ORDINANCE NO. �
AN EMERGENCY ORDINANCE PROVIDING THAT THE
CITY MANAGER OR, DESIGNEE SHALL EE THE
DIRECTOR OF THE MIAMI SPORTS AND EXHIBITION
AUTHORITY AND THAT WHILE 80 SERVINO SAID CITY
MANAGER SHALL NOT EE AN EX OPVICIO MEMBER OF
THE GOVERNING BODY OF SAID AUTHORITY: FURTHER
PROVIDING THAT THE CITY ATTORNEY OR DESIGNEE
SHALL BE LEGAL COUNSEL FOR SAID AUTHORITY AND
MAY EMPLOY SUCH 'OTHER COUNSEL AS SHALL BE
APPROVED BY SAID AUTHORITY; AMENDING
SECTION 52,6-5, SECTION 52.6-5 AND
SUBSECTION (a) OF SECTION 52,6-5, OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
- BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA
Section 1. Section 52.6-8, Section 52.6-5 and
Subsection (a) of Section 52.6-3 of the Code of the City of
Miami, Florida, as amended, are hereby amended in the following
particulars 1
Sec. 52.6-8. Counsel.

The city attorney or designee thereof shall be the
legal counsel for the authority and may employ such
other counsel as shall b by said authority.

entering upon any duties. The director shall act as
the chief executive officer of the authority. Subject
to the policy directiV68 of the authority, the director
shall have general supervision over and be responsible
for the operation and maintenance of all authority
properties, activities, and facilities, The director
shall attend all meetings of the authority, shall
furnish the authority a monthly report with respect to
the operation, maintenance and financial condition of
the authority, and shall from time to time have
prepared and shall furnish such reports audits and
other information relating to said authority as may be
required by the authority. in the event that the
director shall for any reason be temporarily incapable
of exercising the powers and performing the duties and
functions of this office, the
commission may appoint an acting director to exercise
such powers and to perform such functions and duties
until such incapacity of the director shall be
terminated.
Sec. 52 6-3 Governing body.
(a) Composition. The authority shall consist of
nine (9) voting members to be appointed by the city
commission, one (1) of whom shall be the chairperson so
appointed by the city commission. Additionally, the
following shall be nonvoting, ex officio members of the
authority: the mayor and the city manager provided that
said city manager shall not be servins as director."
Section 2 All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section_4. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami
Section 5. The requirement of reading this ordinance on
two separate days is hereby dispensed with by an affirmative vote
- of not less than four -fifths of the members of the Commission.
Section 6. It is the intention of the City Commission that
the provisions of this ordinance shall become and be made a part
of the Code of the City of Miami, Florida, as amended, which
provisions may be renumbered or relettered and that the word
