I () 1. 0 2 AN ORDINANCE AMENDING ORDINANCE NO. 10065 ADOPTE% MARCH 18o 1986, BY AUTHORIZ190 THE CITY COMMISSION AND CITY MANAGER TO Pt MiT THE SALE OR DISPENSING OF WIDE OR BEER IN SOFT CONTAINERS IN ONE (1) ADDITIONAL CITY PARK, NAMELY, VIRGINIA KEY PARXo ON SPECIAL OCCASIONS AND FOR SPECIAL EVENTS CAR PROGRAtiis ; PURTHER AUTHORIZING THE CITY COMMISSION To APPROVE SUCH PERMITS IN CONNECTION WITH "ROCK CONCERTS" CONTAINING A REPEALER PROV18ION AND 8EVERABIL1TY CLAUSE, WHEREAS, Ordinance No.10085 authorized the City Manager to permit the sale or dispensing of beer and/or wine in Bayfront Park, Bicentennial Park, Jose Marti Park, Peacock/Meyers Park, Watson Island Park and at the FEC Property; and WHEREAS, said Ordinance further established a permit fee of $300 per day for said sale of beer and/or wine; and WHEREAS, the nature of activities and events in Virginia Ivey Park make it appropriate to extend such beer and wine policy to that park; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sub -section (a) of Section 1 of Ordinance No. 10085, adopted March 18, 1986, is hereby amended in the following particulars 1: "Section 1. a. Notwithstanding any provision in the City Code of the City of Miami, Florida, to the contrary, the City Commission and the City Manager or his/her designee, on special occasions and for special events or programs, 4-& are hereby authorized upon execution of the application/permit form as attached, to permit the sale or dispensing of wine or beer in soft containers in the following City Parks; 1 UnderacQred words and/car figures shall be added, Remaining provisions are now in effect and unchanged. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. it is the intention of the City Commission that the herein provisions shall become and be made part of the Code of the City of Miami, Florida, as amended, all of which provisions may be renumbered or relettered and the word "ordinance" may be changed to "section", "Article", or other appropriate word to accomplish such intention. It is recommended that Ordinance No. 10085 be amended, authorizing the City Manager to permit the sale or dispensing of beer and/or wine in one (1) additional City park, namely, Virginia Key, in connection with special occasions and events, and providing other minor revisions pertainingpertaining to the authority of the Commission to approve such permits. Ordinance No. 10085 was adopted March 18, 1986 and authorized the City Manager to permit sales and dispensing of beer and/or wine in these City parks: Bayfront, Bicentennial, F.E.C. Property, Jose Marti, Peacock/Meyers and Watson Island. This legislation also contains provision for a $300 per day permit fee and approval of such sales at "rock concerts". Since that time, it has been determined that the community would be served by adding Virginia Key to the "permit list". This property is an appropriate site for special events, concerts, and festivals where responsible beer/wine sales attract the community to these activities. The attached ordinance further provides two minor revisions: the first allows the Commission, as well as the Manager, to approve such permits, and the second gives the Commission the authority to approve permits in connection with "rock concerts" when deemed appropriate.
