Home My WebLink AboutR-86-0770J-88-839 9/25/86 86770C RESOLUTION NO. .`= A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 4TH DAY OF NOVEMBER, 1986 FOR THE t PURPOSE OF SUBMITTING TO THE ELECTORATE AT SAID ELECTION THE FOLLOWING QUESTION: "IS IT OFFENSIVE, ANNOYING AND OBSCENE TO YOU AS A CITIZEN OF THE CITY OF MIAMI, FLORIDA, FOR A MOVIE, TELEVISION PROGRAM, VIDEO RECORDING OR PRINTED MATERIAL TO DEFAME, MOCK, OR DEGRADE BASIC RELIGIOUS BELIEFS BY THE USE OF NUDITY, SEXUAL ACTS, OR PROFANITY AS THE ';. TERM PROFANITY IS DEFINED BY FLORIDA LAW?"; FURTHER DIRECTING THAT A CERTIFIED COPY OF THIS RESOLUTION BE DELIVERED TO THE SUPERVISOR OF ELECTIONS _ OF METROPOLITAN DADE COUNTY, FLORIDA, NOT LESS THAN THIRTY DAYS PRIOR TO THE DATE OF SUCH SPECIAL MUNICIPAL ELECTION. WHEREAS, a matter of serious oommunity oonoern presently exists with respeot to the publio showing in the City of Miami of material like that contained in a movie, "Hail Mary", whioh _ depicts nudity, sexual ants and profanity as the term profanity f is defined by Florida law and whioh defames, mocks and degrades basin religious beliefs; and WHEREAS, the United States Supreme Court has deoided that eaoh oommunity may determine its own oontemporary community standards with regard to the publio showing of suoh material se that the government of the community oan if it desires to do so z x regulate suoh material in an informed, proper and oonstitutional manner; and WHEREAS, the most accurate praotioal and inexpensive manner for determining oontemporary oommunity standards of oitizens in the City of Miami with respeot to suoh material is to plaoe an appropriate question on the ballot; - NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI. FLORIDA: Seotion 1. A speoial munioipal eleotion is hereby oalled and direoted to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M. on Tuesday, November 4, 1988, for the El purpose of submitting to the qualified elootoro of the City of — Miami for their affirmation or denial the following question: Is it offensive, annoying and obscene to you as a citizen of the city of Miami, , Florida, for a movie, television program, video recording or printed material to defame, mook or degrade basic religious beliefs by the use of nudity, sexual acts, or profanity as the term profanity is defined by Florida Law? Section 2. Said special municipal election shall be held at the voting places in the precincts designated, all as shown on the list attached hereto and made a part hereof and referred to as Exhibit No. 1, or as may be designated by the Supervisor of Elections of Metropolitan Dade County, Florida, in conformity with the provisions of the general laws of the State. The Precinct Election Clerks and Inspectors to serve at said polling places on said election date shall be those designated by the Supervisor of Elections of Dade County for such purpose in a000rdanoe with the general laws of the State. A description of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is hereby adopting and desires to use for holding such special municipal election is as follows: all registration cards, books, records and certificates pertaining to electors of the City of Miami and established and maintained as official by the Supervisor of Elections of Dade County, Florida, in conformity with the provisions of the general laws of the State of Florida, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of the City of Miami. Section 3. In compliance with Section 100.342, Florida Statutes, the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein resolution and of the provisions hereof. at least twice. once in the fifth week and onoe in the third week prior to the week in which the aforesaid special municipal election is to be held, in the following newspapers of general oiroulation published in the City of Miami. Florida, at least tvioe, one in the fifth week and onoe in the third week, whioh notioe shall be substantially In the following form: "NOTICE OF SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 4, 1986 IN THE CITY OF MIAMI, FLORIDA PURSUANT TO RESOLUTION NO. 88- 770 A speoial referendum eleotion will be held on Tuesday, November 4, 1986, from 7:00 A.M. until 7:00 F.M. in the City of Miami, Florida, at the polling plaoes in the several eleotion preoinots designated by the Board of County Commissioners of Dade County, Florida, as set forth herein, unless otherwise provided by law, for the purpose of submitting to the qualified eleotors of the City of Miami, Florida, the following question: 'I8 it offensive, annoying and obsoene to you as a oitiaen of the City of Miami, Florida, for a movie, television program, video reoording or printed material to defame, nook or degrade basin religious beliefs by the use of nudity, sexual aots, or profanity as the term profanity is defined by Florida Law?' The offioial ballot to be used at said eleotion shall be in full oomplianoe with the laws of the State of Florida d' with respeot to absentee ballots amd to the use of the meohanioal ,. voting machines or the Computer Bleotion System (CBS), and shall be in substantially the following fora. to wit: =: OFFICIAL BALLOT SPECIAL MUNICIPAL ELECTION TUBODAY, NOVEMBER 4, 1986 FOR APPROVAL OR DISAPPROVAL OF THE FOLLOWING QUESTION: ------------------------------------------------------------- INDIVIDUAL EXPRESSION CONCERNING SENSITIVITY, ANNOYANCE AND OBSCENITY "Is it offensive, annoying and obsoene to you as a citizen of the YES City of Miami, Florida, for a movie, television program, video recording or printed material to NO defame, mook or degrade basic religious beliefs by the use of nudity, sexual aots, or profanity as the term profanity is defined by Florida Law?" ._Section 8. Electors desiring to vote in the affirmative, in answer to said Question described above, shall be instructed to punch straight down with the stylus through the hole nest to the word "YES" within the ballot frame containing the statement relating to said Question. Electors desiring to vote in the negative answer to said Question, shall be instructed to punch straight down with the stylus through the hole next to the word "CIO" within the ballot frame containing the statement relating to said Question. Section 6. The City Clerk shall cause to be prepared absentee ballots containing the Question set forth in Section 4 above for the use of absent electors entitled to cast such ballots in said election. Section 7. All qualified eleotors of said City shall be permitted to vote in said special municipal election and the Supervisor of Elections of Dade County is hereby requested, authorized, and direoted to furnish, at the cost and expense of the City of Miami, a lint of all qualified eleotors residing in the City of Miami as shown by the registration books and records Of the Office of said Supervisor of Eleotions and duly certify the same for delivory to and for use by the el.eotion offioials designated to serve at the respective polling places in said election preoinots. Section 8. For the purpose of enabling persons to register who are qualified to vote in said municipal election to be held on November 4, 1988, and who have not registered under the provisions of the general laws of Florida and Chapter 18 of the Code of the City of Miami, Florida, or who have transferred their legal residency from one voting precinct to another in the City, they may register Monday through Friday, from 8:00 A.M. to 8:00 P.M. at the Metropolitan Dade County Election Department located at 111 Northwest 1 Street, Miami, Florida. In addition to the above place and times, qualified persons mays register at such branch offices and may also use any mobile registration van for the purpose of registration in order to vote in the herein described election during such times and on such dates as may be designated by the Supervisor of Elections of Dade County. Section 9. NATTY HIRAI, the City Clerk of the City of Miami, Florida, or her duly appointed successor, is hereby designated and appointed as the official representative of the Commission of the City of Miami, Florida, in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election. Section 10. The City Clerk shall deliver a certified oopy Of this resolution to the Supervisor of Elections of metropolitan Dade County not less than thirty days prior to the date of the herein Special munioipal election.
