HomeMy WebLinkAboutR-86-0797J-;6-d3b A RESOLUTION NO. - 6 m 7 9 7 A RESOLUTION VACATING, DISCONTINUING AND ABANDONING TWO (2) EASEMENTS FOR DREDGING AND WIDENING MIAMI CANAL AND RETURNING SAME TO PRESENT OWNERS LOCATED IN STREAMLAND GARDENS SUBDIVISION AMENDED IN DADE COUNTY SITUATED AT APPROXIMATELY 3163 N.W. SOUTH RIVER DRIVE AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE A QUIT CLAIM DEED THEREFORE. WHEREAS, a request has been made to release, vacate, discontinue and abandon two (2) easements granted to the City of Miami for widening and deepening the Miami Canal in 1931 and 1932 as recorded in D.B. 1485 at Page 380 and D.B. 1487 at Page 534 of the Public Records of Dade County, Florida; and WHEREAS, the project of dredging and widening the Miami Canal has since been completed and discontinued by law making the easements no longer necessary; and WHEREAS, Lots 18, 19 and 20 Streamland Gardens Amended (17- 27) the property over, under and across which said easements were granted now lies in the unincorporated area of Dade County; and WHEREAS, it has been determined that it would not be detrimental to the interests of the City of Miami to relinquish the aforesaid easements, and any refusal to do so would prevent the present owners fro utilizing the property for its highest and best use; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. ENcLoauRES:Resolution and Two (2) Quit Claim Deeds -Correspondence It is recommended that the attached Resolution be adopted vacating and releasing two •(2) easements and re- turning same to present owners by authorizing and directing City Manager and City Clerk to execute a Quit Claim Deed thereof. In 1931 and 1932 the City of Miami was granted easements for deepening and widening,the Miami Canal adjacent to property legally described as Lots 18, 19 and 20 of Streamland Gardens Amended (17-27) located at approximately 3163 N.W. South River Drive which is now in unincorporated Dade County. The project has since been completed and abandoned. The present owners of the property over, under and across which the easements pass have requested the release of said easements to better utilize their business by formal removal of them from the Public Records. This resolution recommended by the Department of Public Works permits the proper execution of the attached quit claim deeds which are made a part hereof.
