RESOLUTION NO -'
A RESOLUTION AUTHORIZING AND
DIRECTING THE CITY MANAGER TO ACQUIRE
BY NEGOTIATED PURCHASE AT A PRICE NOT
TO EXCEED $1,070,000 FOR A PARCEL OF
REAL PROPERTY LOCATED AT 3601 S. W.
37th AVENUE, ALSO KNOWN AS THE ST.
HUGH'S OAK PROPERTY IN THE CITY OF
MIAMI, WHICH CONTAINS APPROXIMATELY
3.094 ACRES AND WHICH IS MORE
PARTICULARLY AND LEGALLY DESCRIBED IN
THE ATTACHED EXHIBIT "A", TO BE USED
FOR HOUSING PURPOSES; FURTHER
AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO PROCEED TO CLOSE ON THIS
PARCEL AFTER EXAMINATION OF THE
ABSTRACT AND CONFIRMATION OF OPINION
OF TITLE, SAID ACQUISITION COSTS
TO BE PROVIDED FROM THE GENERAL
OBLIGATION HOUSING BOND FUND.
WHEREAS, there exists a critical shortage of standar(
housing in the City of Miami affordable to families an(
individuals of low and moderate income; and
WHEREAS, the City of Miami is in dire need of suitably
development sites for the development of such housing; and
WHEREAS, the City of Miami is interested in acquiring i
parcel of land located in the Coconut Grove neighborhood at 360:
S. W. 37th Avenue, also known as the St. Hugh's Oak propert;
which consists of 3.094 acres; and
WHEREAS, the City of Miami is seeking such property for thl
development of housing affordable to low and moderate incom,
families; and
WHEREAS, the City Commission finds that the herein propert;
is needed for the aforementioned purposes; and
WHEREAS, appraisals have been obtained and efforts to recur
the property for valid public and municipal purposes throug
negotiation should be undertaken by the City; and
WHEREAS, funds from the proceeds of the general obligatio
Housing Band Fund are available for the acquisition of th
subject property; and
WHEREAS, the cost of this parcel to the City would no
exceed estimated coats rased on appraised values; and
WHEREAS, the amount set forth in Exhibit A is reasonable an
in keeping with the cants of acquiring property through th

Section 1• This Commission hereby funds, determines, and }
declares that the matters suet out in the foregoing recitals are
true and correct and they are hereby incorporated by reference as
if fully set forth in this section.
Section 2. The acquisition of the parcel of land located at
3601 S. W. 37th Avenue, also known as the St. Hugh's Oak property
in the City of Miami, which parcel contains 3.094 acres and which
is more particularly and legally described in the attached
Exhibit "A" is hereby authorized for acquisition by way of
negotiated purchase.
Section 3. The City Manager is hereby authorized to execute
a purchase agreement for acquisition of the subject property
identified at a price not to exceed $1,070,000 subject to the
availability of funds provided for in the foregoing paragraphs.
Section 4. The City Attorney is hereby authorized to
proceed to close on this property after examination of the
Abstract and confirmation of an Opinion of Title.

Basis of just compensation:
The City's offer represents the full amount of Just
Compensation for the property and all interests
therein to be acquired. This offer represents the
appraised Fair Market Value of the subject property
less $100,000 of the appraised value made by a
competent professional appraiser. The subject
property has been inspected by the City and by the
independent appraiser.
FAIR MARKET VALUE IS DEFINED AS: The price
estimated in terms of money, which a property would
bring if eeposed for sale in the market with a
reasonable time allowed in Which to find a purchaser
buying with the knowledge ofo all the uses and

purposes to which it is adopted and of which it is
capable.'
Any.deorease or increase in the Fair Market Value of
real property to the date of valuation caused by the
public improvement for which such property is
acquired, or by the likelihood that the property
would be acquired for such improvement, other than
that due to physical deterioration within the
reasonable control of the owner, has been
disregarded in determining the compensation for the
property by the City and its appraiser.

As a result, a three (3) acre parcel of land located at 3601 S. W.
37th Avenue in the Coconut Grove neighborhood was determined to be
suitable for the program. Subsequently, the City retained two M.A.I.
certified appraisers in order to dete^mine the fair market value of
the property.
The appraisers retained by the City, Gabriel Garcia Meriocal and
Leonard A. Biez, determined the fair market value of the property to
be $910,000 and $1,100,000, respectively.
In an effort to move this program forward, I am recommending the
acquisition of the St. Hugh Oaks property through a negotiated
purchase. The purchase offer of $1,000,000 is recommended subject to
City Commission approval.
It is recommended that the attached resolution be adopted by the City
