storm
drainage, sanitary sewers, hauling of fill and length of piling
and modifications to the Light Tower; and
WHEREAS, the City Manager has made a written finding
that a valid emergency exists for the work to be done; and
WHEREAS, the Directors of the Departments of Public
Works and Development recommend the increase in contract to cover
the additional costs, and
WHEREAS, funds to cover the increase are available from
money already allocated to the project.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. After a properly advertised public hearing,
the finding of the City Manager set forth in the preamble to this
resolution is hereby ratified by an affirmative vote of two-
thirds of the City Commission, and adopted as if fully set forth
in this section.

Section 2. The contract between the City of Miami,
Florida and PNM Corporation for the construction of Bayfront Park
Redevelopment Phase II dated January 24, 1986 is hereby increased
by $430,528, with funds for the increase to be provided from
monies already allocated to the project.

I am sending you a revised resolution and memorandum relative to
Commission Agenda Item #4 for July 24, 1986 Commission Meeting.
The resolution pertains to an increase in contract for the
Bayfront Park Redevelopment Phase II project and the resolution
and memorandum have been revised to show that the funds for the
increase are from UDAG Grant Funds that are explicitly allocated
for use in Bayfront Park.
The memorandum has also been revised to more clearly explain how
an estimated $544,776 worth of extra work is to be completed with
an $430,528 increase.
Please substitute the revised resolution and memorandum for those
supplied earlier.

It is recommended that a resolution be adopted
authorizing an increase in contract amount of
$430,528.00 in the contract between the City of
Miami, Florida and PNM Corporation for the
construction of Bayfront Park Redevelopment
Phase II; said funds to be provided from UDAG
Grant Funds already allocated to the Bayfront
Park Redevelopment Project; further ratifying
the City Manager's written finding that the
herein increase resulted from emergency
circumstances by an affirmative vote of two-
thirds of the members of the City Commission and
adopting the finding and conclusions set forth
in the preamble of this resolution.
The additions in size and lengths of water mains and
additional fire hydrants to meet the requirements of the
City of Miami Fire Department and the Miami Dade Water and
Sewer Authority Department, an added 12-inch diameter water
service being constructed as part of this project but which
will serve later phases of the park redevelopment, and the
addition of a 4-inch diameter main onto the Baywalk project
being constructed by the U.S. Army Corps of Engineers will
result in an extra cost of $1149885 to the project.
Additional length of soakage drainage to compensate for poor
drainage conditions encountered at the site and additional
watershed areas added by the Baywalk project will result in
an extra cost of $959938 to the project.
Unforeseen soil conditions that resulted in piles for the
Light Tower, Service Building and Maintenance Space having
to be 58 to 60 feet in length instead of the specified
length of 40 feet, and additional piles required for the
Service Building have resulted in an extra cost of $121,953•

The sanitary sewer system for the Maintenance space and
Service Building was shown on the plans to be connected to
the Bayside sanitary system. We have found that no
provision was made in the Bayside system for the hookup.
Estimated costs to correct this problem are $40,000 to

The contractor has been authorized to haul fill from the
City's Virginia fill storage area to the Bayside project to

Revised plans showing modifications to the Light Tower and
Service Building have been given to the contractor and we
are awaiting his estimate of the extra cost involved. We
expect his quotation to be in excess of $509000.
The Directors of the Departments of Public Works and
Development agreed that all of the aforementioned work
should be done as an addition to the existing contract,
concurring in the opinion that to do it under a separate
contract would be more costly than the established and
estimated costs given above, and result in a delay in the
completion of the total project.
The total cost of the above mentioned additional work
amounts to more than the $430,528 increase requested
($544,776). It is the intention of the Public Works
department to reduce the cost by further negotiations with
the contractor or other means to complete all of it with the
funds provided by the requested increase. The $4309528
represents the remaining UDAG funds that the City received
for explicit use for the redevelopment of Bayfront Park.
They cannot be used elsewhere.
As required by City ordinances, an increase of $10,000 or
more in a City contract must be accompanied by a finding by
the City Manager that the increase resulted from emergency
circumstances, and such a finding has been prepared and
signed. It is further required that a Public Hearing be
held, and the Public Hearing has been scheduled.

Based on information supplied to me by the Director of the
Department of Public Works and the Director of the
Department of Development I have found that there exists an
emergency need for an increase in contract amount of
$430,528 in

The reasons for the emergency need are as follows:
• Additional costs will be incurred by additional water
mains, hydrants and services that must be installed.
• Additional costs will be incurred by additional storm
drainage required to satisfy existing conditions.
# Additional costs will be incurred to provide
additional sanitary sewers.
e Additional cost will be incurred to haul fill to the
site from Virginia Key.
• Additional cost• will be incurred by modifications
being made to the Service Building and Light Tower.
