RESOLUTION NO.
A RESOLUTION APPROVING THE INSTALLATION OF
DRIVE-IN FACILITIES AT A FINANCIAL
INSTITUTION LOCATED AT APPROXIMATELY
821-899 NORTHWEST 37 AVENUE, MIAMI, FLORIDA,
MORE PARTICULARLY DESCRIBED HEREIN, AS PER
PLANS ON FILE SUBJECT TO LANDSCAPE PLAN
APPROVAL BY THE PLANNING DEPARTMENT AND ALL
DEDICATIONS AS REQUIRED BY THE PUBLIC WORKS
DEPARTMENT AND ZB RESOLUTION NO. 86-86; ZONED
CR-2/7 COMMERCIAL -RESIDENTIAL (COMMUNITY).
THIS SPECIAL EXCEPTION IS ALSO SUBJECT TO A
TIME LIMITATION OF TWELVE MONTHS IN WHICH A
BUILDING PERMIT MUST BE OBTAINED.
WHEREAS, the owners, Racasa, N.V., a Netherlands Antilles
Corporation and Astrid, N.V., a Netherlands Antilles Corporation,
desire to install drive-in facilities in conjunction with its
financial institution located at approximately 821-899 Northwest
37 Avenue, Miami, Florida, more particularly described herein;
and
WHEREAS, the City Commission has determined that it wishes
to review all applications for the installation of drive-in
facilities; and
WHEREAS, the Miami Zoninq Board at its meeting of
July 21, 1986, Item 7, following an advertised meeting, adopted
Resolution ZB 86-86 by a nine to zero (9-0) vote granting the
Special Exception subject to the approval of the City Commission
as listed in Ordinance 9500, as amended, the Zoning Ordinance of
the City of Miami, Schedule of District Regulations, CR-2
Commercial -Residential (Community) and CR-1 Community -Residential
(Neighborhood), Principal Uses and Structures, Permissable Only
by Special Permit, to permit a drive-in facility for a financial
institution located at approximately 821-899 Northwest 37 Avenue, 1

Miami, Florida, also described as Lot 6 less the South 350 feet
less the West 20 feet and less the North 15 feet thereof and Lot
7 less the South 20 feet and less the North 15 feet thereof and
the North 105 feet of the South 350 feet less the West 20 feet,
TROPICAL TRADE COMPANY STATION "A", as recorded in Mat Book 4 at
Page 6 of the public Records of Dade County, as per plans on file
subject to landscape plan approval by the Planning Department and
all dedications as required by the Public Works Department; zoned
CR-2/7 Commercial Residential (Community); subject to a time
limitation of twelve months in which a building permit must be
obtained;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

the Zoning Ordinance of the City of Miami, Schedule of District
Regulations, CR-2 Commercial -Residential (Community) and CR-1

Structures, Permissable Only by Special Permit, to permit a
drive-in facility for a financial institution located at
approximately 821-899 Northwest 37 Avenue, Miami, Florida, also

a drive-in facility for a financial institution
requiring City Commission approval meets the
intent of Zoning Ordinance 9500. The proposed
facility is in accordance with a Declaration of
Restrictive Covenants proferred at the time the
subject property was rezoned to commercial use.
The north property line, NW 9th Street, which
faces an RG-2/5 (Multiple Residential District)
was intended to be protected with a landscape
buffer. The applicant is proposing a 12' 8"
landscaping area with a five feet (5') high
masonry wall. No ingress/egress from the
proposed parking structure or loading activities
are proposed through that street . There is
only ingress to the drive-in facility through NM
9th Street and the faacility meets the ten (10)
required stacking spaces behind each of the two
teller windows, therefore, no additional back up
is anticipated to occur on the street. The use
should not have any adverse impact on the
surrounding area.
The east property line which also faces an RG
2/5 district shall be heavily landscaped and.
parking structure wall should be redesigned with
architectural features that will lessen the
impact on the adjacent area to the east.
Require the dedication of the north 15' of Lots
6 and 7 and a 25' radius return at the
intersection of NW 31 Avenue and NW 9 Street.
No objection. ,
At its meeting of July 21, 1986, the Zoning
Board adopted Resolution ZB 86-86 by a 9 to 0
vote, granting the above with approval by the
City Commission subject to landscape plan
approval by the Planning Department and
providing all dedications as -required by the
Public Works Department. The Zoning Board
further granted a time limitation of'twelve
(12) months in which a building permit Est
be obtained.

Within the City generally, or within certain zoning districts, certain structures, uses,
and/or occupancies specified in this ordinance are of a nature requiring spacial and
intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special Umitations, co titions, and sofeguords which should
be applied as reasonably necessary to promote the general purposes of this Zoning
Ordnance, and, in particular, to protect adjoining properties and .the neighborhood
from avoidable potentially adverse effects. It is further intended that the expertise
and. judgement of the Zoning Board be exercised in making such determinations,. in
accordance with the rules, considerations and limitations relating to Class D Special
Permits and Special Exceptions. (See Article 26J
Formal public notice and hearing is not mandatory for Claw D Special Permits, but is
mansdatory, for Special Exceptions. In other respects, these classes of special permits
are the same.
The Zoning Board shall be solely responsible for determinations on applications for
Class D Special Permits and Special lxceptions. AU applications in these classes of
awdal permits shall be referred to the director of the Department of Planning for his
recommendation and the director dW make any further referrals required by these
• regulations.
