HAS A TIME LIMITATION OF TWELVE (12) MONTHS
IN WHICH A BUILDING PERMIT MUST BE OBTAINED.
WHEREAS, the Miami Zoning Board at its meeting of
July 21, 1986, Item 1, following an advertised hearing, adopted
Resolution ZB 81-86 by a seven to two vote (7 - 2), granting the

Zoning Ordinance of the City of Miami, Schedule of District
Regulations, Page 2 of 6, RG-3 General Residential, Principal
Uses and Structures, permitting accessory installation and
facilities for the property located at 5950-60-80-90 Northwest
7th Street, Miami, Florida, (more particularly described herein),
as per plans on file, for the Pan American Hospital located at
5959 Northwest 7th Street, subject to: (1) the applicant
providing a 24-hour towing service available for use by the
neighbors in the area in case of illegally parked cars; (2)
applicant paying for the installation of a traffic light if

WHEREAS, concerned neighbors have taken an appeal to the
City Commission from the granting of the 3peci.al Exception; and
WHEREAS, the City Commission after careful consideration of
this matter finds that the Special Exception as approved by the
Zoning Board meets the applicable requirements of Zoning
Ordinance 9500;
NO", THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The decision of the Zoning Board in granting
the Special Exception as listed in Ordinance 9500, as amended,
the Zoning Ordinance of the City of Miami, Schedule of District
Regulations, Page 2 of 6, RG-3 General Residential, Principal
Uses and Structures, permitting accessory installation and
facilities for the property located at 5950-60-80-90 Northwest
7th Street, Miami, Florida, also described as Lots 1, 2, 29, and
30 less the North 10 feet of Lots 1 and 30s. Block 28, WEST
FLAGLER PARK SECTION B, as recorded in Plat Book 8 at Page 112 of
the Public Records of Dade County, Florida, as per plans in file,
for the Pan American Hospital located at 5959 Northwest
7th Street, subject to: (1) the applicant providing a 24-hour
towing service available for use by the neighbors in the area in
case of illegally parked cars; (2) applicant paying for the
installation of a traffic light if approved by Dade County
Traffic and Transportation; (3) operating hours of facility to be
Monday through Friday from 8:00 A.M. to 6:00 P.M.; (4) providing

PLANNING DEPARTMENT DENIAL. The Special Exception as requested
ones not meet the intent of Zoning Ordinance
9500. The proposed use will not be compatible
and harmonious with other development in the
area and vill cause an undue encroachment into
this stable residential area. Even though the
applicant is proposing to provide the required
number of parking spaces in accordance with the
land use intensity sector of this district, it
appears that this number will be insufficient
based on the number of doctors which will be
using the facility. The request will
potentially create a parking problem and will
cause adverse effects on adjoining and nearby
properties disrupting the neighborhood with
vehicles parked in front of homes located in the
vicinity.
PUBLIC WORKS Require the dedication of the north 10' of Lots
1 and 30 and a 25' radius return at the
intersections of NW 59 Court and NW 60 Avenue
with NW 7 Street.

b TRANSPORTATION No objection.
ZONING BOARD At its meeting of June 2, 1986 the Zoning Board
adopted Resolution ZB 57-86 by a 9 to 0 vote
continuing the item to July 7, 1986.
At its meeting of July 7, 1986, the Zoning Board
deferred action on the above.
At its meeting of July 21, 1986, the Zoning
Board adopted Resolution ZB 81-86 by a 7 to 2
vote, granting the above subject to: 1)
applicant providing a 24-hour towing service
available for use by the neighbors in the area
in case of illegally parked cars; 2) applicant
paying for the installation of a traffic light
if approved by Dade County Traffic and
Transportation; 3) operating hours of facility
to be Monday through Friday from 8:00 AM to 6:00
PM; 4) providing ten (10) off-street parking
spaces on the hospital site located at 5959 NW 7

Within the City generally, or within certain zoning districts, certain structures, uses,
and/or occupancies specified in this ordinance are of a nature requiring special and
intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special limitations, conditions, and safeguards which should
be applied as reasonably necessary to promote the general purposes of this Zoning
Ordinance, and, in particular, to protect adjoining properties and the neighborhood
from avoidable potentially adverse effects. It is further intended that the expertise
and judgement of the Zoning Board be exercised in making such determinations, in
accordance with the rules, considerations and limitations relating to Class D Special
Permits and Special Exceptions. (See Article 26.)
Formal public notice and hearing is not mandatory for Class D Special Permits, but is
mandatory for Special Exceptions. In other respects, these classes of special permits
are the same.
The Zoning Board shall be solely responsible for determinations on applications for

This letter accompanies the subject application for special
exception to state the following:

1. The proposed building is one (1) story in height only;
2. No use shall be made of, nor any activity conducted on
the subject property between the night-time hours of 10:00 p.m.
and 6:00 a.m. prevailing Eastern Time;
3. The architectural design of the proposed building is in
conformity with the general character of the neighborhood;
4. The total landscaping budget shall exceed $10,000.

