ORDINANCE NO, AN EMERGENCY ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO 6148, ADOPTED MARCH! 19, 1958, AS AMENDED, WHICH ESTABLISHED PEES FOR BUILDING, PLUMEINO, ELECTRICAL, MECHANICAL (INCLUDING BOILER AND ELEVATOR) INSPECTION, PERMIT AND CERTIFICATE FEES, BY ADDING AND INCREASING SOME FEES AND CLARIFYING CERTAIN ITEMS IN SAID SECTION 5, TO COMER THE INCREASE IN OPERATIONAL COST PRIMARILY FOR THE ENFORCEMENT OF THE SOUTH FLORIDA BUILDING CODE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA Section 1. Section 5 of Ordinance No. 6145, adopted March 19, 1958, as amended, which provides fees for building, plumbing electrical and mechanical (including boiler and elevator) inspection, permit and certificate fees, is hereby further amended by repealing said existing Section 5 in its entirety and substituting in its place and stead the following: "Sec. 5.- FEE SCHEDULE. a. FEE FOR WORK WITHOUT PERMIT: When work is commenced prior to obtaining a re uired a 't f f (4) ti th t q p rmi , a ee our mes a specified herein shall be paid, but in no event shall such fee be less than $28.00. The payment of such fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicableregulations and codes, nor shall it relieve them from "being subject ,to any of the penalties therein. Payable by cash or certified cashier's check. A copy of signed contract with a contractor to do the work is also required. 3. Letter of Credit from a Federally Guaranteed Insured - State Certified Bank. The letter shall indicate the purpose of the line of credit. A copy of signed contract with a contractor to do the work is also required. (iii) If work is not done within specified time, the City will proceed to have the work done (1) through, the Bonding Company if Method No. 1 was used; (2) through the con- tractor specified in the contract if Method No. -2 or Method No. 3 was used, using the proceeds from the cash bond or from the Bank Letter of Credit. (6) VIOLATION NOTICE; ' When a violation letter is sent ordering correction of an existing violation, the following administrative fee is required { -3- to be path such payment being cumulative and in addition to any fines or penalties which may be imposed as a result of a conviction for said violation: Each violation letter sent .............. (1) No refunds shall be made where any work has commenced except where duplicate S; permits are issued for the same work, in which case a refund in accordance with paragraph (4) of subsection (g) hereof Ilk may be granted to the original permit holder providing' that the duplicate permits were issued within ninety (90) days of each other and request for refund is received within ninety (90) days of the issuance of the latter permit. r (2) No refunds shall be made where permit have become void as provided by Paragraph 304.3(a) of the South Florida Building Code. (3) No refunds shall be made on permit fees t, of $10.00 or less. (4) Refunds on permits or any item thereon where fees are over $10.00 will be refundable on a basis of seventy percent (70%) of the balance over $10.00, such refunds to be made to the closet dollar. (5) Full refunds may be granted to a permit holder whose permit is cancelled by owner authorization where work has commenced and such owner selects a 10157- second contractor to coMplete the Work. The second contractor shall pay a full fee to complete the work unless the first contractor waives his/her opportunity to a refund in writing, or • if the property owner can provide proof / that the first permit holder was reimbursed for the permit fee, in which z.' case the second contractor is entitled to a permit to cover the same work on a 'no Charge' basis, if the first payment is expired the second contractor shall pay a full permit fee on unstarted work or a completion permit fee in accordance with subparagraph (b) of paragraph (16) of subsection d hereof. j, (6) A full refund may be granted to a permit holder who takes out a permit covering work outside the jurisdictional inspection area, or if permit is cancelled by the Department within ninety (90) days with no work being done. d.
