(MORE PARTICULARLY DESCRIBED HEREIN) FROM
RG-1/1 GENERAL RESIDENTIAL (ONE AND TWO-
FAMILY) TO CR-2/7 COMMERCIAL -RESIDENTIAL
(COMMUNITY) BY MAKING FINDINGS; AND BY MAKING
ALL THE NECESSARY CHANGES ON PAGE NO. 32F OF
SAID ZONING ATLAS MADE A PART OF ORDINANCE
NO. 9500 BY REFERENCE AND DESCRIPTION IN
ARTICLE 3, SECTION 300, THEREOF; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
July 21, 1986, Item No. 2, following an advertised hearing,
adopted Resolution No. ZB 82-86, by a 8 to 1 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of. the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 4220, 4234
and 4244 N.W. 2nd Street, and approximately 4225 N.W. 1st Street,
Miami, Florida, more particularly described as Lots 7, 8, 9, and
19, Block 1, KINLOCK PARK, as recorded in Plat Book 11 at Page 35
of the Public Records of Dade County, Florida, from RG-1/3
General Residential (One and Two --Family) to CR-2/7 Commercial -
Residential (Community).
Section 2. It is hereby found that this zoning
(a) IS in conformitV with the adopted Miami Comprehensive
Neiohbor hood Plan;
(b) Is not contrary to the established land use pattern#
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) rs not out of scale with the needs of the neighborhood
or the City,,
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or extensively increase traffic
congestion or otherwise affect public safety;
(i) Will. not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 32F of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts thereof
in conflict herewith are hereby repealed insofar as they are in
conflict.
Section 5. Should any part of provision of this Ordinance
be de-clared by a court of competent jurisdiction to be invalid,

This statement is a part of our application for Amendment to Zoning
Atlas as requested under Item #9 of said application.
For more than eleven years, the Bank has used the above mentioned lots
as off-street parking facilities for the Bank customers visiting the
Bank Main Office Building, located at LeJeune and Flagler Street
(N.W.,corner).
The above mentioned lots are part of a property that the Bank owns for
parking purposes and which is located facing LeJeune Road between the
First and Second Streets N.W.
'A conditional use for off-street parking was granted by the Miami City
Commission on May 5, 1975 by Resolution ZB53-75 by a 7 to 0 vote.
Therefore, we consider that the present zoning designated as
residential is inappropiate,

The above mentioned lots are part of a property that the Bank owns
and uses for Parking purposes.
However, the Bank is planning to build a new building on this
' property; to this purpose, and since most of the property is zoned
"Commercial" and in order to optimize the utilization of the lot, we
are requesting that the lots in reference be rezoned from Residential
RG - 1/3 to Commercial CR - 2/7.
We would proceed with the project as soon as possible depending on
the approval of our request.
According to our growth plans, we would like to have this building
started by the end of this year or the beginning of next year, so we
would appreciate that the rezoning procedure is expedited by you as
much as possible,

LETTER OE INTENT
Applicant has owned the subject real property for over ten
(10) years. On or about May 5, 1975 pursuant to Resolution No.
2B53-75, the City of Miami Commission by a seven to zero vote
approved' a conditonal use of the property for off street
parking. Subsequent to that date the property has been used
exclusively as a parking facility by the applicant to
accommodate its banking facilities situate on adjacent
properties.
Over the last several years the character of the
neighborhood has become substantially commercial in nature and
a residential classification is inconsistent with the area.
Applicant has made a substantial economic impact both in
the immediate community and the City of Miami in general and is
now considering expanding its banking operations onto the
subject property and adjacent parcels which it owns and are
presently zoned CR 2/7. The granting of this rezoning
application is critical to applicant's expansion plans.