covering and running with the above -referenced property ("the
Property") specifying that this Declaration: (i) shall constitute
a covenant running with the land; (ii) shall be binding upon the
undersigned as the owners (the "Owners") of the Property and all
parties deriving title through theta; (iii) shall be for the
benefit of and a limitation upon all present and future owners of
the Property; and (iv) shall be for the benefit of the City of
Miami, Florida (the "City") for the public welfare.
1. The Owners are presently applicants before the City
Commission of the City pursuant to the City's Zoning Ordinance
(the "Ordinance") to rezone the subject property from RS-2/2 to
RG- 3/ 5.
2. If the Property is rezoned as requested, the following
covenants and restritions shall be applicable to the Property:
(a) No building or structure erected on the property
shall exceed one (1) story in height;
(b) No use shall be made of, no- any activity conducted
on the Property between the night-time hours of 10 p.m. and 6
a.m. prevailing Eastern Time.
(c) The architectual design of any buildings or
structures erected on the Property shall be in conformity with the general charachter of the neighborhood;
(d) The total landscaping budget shall be a minimum of
ten thousand dollars ($10,000). This amount shall, in part, be
used to buffer the subject property from adjoining residential
areas.
(e) A solid masonry wall having a height of eight (8)
feet shall be erected along a line five (5) feet from the rear
boundary of the subject property and parallel thereto. vines

(v) Community based residential facilities;
(vi) Private clubs, lodges, fraternities, soror-
ities and similar uses, not for profit;
(vii) Conversion to multiple dwelling use, or
addition of units, in existing structures not conforming to RG-3
requirements; and
(viii) Occupancy of private pleasure craft as
living quarters.
3. This Declaration of Restrictions may be modified amended
or released as to all or any portion of the Property by written
instrument executed by the holder or holders of the fee simple
title to the Property and by the City or its authorized
representative, provided, that no such modification, amendment or
release shall be made without a prior public hearing being held
by the City.
4. This Declaration shall enure to the benefit of the
Owners, the City, and all property owners within a 300 foot
radius of the Property and may be enforced by the City "by (J-z ,

by a suit in equity against the then owners of the Property �
violating these restrictions
In the event of
such litigation, the prevailing party shall be entitled to .ttorneys fees.-
5. Effective Date. The effective date of this Declaration

tion submitted by the Owners. In the event the application asq
submitted by the Owners is not approved, this Declaration shall
be considered null and void and shall not be recorded in the
Public Records of Dade County, Florida. In the event the appli-
cation as submitted by the Owners is approved by the City but is
challenged by third parties in a court of competent jurisdiction,
then the provisions of Section 2 hereof shall be stayed pending
the final determination of the court action. In the event such
court action results in a reversal of the City's final approval
of the application, then the provisions of Section 2 hereof shall
be deemed null and void and without any force or effect.

I would like to share with you some of my observa �on�frem
the recent June 2nd Zoning Hoard meeting at which thG Pan
American Hospital application was considered. I belidVe ttheWe
observations objectively reflect the sense of the Board in :Vhett
official comments at the meeting.
1. There appeared to be general agreement among the members
of the board that it was not fair to either recommend
denial or to deny an application for lack of parking
when the provisions of the zoning ordinance had not only
been complied with but exceeded.
2. There appeared to be general agreement among the members
of the board, as expressed by the Chairman in his
summation of the discussion, that between the church
parking facilities and those of the hospital and nearby
shopping center there is more than enough parking to
accommodate the existing and proposed non-residential
uses, and that if the various parties got together a
solution to the parking problem could be achieved. The
Chairman further noted that the hospital is not going to
go away, and that the proposed new structure is the best
thing he had seen proposed for the location.
Sergio, as you know, the Board continued the hearing to July
7th in order to allow the hospital to make specific proposals for
the parking arrangements and so we can meet with you to discuss

these -including possibly looking into requesting a crosswalk to
the hospital. I believe the mandate of the Board is to come back
with a constructive solution to this situation.
Toward this end, Art Berger and I are working with the
hospital to identify specific parking arrangements, and I look
forward to meeting with you and Guillermo 01medillo to discuss
these. I look forward to a positive solution to this request.

In response to your inquiry about use of adjacent homes by the Pan American
Hospital located at 5959 N.W. 7th Street an inspection was made by a Zoning
Inspector.
The buildings in questions are located at 5950-60-80-90 N.W. 7th Street.
Two (2) were found to be vacant, one (1) was being used as an office and one
(1) was being used for storage. The Zoning Inspector issued them a notice
of violation.
Also, be advised that the Pan American Hospital Administration has applied
for a Special Exception to utilize the lots, on which these buildings are
located, for accessory installations and facilities for the Hospital. This
item was scheduled to be heard by the Zoning Board on its April 7th, 1986
meeting however, the applicant requested a deferral until the June 2nd, 1986.

use the space granted as office space for the hospital for other purposes.
have received complaints that adjacent homes are being utilized to store
medical supplies --something which we were assured that would stop --with
various vehicles creating a disturbance in the neighborhood pulling in and
out of those homes at late hours (9:00 p.m. to 12:00 midnight) .
Please have someone check if Pan American Hospital has received approval
for any Zoning variances and let me know if space is used for any other
than specified purposes.
