RESOLUTION NO. 86-705
A RESOLUTION ACCEPTING TWO FEDERAL HISTORIC
PRESERVATION GRANTS-IN-AID IN THE AMOUNTS OF
$149225 AND $5,500 AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE ATTACHED AGREEMENTS WITH
THE FLORIDA DEPARTMENT OF STATE, DIVISION OF
ARCHIVES, HISTORY AND RECORDS MANAGEMENT, FOR
THE CITY TO PROVIDE HISTORIC PRESERVATION
SERVICES IN CONNECTION WITH SAID GRANTS-IN-AID.
WHEREAS, the City of Miami has applied for two federal grants-in-aid under
the Certified Local Government program to support Planning Department expenses
in the preparation of four publications concerning the City's heritage
conservation program, and in the preparation of the Buena Vista East Historic
District designation and the Biscayne Boulevard Thematic nomination; and
WHEREAS, said federal grants-in-aid, in the amounts of $14,225 and $5,500,
respectively, have been awarded to the City of Miami by the Florida
Department of State, Division of Archives, History and Records Management; and
WHEREAS, required matching funds for said grants-in-aid in the amounts of
$14,225 and $5,500, respectively, are available in the form of in -kind
services from existing staff in the Planning Department and budgeted Print
Shop fees;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Two federal grants-in-aid in the amounts of $14,226 and
$5,500 are hereby accepted for historic preservation work to be done in
connection with the preparation of four publications concerning the City's
heritage conservation program, and in the preparation of the Buena Vista East
Historic District designation and the Biscayne Boulevard Thematic nomination,
respectively.

and $5,500 and authorizing the City
Manager to execute the grant

The City of Miami has applied for and has been selected by the State of. Florida
to receive two federal grants-in-aid for historic preservation actfilities. The
first grant in the amount of $14,225 will be used to produce four brochures and/or
publications explaining and educating the public about the City of Miami's
heritage conservation program. The project will draw attention to designated
historic sites and will document the results of the downtown survey and master
plan.
The second grant in the amount of $5,500 will document two historic areas within
northeast Miami and will result in the preparation of a historic district a
designation report for Buena Vista East. Historic district designation has been
requested by the Buena Vista East Association. The grant will also result in the
preparation of a thematic nomination for selected buildings on Biscayne Boulevard,
Miami's first "shopping center." ?
Historic Preservation Grant Award
A G R E E M E N T
This AGREEMENT drawn at Tallahassee, Florida by and between the State of
Florida, Department of State, Division of Archives, History and Records
Management, hereinafter referred to as the Department, and the City of Miami,
hereinafter referred to as the Grantee, relative to the Miami Preservation
Education Project, hereinafter referred to as the Project, is entered into and
effective this day of , 1986.
WHEREAS, the'Department is responsible for the administration of grant-in-
aid assistance for historic preservation purposes under the provisions of.
Section 267.0617, Florida Statutes; and
WHEREAS, the Grantee has applied for grant-in-aid assistance for the
Project; and
WHEREAS, the 'said application has been reviewed and approved in accordance
with Chapter 1A-35, Rules of the Department of State, Historic Preservation
Grants -in -Aid; and
WHEREAS, grant-in-aid funds in the amount of fourteen thousand two hundred
and twenty-five dollars ($14,225.00) have been reserved for the Project by the
Department;
WITNESSETH, that in consideration of the mutual covenants herein
contained, the Department and the Grantee hereby agrees as follows:
I. The Project, as approved for grant assistance, shall consist of the
following authorized project work:
A. The research, writing, design and production of a series
of four (4) publications explaining and educating the
public about the City of Miami's heritage conservation
program. one will explain and promote the City's
heritage conservation program and ordinance; the
second will describe the historic sites and districts
that have received local historic designation; the
third will highlight the results of the downtown
Miami survey and historic preservation component of
the master plan; and the fourth will contain the
City of Miami's heritage conservation ci:dinance.

