''DINt-41ER KEY MARINA RENOV AT I0N/FXrhI-IS 1014" t N THE AMOUNT OF $1,146,865.65 TO COVER THE CONTRACT COST; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM. WHEREAS, sealed bids were received October 23, 1986, for Dinner Key Marina - Paving & L.andside Utilities; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that the bid received from P.N.M. Corporation, be accepted as the lowest responsible and responsive bid; and WHEREAS, the Capital Improvements Ordinance No. 9939, was adopted on December 10, 1984, and monies are available for the proposed amount of the contract, project expense, and Incidentals from the account entitled "Dinner Key Marina Renovation/Expansion", as set forth In Section 3.Marinas.B.5 of said ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The October 23, 1986, bid of P.N.M. Corporation In the proposed amount of $1,146,865.66, for the project entitled Dinner Key Marina - Paving & Landside Utilities, for the alternate base bid of the proposal, based on unit prices, Is hereby accepted at the price stated therein. Section 2. The amount of $1,146,865.65 Is hereby allocated from the account entitled "Dinner Key Marina Renovation/Expansion" to cover the cost of said contract. This office represents S. I. Nicholas, Inc., one of the bidders in the above -referenced project. Our client has asked us to respond on its behalf to your letter dated October 24, 1986, a copy of which is enclosed herewith for your convenience. This letter shall constitute a formal protest of your apparent decision to reject the bid of S.I. Nicholas, Inc. as nonresponsive. S.I. Nicholas, Inc. is a state -certified general contractor which entitles it to contract in any jurisdiction in the state without being required to fulfill the competency requirements of that jurisdiction, pursuant to §489.105(7), Florida Statutes. In any event, it is apparent on the face of the bid submitted by S.I. Nicholas, Inc. that all of the specialty work for which a local license might be required would be performed by County -certified sub -contractors. We also call to your attention the fact that, based upon the reasons given for rejecting the bid of S.I. To reach this conclusion we have consulted the Florida State Statutes, Ch. 489.103(1) and Ch. 489.117(2), the Code of Metropolitan Dade County, Ch. 10-3(a), (b), and the Office of the City Attorney. According to the bid specifications, "Instructions to Bidders°, your firm did not hold a valid Certificate of Competency issued by the appropriate examinig board of Metropolitan Dade County prior to the submission of the bid.
