ORDINANCE NO, 10 1 3 6_-
Afi EMERGENCY ORDINANCE pROVIDING THAT,
CaMMENCING EFFECTIVE OCTOHER 1, AN

Section 1. Notwithstanding any City Code provision to the
contrary, commencing effective October 1, 1986 there shall be an
annual fee assessed against all commercial establishments to
offset the cost for the provision of trash and street -cleaning
services by the City in accordance with the schedule attached
hereto and made a part hereof.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary paymentie UU LVID _
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
Section 5. The requirement of reading this ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission,

of the Code of the City of Miami, Florida, as amended, which

TRASH ARb STREET CLEARING SERVICES PROGRAM
PEE SCHEDULE
Effective October 1, 10$O, the following level of service will be
initiated:
soheduled, once -a -week trash collection;
Main thoroughfares in the City's business districts will
be swept on a daily basis;
All litter containers will be serviced and cleaned on a
daily basis;
Sidewalks in the City's business districts will be
cleaned with litter -vacuums on a daily basis;
Sidewalks of the City's business districts will be
pressure cleaned according to a defined program.
An annual fee of $150 will be assessed against all commercial
establishments in the City. This fee is in addition to all
existing fees contained in Chapter 22 of the City Code.

IT IS RECOMMENDED THAT THE CITY COMMISSION

The City administration recommends the adoption of an annual fee
to be assessed against all commerti al establishments as defined in
Chapter 22, Sec. 22-1 of the Code of the City of Mi ami for the
collection of trash and the performance of street -cleaning
services.
The trash and street -cleaning fee will become effective October 1,
1986 and will be based on a rate schedule which will be forwarded
under separate cover memorandum.
The adoption of this ordinance will modify applicable sections of
the Chapter 22 of the Mi ami Code.

As you are aware, the City of Miami currently assesses both
residential and commercial establishments a fee to offset the
City's costs of garbage collection and disposal. Although both
street cleaning and commercial trash collection are conducted by
the City on a daily basis, a fee is not assessed for those
functions. Both functions demand a considerable allocation of
personnel and financial resources on an annual basis.
` To defray the approximate FY'87 expense for street cleaning and
trash collection, I recommend that the City assess an annual fee
in the amount of $150 against all commercial establishments as
defined in Chapter 22, Sec. 21-1 of the Code of the City of Miami.
Currently, approximately 40,000 commercial establishments are
receiving City trash collection and street cleaning services but
do not pay for those tangible benefits.
Revenues generated from the street cleaning and commercial trash
collection fee will be sufficient to finance these operations in
FY'87. In addition, it is important to note that revenues
generated by the commercial trash collection and street cleaning
fee will be programmed specifically to those functions and that
those commercial establishments assessed a fee will be the direct
beneficiaries of specific services.
The additional resources programmed to support trash collection
and street cleaning operations in FY'87 are: (1) five additional
code enforcement inspectors, (2) approximately 50% of current
code enforcement personnel, (3) ten additional trash collection
crews, and (4) steam and vacuum cleaning machines and associated
support personnel.
The additional service level established by the Chapter 22
Ordinance and funded by the commercial trash collection and street
cleaning assessment is as follows:

Increased enforcement authority and presence.
It is important to demonstrate that this increased service level
represents an ambitious and practicable initiative to raise the
C i t y ' s standard of appearance and that the institution of the
commercial trash collection and street cleaning fee is an
appropriate measure to assess those beneficiaries of City
services. A fee schedule is attached for your information.
