RESOLUTION NO. 86-101
A RESOLUTION APPROVING, IN PRINCIPLE, THE
ATTACHED "RESOLUTION OF UNDERSTANDING BETWEEN
THE CITY OF MIAMI AND DADE COUNTY RELATING TO
THE MIAMI RIVER AND ITS TRIBUTARIES EAST OF
THE SALINITY STRUCTURE AT 38TH AVENUE" WHICH
DEALS WITH LOCAL GOVERNMENTAL POLICY
CONCERNING THE MIAMI RIVER.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

The City of Miami Marine Patrol is the primary agency responsible for law enforcement from
the mouth of the river to the City's boundary which is just west of 27th Avenue.
The Metro -Dade Marine Patrol is the primary agency responsible for law enforcement iron
the City's boundary just west of 27th Avenue to the salinity structure at 36th Avenue.
A mutual aid agreement allows City and County law enforcement agencies to cooperate and
assist each other with routine law enforcement across jurisdictional lines.
The Miami Marine Patrol, Metro -Dade Marine Patrol, Florida Marine Patrol and Unite3 States
Coast Guard will cooperate in scheduling working shifts so that the river will be patrolled
for the greatest number of hours possible per 24-hour day.
The City and County will make regular surveys of the river for the purpose of locating
and assisting in the removal of derelict vessels (as defined by law) and in enforcing
applicable mooring codes; however, the Florida Department of Natural Resources is the primary
agency responsible for funding the removal of derelict vessels from the Miami River.
Dade County will continue to offer use of the Artificial Reef Program for placement o:
derelict vessels and to offer the assistance of the Metro -Dade Marine Patrol and Bomb Squad
to facilitate the sinking of derelict vessels as part of the Artificial Reef Program.
The Dade County Department of Environmental Resources Management (D.E.R.M.) is the primary
agency responsible for environmental concerns in and along the river.
The City will notify D.E.R.M. of potential pollutants and environmental concerns to the
Miami River, cooperate with and assiat D.E.R.M. to whatever extent possible in the
elimination of river pollution.
The City and County will work together to obtain funds to eliminate or redesign stornwate
outfalls in the Miami River that cannot be upgraded with existing Funds.
Dade County's D.E.R.M. is the primary agency responsible for identifying the sources of
pollutants entering the Miami River, remedying those situations with proper enforcement
and seeking assistance from the Florida Department of Environmental Regulation, the Florid, -
Department of Natural Resources, the U.S. Army Corps of Engineers and other sources to
identify additional methods for eliminating existing sources of pollution, cleaning -up.
contaminated sediments and preventing future pollution of the river.
The City and County will undertake shoreline stabilization and revegetat.on projects at
suitable locations along the river as grants and other sources of funding become available.
Dade County will continue to provide the services of Ms. Cleanup, a vessel wh:.ch rer:ove=
floating debris from the river.
The City and County will provide courtesy notice to the Dade County Archaeologist 12
permitting developments along the Miami River.
The City and County will encourage activities which provide public awareness of the 44--ft i
River and its rich heritage.
The City and County agree to respond promptly to reports of code violations on
properties.

The City and County recognize the need for an ongoing Miami River Coordinating Committee
with a similar mix of public and private citizens as previously created by Governor 3c
Graham and such Committee is hereby created. a=
The Committee shall be composed of eleven members selected as follows:
1) The Manager, City of Miami, or his designated staff member.
2) Three persons, appointed by the Miami City Commission, who have demonstrated an interest
in the protection and enhancement of the Miami River an4 who are not elected officia:a
or employees of the City of Miami and who represent an appropriate cross section of
businesses, conservationists, property owners, and other citizens interested in he
welfare of the Miami River.
3) The Manager, Metropolitan Dade County, or his designated staff member.
4) Three persons, appointed by the Dade County Commission, who have demonstrated an
interest in the protection and enhancement of the Miami River and who are not elected
officials or employees of :Metropolitan Dade County and who represent an appropriate
cross section of businesses, conservationists, property owners, and other citizens
interested in the welfare of the Miami River.
5) One staff member from the Florida Governor's Office.
6) Two persons, appointed by the Florida Governor, who have demonstrated an interes`.
in the protection and enhancement of the Miami River and who are not elected officials
or employees of the State of Florida and who represent an appropriate cross secticr.
of businesses, conservationists, property owners, and other citizens interested n
the welfare of the Miami River.
Members selected under items 1, 3 and 5 shall serve in perpetuity. Members selected under
items 2 and 4 shall serve terms of 3, 92 and 1 years respectively. Members selected undo:
item 6 shall serve terms of 3 and 2 years respectively. Vacancies on the CcRLnittee shall
be filled in the same manner as the original appointments.
The Committee shall elect a chairman from among its members. The Committee s�ia_l nees
at the call of the chairman. The Committee shall formulate its own rules and regslations.
Six members constitute a quorum for the transaction of business.
The Miami River Coordinating Committee shall provide the following services:
a) act as a clearinghouse of information for citizens needing assistance regardir.g a7
of the multiple agencies having jurisdiction over the river,
b) work with the Miami River business community and act as a liaison between that cc�ncni.
and the City and County,
c) be empowered to accept and expend grants and other donations from City and County ,
agencies or from private sources for the purposes of carrying out its duties anll
responsibilities under this agreement,
d) make recommendations for review and action by the appropriate City, County and athar
agencies that perform functions and services relating to the Miami River,
