EXHAUSTION OF ADMINISTRATIVE REMEDIES PRIOR
TO JUDICIAL REVIEW AND PROVIDING THAT THE

DECISIONS SHALL BE BY FILING A NOTICE OF
APPEAL; CONTAINING A REPEALER PROVISION AND A
SEVERABILtTY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 2., 1986, Item No. 3, following an advertised hearing,
adopted Resolution No. PAR 26-86, by a 9 to 0 vote, RECOMMENDING
APPROVAL, as amended, of an amendment to Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, as hereinafter setf_orth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of. the City of Miami and its inhabitants to grant
this amendment to the Zoning Ordinance as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The text of Ordinance No. 9500, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended as
follows:l

conflict.
Section 3. Should any part or provision of this Ordinance
be declared by a Court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as a
whole.

ZONING BOARD REVIEW BY CITY COMMISSION,
COMMISSION POWERS; JUDICIAL REVIEW, of Ordinance
9500, as amended, the Zoning Ordinance of the
City of Miami by providing that persons
aggrieved by a land -use decision of the City
Commission may request review by filing an
appeal in accordance with Florida Appellate
Rules and deleting reference, to a petition for
issuance of a writ of certiorari.
REQUEST
To furtherspecify the form and procedure of
appeals to the Courts from land -use decisions of
the Commission.
ANALYSIS
The Law Department has suggested that this
procedure will result in a three -judge appellate
panel that is more likely to include jurists who
are knowledgeable in planning and zoning than a
single judge, as allowed by the existing
procedure. The Law Department further suggests
that judicial decisions based on thorough
knowledge are more equitable to both the
appellant and the City.