9. Preparation and submission of required reports, photo -
graphs, and supporting documentation as outlined in
Attachment A, Part it, and such other interim reports
and documentation as may be deemed appropriate by the
Grantee.
The Grantee agrees to administer the Project in accordance with the
General and Special Conditions Governing Grants and the
Administrative Instructions for Historic Preservation Project
Accountability attached hereto as Attachment "A", and the
Department's Rule 1A-35, Florida Administrative Code, and the
following specific conditions:
A. The Grantee agrees to complete the Project by June 30, 1987.
No costs incurred prior to the date of this Agreement will be
eligible for reimbursement from grant funds unless specifically
identified and authorized in Section I above and as specified
in Attachment "A". No costs incurred after the above project
campletion date will be eligible for reimbursement from grant
funds.
B. 'The Grantee shall be responsible for all work performed and
all expenses incurred in connection with the Project. The
Grantee understands and agrees that any work performed or
expenses incurred on the Project is undertaken at the sole
risk of the Grantee. Neither the Department nor the State
of Florida shall be liable for any expenses incurred in
connection with the Project by the Grantee or its professional
consultants, contractors, or agents.
C. The Grantee shall submit complete bid documents, including
plans and specifications, to the Department for review and
approval prior to the execution of any contract for
construction work.
D. The Grantee shall submit any and all proposed contracts for
the procurement of goods and/or services relating to the
Project, and all proposed contract change orders or amendments
for review and approval by the Department prior to the final
execution of said contracts and contract change orders or
amendments; but said review and approval shall not be construed
as imposition upon or acceptance by the Department of financial
liability in connection with said contracts or contract change
orders.
E. The Grantee shall coordinate consultation between its
professional consultants and appropriate Department staff
representatives as necessary to assure mutual understanding
of and agreement on the objectives, requirements, and
limitations of the Project in relation to the state historic
preservation programs.
The Department agrees to reimburse the Grantee, contingent upon
availability of grant funds, and upon receipt and verification of
the Grantee's request and documentation, for fifty percent (50%) of
the allowable project costs pursuant to and as defined in Attachment
"A", of authorized project work as defined in Section i above, up to
a maximum reimbursement of fourteen thousand two hundred and twenty-
five dollars ($14,225.00) or the amount of actual cash expended by
the Grantee for project work, whichever is least. The Department
further agrees to the following conditions:
A. The Department shall review and approve as to form and content
all proposed contracts of the Grantee for the procurement of
goods and/or services relating to the project work and all
proposed contract change orders or amendments prior to final
execution of said contracts, change orders or amendments, but
said review and approval shall not be construed as acceptance
by*or imposition upon the Department of any financial liability
in connection with said contracts.
H. The Department shall review and approve detailed plans,
specifications, and other bid documents for construction work
relating to the Project prior to the execution of any contract
for such work; review and comment on all preliminary
reports and recommendations; and confer with the Grantee and
its professional consultants as necessary throughout the course
of the Project, to assure compliance with the objectives,
requirements and limitations of the state historic preservation
programs.
IV. This i►istrument embodies the Wbole Agreement of the parties. 7t*xe
are no provisions, terns, conditions, or obligations other than those
contained herein; and this Agreement shall supersede all previous
communications, representations or agreements, either verbal or
written, between the parties hereto. No change or addition to this
Agreement shall be effective unless in writing and properly executed
• by the parties.
V. Any provision of this Agreement in violation of the laws of the State
of Florida shall be ineffective to the extent of such violation,
without invalidating the remaining provisions of this Agreement.
IN WITNESS WHEREOF, the Department and the Grantee have read this
Agreement and the Attachments hereto and have affixed their signatures.

contained, the Department and the Grantee hereby agrees as follows:
I. The Project, as approved for grant assistance, shall consist of the
following authorized project work:
A. Preparation of all forms, including Florida Master Site

File Site Inventory Forms, and supporting documentation
required to support the local designation of the Buena
Vista Neighborhood area as an historic district.
B. Preparation of all forms and supporting documentation
required to support the nomination of the Biscayne
Boulevard Thematic Group for listing in the National
Register of Historic Places.

and documentation as may be deemed appropriate by the
Grantee.

IV. This instrument embodies ;he whole Agreement of the parties. Where
are no provisions, terms, conditions, or obligations other than those
contained herein; and this Agreement shall supersede all previous

written, between the parties hereto. No change or addition to this
Agreement shall be effective unless in writing and properly executed
by the parties.
V. Any provision of this Agreement in violation of the laws of the State
of Florida shall be ineffective to the extent of such violation,

IN WITNESS WHEREOF, the Department and the Grantee have read this
