A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO

ENTERPRISES, INC. IN CONNECTION WITH ALL
REMEDIES AVAILABLE TO THE: CITY OF MIAMI

REGARDING LOSS OF CERTAIN PROPERTY FROM
CONFISCATED BOATS STORED AT KEY MARINA.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMIr
FLORIDA:
Section 1. The City Attorney is hereby authorized to
initiate proceedings against Marine Stadium Enterprises, Inc. in
connection with all remedies available to the City of Miami
regarding loss of certain property from confiscated boats stored
at Key Marina.

ENCLOSURES.
This office is seeking authorization to commence the legal
proceedings necessary to receive restitution for the theft of
several items from two confiscated vessels while those vessels
were under the care and control of Marine Stadium Enterprises,
Inc.
This request is made pursuant to the attached memorandum
from Chief of Police Clarence Dickson.

i am requesting that the Law Department proceed with a legal action against
Gulfstream Marine Insurance/Key Marina for the replacement of or reimbursement
Costs for two engines stolen and propellers stolen from two vessels stored at Key
Marina pursuant to a contract with the City of Miami.
The Police Department case numbers for these incidents are #0231621 K an
#27416293. Risk Management OPT 36-061 and ,#PT-86-061 handled by file numbers
are Donna Welter.

f: Dear Sir,
In regard to your request for specific information on Marine Stadium
I Enterprises, Inc. rates and procedures for confiscated property to be stored
on our premises.
The rate for stored vessels will be $10.00 per day and there will be a
$20.00 hauling charge per vessel. Lower monthly rates,will be available if
requested. Boats will be accepted 24 hours a day. After normal hours of
operation, it will be necessary to call for someone to accept boat, there
will be a $50.00 charge to remove boat from water after hours.
Marine Stadium Enterprises, Inc. will provide a separate area for the
storage of confiscated vessels at no additional charge and the auctioning of
vessels may be conducted on our premises at any time except Saturdays and
Sundays. The impounding officer will accompany any boats placed into storage.
The impounding officer and an agent of Marine Stadium Enterprises, Inc. will
inventory boat and note condition of boat. All items except components of
the boat and normal safety equipmeme'will be removed from the boat by the
impounding officer and stored at the Police Department. All items remaining
on the boat will be listed on•the inventory. The agent of `.'urine Stadi=
Enterprises, Inc. will sign the pound slip for,the,boat. At this point the
boat and its contents become the sole 'responsibility:of-Marine Stadium
Enterprises, Inc. until boat Is released.' Normal` afety equipment will be
considered to be: life preservers and cushions, lights, ropes, anchors,
fire extinguishers, first aid kits, paddles, boat hooks and horns. Boats
will be released only with a release slip from the Police Property Unit.
Owner will sign for the boat on the release slip. Release slips will be
retained and returned to the Police Property Unit on a weekly basis.
Marine Stadium Enterprised, Inc. will accept vagsels during normal
business hours which are: Monday -Friday 8:00-6:00, Saturday -Sunday 8:00-
7:00. In the event a vessel is brought in after hours you may call Andy
Hancock at 448-2208 or Charles Hancock at 665-865i.
