ORDINANCE NO,
AN EMERGENCY ORDINANCE AMENDING SECTION 5 OF
ORDINANCE NO 6148, ADOPTED MARCH! 19, 1958,
AS AMENDED, WHICH ESTABLISHED PEES FOR
BUILDING, PLUMEINO, ELECTRICAL, MECHANICAL
(INCLUDING BOILER AND ELEVATOR) INSPECTION,
PERMIT AND CERTIFICATE FEES, BY ADDING AND
INCREASING SOME FEES AND CLARIFYING CERTAIN
ITEMS IN SAID SECTION 5, TO COMER THE
INCREASE IN OPERATIONAL COST PRIMARILY FOR
THE ENFORCEMENT OF THE SOUTH FLORIDA BUILDING
CODE; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA
Section 1. Section 5 of Ordinance No. 6145, adopted
March 19, 1958, as amended, which provides fees for building,
plumbing electrical and mechanical (including boiler and
elevator) inspection, permit and certificate fees, is hereby
further amended by repealing said existing Section 5 in its
entirety and substituting in its place and stead the following:
"Sec. 5.- FEE SCHEDULE.
a. FEE FOR WORK WITHOUT PERMIT:
When work is commenced prior to obtaining a

payment of such fee shall not relieve any
person, firm or corporation from fully
complying with all of the requirements of all

Method No. 3 was used, using
the proceeds from the cash
bond or from the Bank Letter
of Credit.
(6) VIOLATION NOTICE;

When a violation letter is sent ordering
correction of an existing violation, the
following administrative fee is required

by Section 301.1 of the South Florida
Building Code, may be refunded by the

Refunds on permits or any item thereon
where fees are over $10.00 will be
refundable on a basis of seventy percent
(70%) of the balance over $10.00, such
refunds to be made to the closet dollar.
(5)
Full refunds may be granted to a permit
holder whose permit is cancelled by
owner authorization where work has
commenced and such owner selects a

second contractor to coMplete the Work.
The second contractor shall pay a full
fee to complete the work unless the
first contractor waives his/her
opportunity to a refund in writing, or

if the property owner can provide proof

that the first permit holder was
reimbursed for the permit fee, in which

case the second contractor is entitled
to a permit to cover the same work on a
'no Charge' basis, if the first payment
is expired the second contractor shall
pay a full permit fee on unstarted work
or a completion permit fee in accordance
with subparagraph (b) of paragraph (16)
of subsection d hereof.

(6) A full refund may be granted to a permit
holder who takes out a permit covering
work outside the jurisdictional
inspection area, or if permit is
cancelled by the Department within
ninety (90) days with no work being
done.

as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed,

remaining provisions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace) health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.
Section 7. It is the intention of the City Commission that
the provisions of this ordinance shall become and be made a part
of the Code of the City of Miami, Florida, as amended, which
provisions may be renumbered or relettered and that the word
"ordinance" may be changed to "section", "article", or other
appropriate word to accomplish such intention.

IT IS RECOMMENDED THAT THE PROPOSED ORDINANCE
BE ADOPTED WHICH PROVIDES FOR COLLECTION OF A
PORTION OF PERMIT FEES AT THE TIME OF
APPLICATION; INCREASE FEES TO REFLECT THE
ACTUAL COST TO THE CITY; ADD CERTAIN FEES FOR
ITEMS WHICH THE CITY HAS NOT BEEN PROPERLY
COMPENSATED TO DATE. THESE FEES ARE INCURRED
AS A RESULT OF PROVIDING SERVICE TO THE
CONSTRUCTION INDUSTRY AND THE GENERAL PUBLIC.
Overall Increase in fees
No substantial increase has been made to the permit fees since
The increase proposed will reflect the increase in cost to the - city
since 1981 due mainly to inflation (50%) and increase in employee
salaries (40%) This will bring the department closer to being operated
under enterprise funding.
It also provides for fees for services which have not to date been
charged to the construction industry, designers and public such as:
(a) Permit application fee collected at time of application to cover
cost of review if permit is not issued due to decision by developer to
abandon project and not acquire a building permit._
(b) Fees for computer installations
It is estimated that these fees will generate an increase of revenue,
derived from the, permitting process, of approximately 35% for an
additional $700,000.
