FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 43 OF SAID ZONING ATLAS
MADE A PART OF ORDINANCE NO. 9500 BY
REFERENCE AND DESCRIPTION IN ARTICLE 3,
SECTION 300, THEREOF; CONTAINING A REPEkLER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
June 16, 1986, Item No. 5, following an advertised hearing,
adopted Resolution No. ZB 69-86, by a 9 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 2564-2574
Southwest 27th Lane, Miami, Florida, more particularly described
as Lots 1 - 10 inclusive, Block 2, SILVER BLUFF BUSINESS CENTER,
as recorded in Plat Book 14 at Page 76 of the Public Records of
Dade County, Florida, from RS-2/2 One -Family Detached Residential
to RO-1/4 Residential -Office.
Section 2. It is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) Will riot create an i:soIated district unrelated to
adjacent anM nearby districts;
(d) is not out of scale with the nQerls of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f_) Is necessary roue to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the

adjacent area;

development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 43 of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts thereof
in conflict herewith are hereby repealed insofar as they are in
conflict.
Section 5. Should any part of provision of this Ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as a
whole.

Change of Zoning Classification in the Official
Zoning Atlas of Ordinance 9500, as amended, the
Zoning Ordinance of the City of Miami to RO-1/4
Residential -Office.
APPROVAL. The proposed change would be in
con ormity with Planning Department current
proposal to modify the Miami Comprehensive
Neighborhood Plan. The subject property is
within the Southwest 27th Avenue Study Area and
has been recommended for the R0-1/4 zoning
redesignation within the context of that study.
The Florida State Department of Community
Affairs in Tallahassee has not objected to the
Amendment to the Comprehensive Plan and the
Planning Advisory Board has recommended approval
on 5/14/86. The proposed change is not contrary
to the established land use pattern,

The change suggested is not out of scale with
the needs of the neighborhood or the city.
Existing district boundaries are illogically
drawn in relation to existing conditions on the
property proposed for change.

PUBLIC WORKS The proposed zoning change will allow a
substantially greater sewage flow from the
subject property. The existing sanitary sewer
system serving this property was not designed
for the additional sewage discharge.

ZONING BOARD At its meeting of June 16, 1986, the Zoning
Board adopted Resolution ZB 69-86 by a 9 to 0
vote, recommending approval of the above.
CITY COMMISSION At it meeting of July 24, 1986, the City
Commission passed the above on First Reading.
At its meeting of September 25, 1986, the City
Commission continued action on the above.

STATEMENT EXPLAINING WHY PRESENT
ZONING DESIGNATION IS INAPPROPRIATE
The present zoning of the subject property of RS-2/2 is
inappropriate because the general surrounding area is wholly
characterized by commercial buildings and activity. The subject
property, as a practical matter, is an integral paTt of the
southern intersection of U.S. 1 and 27th Avenue. At that
location there are various retail stores, a gas station, offices,
warehouse space, a fast-food outlet and a new restaurant under
construction.
Across the street directly to the west is warehouse
space zoned CR-2-7. To the southwest is the Burger King
restaurant and parking lot, and small offices. Approximately
100' to the northwest, there is open exposure to U.S. 1 across a
City -owned public parking lot, and across U.S. 1, the Metrorail
station occupies one corner and retail/industrial buildings the
other corner. Across S. W. 27th Lane to the north are small
offices, zoned RO-1/4.
Additionally, the traffic pattern in the area is not
conducive to residential use. Noise from traffic on U. S. 1 is
loudly evident at all times, since the northwest corner of the
subject property directly faces that highway. Further, the west
border of the subject property, S.W. 26th Avenue, is frequently
used by many drivers as a short-cut between U.S. 1 and 27th
Avenue.
Therefore, the present zoning of the subject property
is inappropriate due to the major impact of the adjacent
commercial use and traffic, and we respectfully request a
s rezoning to RO-1/4.

STATEMENT EXPLAINING WHY PROPOSED
ZONING DESIGNATION IS APPROPRIATE
An RO-1/4 zoning designation for the subject property
as proposed is much more appropriate than the present RS-2/2
zoning because the subject property faces commercial activity and
a major highway on its two front sides (it is a corner property).
Across S.W. 26th Avenue to the west and southwest are varied
retail enterprises in an area zoned CR-2/7. To the northwest is
a small open City -owned parking lot, bordering U.S. 1. To the
north and northeast are offices on U.S. 1, zoned RO-1/4.
The subject property borders to the east a residential
neighborhood but a physical inspection of the subject property's
location shows that the character of that particular corner (S.W.
26th Avenue and S.W. 27th Lane) is commercial. Plans now being
discussed for development of the Crook & Sons block and the
existence of the Metrorail station within easy walking distance
suggest that the trend for that particular area is toward more
commercial/retail/office use. Thus, it is important to recognize
this trend and provide for both a transition and a buffer for the
established residential area. RO-1/4 zoning is ideally suited
for this, as such zoning along U.S. 1 demonstrates.
Thus, the proposed rezoning to RO-1/4 allows for a
logical and controllable transition of zoning_ from the CR-2/7
commercial area on the west of the subje-• property, with an FAR
of 1.72, into the residential neighborho�. on the east. It is
also in keeping with the RO-1/4 zoning on the north and northeast
which now serves as a buffer for the residential neighborhood.
The subject property is within the Southwest 27th
Avenue Study Area and has been recommended for the RO-1/4 zoning
redesignation requested in this Application within the context of
that Study. While the main focus of that Study is on 27th Avenue
itself, the underlying philosophy of the Study seems to be toward
suggestions for preserving the nearby residential areas in view
of changing economics and development pressures along the main
thoroughfare. The uses permitted by RO-1/4 meet this goal,
especially at the subject property's location. The subject
property is the only piece missing in the already -established
buffer line between the higher commercial uses on 27th Avenue and
U,S. 1, and we therefore respectfully request the City to rezone
it to RO-1/4,
