WHEREAS, at the C i ty Commission Meeting of June 12, 1986, Resolution No. 86-430 was passed which ordered a highway improvement identified as MANOR HIGHWAY IMPROVEMENT - PHASE IV in MANOR HIGHWAY IMPROVEMENT DISTRICT - PHASE IV H-4519; and WHEREAS, pursuant to due public notice, public hearings were held before the City Commission on July 10, 1986, September 11, 1986 and November 13, 1986, as to any objections to the confirmation of Resolution No. 86-430 which resolution ordered MANOR HIGHWAY IMPROVEMENT -PHASE IV in MANOR HIGHWAY IMPROVEMENT DISTRICT -PHASE IV H-4519; and WHEREAS, no objections to the confirmation cf said highway improvement were sustained by the Commission, it is therefore in order -for the Commission to confirm said ordering resolution and authorize the City Clerk to advertise for sealed bids for the construction of said improvement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 86-430 dated June 12, 1986, which ordered MANOR HIGHWAY IMPROVEMENT -PHASE IV in MANOR HIGHWAY IMPROVEMENT DISTRICT -PHASE IV H-4519 is hereby confirmed. 3 Section 2. The City Clerk is hereby authorized to advertise for sealed bids for the construction of MANOR HIGHWAY IMPROVEMENT -PHASE IV in MANOR HIGHWAY IMPROVEMENT DISTRICT -PHASE IV H-4519. O d i o ENCLOSURES: City Manager RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution confirming Ordering Resolution No. 86-430 and authorizing the City Clerk to advertise for sealed bids for the construction of Manor Highway Improvement -Phase IV in Manor Highway Improvement District -Phase IV, H-4519. S BACKGROUND: The Department of Public Works has polled the property owners affected by the proposed improvements, and has determined that confirmation of the district is now in order. Utilizing postcards supplied by the Department, only 80 out of a total of 420 property owners have responded to date. 56 owners favor the project and only 24 oppose. Based on this response the Department recommends confirmation of Manor Highway Improvemen.t- Phase IV. Manor Highway Improvement -Phase IV H-4519 was ordered by the City Commission on June 12, 1986. It is now in order to confirm the ordering resolution and to authorize advertising for bids. A public hearing will be held by the City Commission on November 13, 1986. At that time the Commission will hear objections to the confirmation of Ordering Resolution No. 86-430. This will be the third public hearing for this project. The previous two public hearings were held on July loth and September lath. At the September 11th public hearing; the Commission directed the Department to hold another evening neighborhood meeting to explain the proposed Manor Highway Improvement -Phase IV to the affected property owners. I Honorable Mayor a Members of the City Commission Four hundred and twenty property owners were invited to this meeting, but only 9 property owners attended the meeting. The meeting began at 7.15 p,m. and concluded at approximately 8:15 p.m. A presentation on the proposed street improvements was made by City staff. A question and answer session followed the presentation. Several property owners who are retired indicated that they were in favor of the street improvements, but could not afford the assessment. At least one of these property owners attended the September 11, 1986 City Commission meeting and spoke against the project. He stated that he would also speak against the project at the November 13, 1986 Commission meeting. Four property owners indicated on the attendance form that they were opposed to the project, two indicated they needed additional information and three did not comment. The condition of the street right of way in this area has deteriorated. The pavement is narrow, in poor condition, off center and/or out of grade; side parkways are in poor condition; and drainage problems exist. All of these problems 'will be corrected on the streets within MANOR HIGHWAY IMPROVEMENT -PHASE IV H-4519. The proposed construction will include asphaltic pavement, concrete sidewalk, concrete curbs and/or gutters, storm drainage facilities and landscaping. The construction of this improvement will be funded by General Obligation Bond Funds. The estimated total cost of this project is $2,700,000.
