WHEREAS, the Miami Zoning Board at its meeting of July 21, 1986, Item 1, following an advertised hearing, adopted Resolution ZB 81-86 by a seven to two vote (7 - 2), granting the ro Special Exception as listed in Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 2 of 6, RG-3 General Residential, Principal Uses and Structures, permitting accessory installation and facilities for the property located at 5950-60-80-90 Northwest 7th Street, Miami, Florida, (more particularly described herein), as per plans on file, for the Pan American Hospital located at 5959 Northwest 7th Street, subject to: (1) the applicant providing a 24-hour towing service available for use by the neighbors in the area in case of illegally parked cars; (2) applicant paying for the installation of a traffic light if CITY COMMISSION MEETING OF OCT "e:i 1986 NO, approved by Dade County Traffic and Transportation; (3) operating hours of facility to be Monday through Friday from 8:00 A.M. to 6:00 P.M.; (4) providing ten (10) off-street }parking spaces on the hospital site located at 5950 Nni-thwest, 7th Street; (5) providing all dedications as requjred by the Public Works Department; and ( 6 ) a review by the Zoning Board one year after date of issuance of Certificate of Occupancy; zoned RG-3/5 General Residential, with a time limitation of twelve (12) months in which a building permit must be obtained; and WHEREAS, concerned neighbors have taken an appeal to the City Commission from the granting of the 3peci.al Exception; and WHEREAS, the City Commission after careful consideration of this matter finds that the Special Exception as approved by the Zoning Board meets the applicable requirements of Zoning Ordinance 9500; NO", THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Zoning Board in granting the Special Exception as listed in Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 2 of 6, RG-3 General Residential, Principal Uses and Structures, permitting accessory installation and facilities for the property located at 5950-60-80-90 Northwest 7th Street, Miami, Florida, also described as Lots 1, 2, 29, and 30 less the North 10 feet of Lots 1 and 30s. The Special Exception as requested ones not meet the intent of Zoning Ordinance 9500. The proposed use will not be compatible and harmonious with other development in the area and vill cause an undue encroachment into this stable residential area. Even though the applicant is proposing to provide the required number of parking spaces in accordance with the land use intensity sector of this district, it appears that this number will be insufficient based on the number of doctors which will be using the facility. The request will potentially create a parking problem and will cause adverse effects on adjoining and nearby properties disrupting the neighborhood with vehicles parked in front of homes located in the vicinity. There appeared to be general agreement among the members of the board that it was not fair to either recommend denial or to deny an application for lack of parking when the provisions of the zoning ordinance had not only been complied with but exceeded. 2. There appeared to be general agreement among the members of the board, as expressed by the Chairman in his summation of the discussion, that between the church parking facilities and those of the hospital and nearby shopping center there is more than enough parking to accommodate the existing and proposed non-residential uses, and that if the various parties got together a solution to the parking problem could be achieved. The Chairman further noted that the hospital is not going to go away, and that the proposed new structure is the best thing he had seen proposed for the location.
