A RESOLUTION RATIFYING THE ACTIONS OF THE CITY MANAGER WHICH RESCINDED A CONTRACT BETWEEN THE CITY OF MIAMI AND AL MARTIN ; INDUSTRIES, INC., AND EXECUTED A CONTRACT BETWEEN THE CITY OF MIAMI AND MET CONSTRUCTION, INC. FOR THE ORANGE BOWL ' RECEPTION ROOM; RESCINDING RESOLUTION NO. 86-510, ADOPTED JUNE 26,1986, WHICH AWARDED A CONTRACT TO AL MARTIN INDUSTRIES, INC.; AND AWARDING A CONTRACT TO MET CONSTRUCTION, INC., FOR THE ORANGE BOWL RECEPTION ROOM. WHEREAS, sealed bids were received June 23, 1986, for ORANGE BOWL RECEPTION ROOM; and WHEREAS, after determination of the low bidder, a contract was awarded to Al Martin Industries, Inc., in the amount of $397,000.00 for construction of said project, by Resolution No. 86-510, dated June 26, 1986; and WHEREAS, subsequent to the award of a contract, Al Martin Industries, Inc. has indicated its inability to supply the insurance coverage and performance bond necessary to successfully execute the contract documents in compliance with ' City requirements; and WHEREAS, Al Martin Industries, Inc. has formally requested that the City release said firm of any and all obligations to �4 execute a contract for the project in question; and WHEREAS, the City of Miami has a commitment with the Miami Hurricanes to provide the Reception Room facilities at the Orange Bowl Stadium for no later than the starting game of their regular season on September 13, 1986; and WHEREAS, MET Construction, Inc., the second lowest bidder, is already on the site working on another Orange Bowl project and has agreed to undertake construction; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution 86-510 adopted June 26, 1986, which authorized the City Manager to execute a contract with Al Martin Industries, Inc., in the proposed amount of $397,000.00 for ORANGE BOWL RECEPTION ROOM, is hereby rescinded. Section 2. The June 26, 1986, bid of MET Construction, Inc., in the proposed amount of $439,000.00, for the project entitled ORANGE BOWL RECEPTION ROOM, for the base bid of the proposal, based on lump sum prices, is hereby accepted at the price stated therein. Section 3. The amount of $439,000. 00 is hereby allocated from T.D.C. Resort Tax Revenues to cover the cost of said contract. Section 4. The actions of the City Manager which rescinded the contract with Al Martin Industries, Inc., and executed a contract with MET Construction, Inc., for the ORANGE BOWL RECEPTION ROOM, are hereby ratified. Odi o City Manager �1 ®ATE: S P 3 19FA MLM: SUBJECT: Orange Bowl Reception Room Resolution Rescinding Contract REFERENCES: (For Commission Meeting ENCLOSURES:of September 11, 1986) It is recommended that a resolution be adopted ratifying the actions of the City Manager to rescind the contract awarded to Al Martin Industries, Inc., for the project named ORANGE BOWL RECEPTION ROOM, and to award a contract to M.E.T. Construction, Inc., the second lowest bidder. Bids were received June 23, 1986 for ORANGE BOWL RECEPTION ROOM. As reflected in the tabulation of bids, the $397,000.00 bid of Al Martin Industries, Inc., was the lowest responsible bid for the total bid of the proposal, and a contract was awarded to said firm on June 26, 1986. New Florida statutes regarding insurance coverage and premiums have made it extremely difficult for some contractors to obtain the necessary insurance, as required to adequately protect the City's interests. After several meetings and correspondence to resolve problems with personnel from various City departments directly involved in the processing of the contract , the contractor notified I the Department of Public Works that his firm cannot provide neither the necessary coverage for this project nor a performance bond. The contractor requested to be released from any contract obligation. The project in question is of an emergency nature; both the Miami Dolphins and the Miami Hurricanes were promised the use of this facility for the start of their regular seasons. The Dolphins have already started their exhibition games; the Hurricanes need the facility for September 13, 1986. In an effort to avoid further Honorable Mayor and Members of the City Commission delays, and to have the room ready on time for the Hurricanes game, a contract was awarded and executed with the second low bidder, M.E.T.
