BY ADDIFj NEW AREAS TO BE INCLUDED UNDFR C.AFF 70NES IN SECTION 54-109, "DEFINITION'S"; AND BY AMENDING, SECTION 54-114, "STANDARDS AND CRITERIA FOR APPLICATION REVIEW", AND SECTION 54-116 "FORM AND CONDITIONS OF PERMIT . "' WHEREAS, the City Commission adopted Ordinance No. 9848 on June 14, 1984 establishing rules and regulations for permitting sidewalk cafes in the downtown central business district; and WHEREAS, the establishment of sidewalk cafes enhances the appeal of the City to tourists, thereby providing needed support to a vital regrowth of the C ity's economy; and WHEREAS, established sidewalk cafes will be accessible to the general public, thereby providing additional opportunity for relaxation and enjoyment of the unique climate which symbolizes South Florida; and WHEREAS, special commercial streets and districts in addition to the downtown central business district could greatly benefit from such cafes by providing people with a unique way to experience that environment; and WHEREAS, the establishment of the herein described sidewalk cafe zones and regulations are deemed in the best interest of the health and safety of the citizens of Miami. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Article VI, entitled "Sidewalk Cafes" of Chapter 54 of the Code of the City of Miami is hereby amended as follows:1 ARTICLE VI. SIDEWALK CAFES. Sec. 54-109. Definitions. (a) the downtown central business district bounded by Northeast - Northwest 6th 5#b. Street on the North, Biscayne Boulevard on the East and the Miami River on the South and West; and i/ Words and/or figures stricken through shallbe deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. (h) NW 7 Avenue from NW 55 Street to NW 64 Street. (i) the area zoned SPIRB (Design District) in the Official Zoning Atlas made a part of Zoning Ordinance 9500. Sec. 54-114. Standards and Criteria for Application Review The following standards and criteria shall be used in reviewing the drawing required in Section 54-112(a)(6): (a) Sidewalk Cafes are restricted to the frontage of the licensed restaurant or food service establishment to which the permit is issued; or within the frontage of the building where the licensed restaurant or food service establishment is located, provided that written approval is supplied by the property owner. (h) Awnings, umbrellas and other decorative material shall be fire retardant pressure treated, or manufactured of fire resistive material. Sec. 54-116. Form and Conditions of Permit. The permit shall be issued on a form deemed suitable by the Director. In addition to naming the permittee and any other information deemed appropriate by the Director, the permit shall contain the following conditions: (c) The permit may be suspended by the Director when necessary to clear sidewalk areas for a "Community or Special Event" shall-a providw authorized by a permit issued by the Police Department. - 2- Section 2. All ordinances, code sections or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 3. Should any part or prevision of this Ordinance he declared by a court of competent jurisdictioi to he invalid, the sAme- shall not affect the validity of the ordinance as a whole, PASSED ON FIRST READ11K^, BY TITLE ONLY this 23rd day of October , 1986.
