NUDITY, SEXUAL ACTS, OR PROFANITY, WAS
APPROVED BY THE ELECTORATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI#
FLORIDA:
Section 1. The City Commission hereby officially accepts
the attached City Clerk's Certification and Declaration of the
results of the Special Municipal Election held on
November 4, 1986 in which Charter Amendment No. 1 appearing on
the ballot as follows:
"Shall Charter Amendment No. 1 be adopted to
require approval of a majority of votes cast
by the electorate at a referendum before the
sale or lease of City land at less than fair
market value unless the City has received
three written proposals for such sale or
lease after a newspaper advertisement
soliciting proposals has been published
allowing not less than 90 days for the City's
reoeipt of proposals?"
was approved by the electorate.
Section 2. The City Commission hereby officially accepts
the attached City Clerk's Certification and Declaration of the
results of the Special Municipal Election held on

results of the Special Municipal Election held on
November 4, 1986 in which the Straw Ballot Question appearing on
the ballot as follows:
"Is it offensive, annoying and obscene to you
as a citizen of the City of Miami, Florida,
for a movie, television program, video
recording or printed material to defame, mook
or degrade basic religious beliefs by use of
nudity, sexual acts or profanity as the term
profanity is defined by Florida Law?"
was approved by the electorate.

I. I. NATTY BIRAI, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps were taken in
connection with the conduct of a City of Miami Special Election
held on November 4, 1986 including the following Logic and
Accuracy Tests:
On October 31, 1986 commencing at approximately 9:00 A.M. the
Dade County Canvassing Board had the automatic tabulating
equipment based at the Elections Department and O.C.S.I.S.
offices, at the Metro -Dade Center, tested to ascertain that the
equipment would correctly count the precinct and absentee ballot
votes cast for the measures.
On November 4, 1986, commencing at approximately 5:00 P.M. the
automatic tabulating equipment based at the Elections Department
and O.C.S.I.S. offices at the Metro -Dade Center was once again
tested to ascertain that the equipment would correctly count the
precinct votes cast for the treasures.
At the completion of the precinct ballot count, the automatic
tabulating equipment was again tested to ascertain that the
equipment correctly counted the precinct votes cast for the
measures.
On November S, 1986, commencing at approximately 9:00 A.M., the
automatic tabulating equipment based at the Elections Department
and O.C.S.I.S. offices, at the Metro -Dade Center, was tested to
ascertain that the equipment would correctly count the absentee
ballot votes cast for the measures.
At the completion of the absentee ballot count, the automatic
tabulating equipment was again tested to ascertain that the
equipment correctly counted the absentee ballot votes cast for
the measures.
I do hereby further certify that all documents concerning
these Logic and Accuracy Tests showed the computer to be
functioning correctly and are in the possession of the Supervisor
of Elections of Metropolitan Dade County, under sealed vault.
I further certify and declare that the results of the
Special Election which was held on November 4, 1986 are as

We, the undersigned County Court Judpe, Member of the Board
of County Com*nlssloners, and Supervisor of Elections,
constitutlnpr the Board of County Canvassers appointed to act
during this election, do by our signatures hereto certify that too
the best of our knowledge:
1. On October 31, 1986, commencing at approximately 9:00 a.m.,
the Dade County Canvassing Board had the automatic tabulating
equipment based at the Elections Department and O.C.S.i.S.
offices at the Metro -Dade C6nter tested to ascertain that the
equipment will correctly count the precinct and absentee
ballot votes cast for the candidates and measures.
2. The undersigned compared the test results with the
predetermined totals for each candidate and measure and
pursuant to the requirements .estabished In Section 101.5612,
Florida Statutes, observed the performance of all required
tests and verified the correctness of the program, precinct
headers and the test ballots, as well as any replacement of
said materials required by said tests, subjected to said
tests.
3. At the completion of the above test, the verified logic and
accuracy report (4), the progrartl listing (•,), BM log (•J),
consol log (1), JCL report (J), BMX tapes ( ), program
tape (7) and test ballots with precinct header cards (1),
were placed In the custody of the Supervisor of Elections

Board appointed to act durinp this election, do by our signatures
hereto further certify that to the best of our knowledge:
,. On November 4, 1986, commencinp at approximately 5:00 p.m.,
the automatic tabulating equipment based at the Elections
• Department and o.C.S.I.S. offices at the Metro -Dade Center
was once again tested to ascertain that the equipment will,
correctly count the precinct votes cast for the candidates
and measures.

testing materials, wore broken in our presence and the
contents were used following the procedures of paragraph (2),
to complete this pro -count logic and accuracy test.
5. At the completion of the above test, all ballots cast at the
polls were counted. Except as otherwise specifically set
forth and declared In this Certification, In our individual
presences and sight, no ballot card was removed from or added
to any ballot card container, ballot card tray or other
segregation of ballots, and no ballot card was In any manner
altered or tampered with by any person, and no person touched
any ballot card container, ballot card tray or ballot card,
except a person authorized to do so pursuant to Section
101.5614, Florida Statutes.
8. At the completion of the precinct ballot count, the automatic
tabulating equipment was again tested to ascertain that the
equipment correctly counted the precinct votes cast for all
candidates and measures.

count the absentee ballot votes cast for the candidates and
measures.
