PURCHASE ORDER FOR THIS SERVICE.
WHEREAS, pursuant to public notice, sealed bids were
received July 21, 1986 for the furnishing of meals to
participants in the City's Day Care and Preschool Programs to the
Department of Parks, Recreation and Public Facilities; and
WHEREAS, invitations were mailed to twenty one (21)
potential suppliers and two (2) bids were received; and
WHEREAS, funds for this purchase are available in the
United States Department of Agriculture Grant through the Florida
State Department of Education; and
WHEREAS, this service will be used by the Department of
Parks, Recreation and Public Facilities for the purpose of
supplying meals to participants in the City's Dade Care and
Preschool Programs; and
WHEREAS, the City Manager and the Director of the
Department of Parks, Recreation and Public Facilities recommend
that the bid received from Greater Miami Caterers, Inc. be
accepted as the lowest responsible and responsive bid;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The July 21, 1986 bid of Greater Miami
Caterers for furnishing meals to participants in the City's Day
Care and Preschool Programs on a contract basis for one (1) year
to the Department of Parks, Recreation and Public Facilities at a
total proposed cost of $81,691.21 is hereby accepted with funds
therefor hereby allocated from the 1986-87 Operating Budget.

contract basis to the Department of Public Facilities.
Ordinance No. 10062 established a goal of Awarding 51% of the
City's dollar volume of all expenditures for All Goods and
Services to Black, Hispanic and Women Minority Business
Enterprises on an equal basis.
Minority Vendors who are interested in submitting bids and who
-=son are not registered with the City as minority vendors are advised
to contact the City Procurement Nanagement Office, 1390 N.W. 20th
Street, Second Floor, Telephone 579-6380.
Detailed specifications for the bids are available upon request
at the City Procurement Management office.
The City Manager may reject all bids and readvertise.

The award of bid for meals for the Day Care Program was withdrawn
from the October 7, 1986 City Commission agenda. Subsequent to
that withdrawal the City Administration reviewed Dietcraft,
Inc.'s objections to the bid award. During this process
Oietcraft was given an opportunity to review all City records
that were utilized in the development of staff recommendations.
Dietcraft has objected to the City Administration's
recommendation on the following grounds:
(1) The temperature standards set for the delivery of
meals (40-45 degrees fahrenheit) are guidelines
and not requirements.
Comment: The City of Miami is under contractual
obligation to the State of Florida Department of
Education for the Day Care Lunch Program. That
contractual obligation specifies temperature
requirements and requires that the vendor deliver
meals in a refrigerated truck. That contractual
requirement is incorporated in thelCity's contract
with Day Care food vendors.
At the request of Dietcraft, Inc. the City
contacted Walter Livingston, local Director of
Environmental Health for the State of Florida.
During that conversation he indicated that the
establishment criteria of 40-45 degrees as
required by the Department of Education was
acceptable. He further stated that meals can be
delivered below that temperature but not above 45
degrees. Subsequent review of Dietcraft's
performance with the City found 3229 meals were
delivered above 50 degrees.
(2) Allegation about the presence of rat feces in a
sandwich.

Comment:. Dietcraft acknowledged that rat feces
was present in the sandwich and suggests that they
buy the sandwiches from another vendor and cannot
be held responsible.

(3) Delivery of hi fasts. Dietcraft suggests that
during FYP4-85 delivery of breakfast foods to Day
Care Centers was accomplished the day before
consumption except Monday.
Comment: The practice of delivering meals a day
ahead of time ceased prior to FY84-85 contract and
all meals are delivered on the day of consumption.
(4) Dietcraft suggests that complaints of contract
deviation were not brought to their attention.
Comment: Routine City practice provides for
deviations to be noted on each delivery invoice by
each Day Care Center. This is accomplished in a
duplicate manner as the yellow delivery invoice is
retained by the Dietcraft driver. Instances where
the discrepancies do not appear on the vendor's
copy are a result of the driver leaving prior to
�..� those notations being made.
(5) Dietcraft suggests that in instances where a
delivery was made in a private vehicle rather than
refrigerated trucks was a one time occurrence
where the truck broke down.
Comment: That explanation is accepted by the City
Administration. Our concern is primarily with the
temperature. of the food delivered to the site and
not with the need to use unrefrigerated delivery
vehicles on an emergency basis.
Summary: The City Admihistration's recommendation remains
constant. We have given every consideration to Dietcraft, Inc.
to rebut the findings of staff. Additionally, we have received
communication from the Department of Education State of Florida
recommending rejection of the low bid, "reject the low bid based
on poor performance by the vendor an.d to approve the next to low
bid", a copy of which is attached.
The City Manager recommends the contract for meals for the Day
Care Program be awarded to Greater Miami Caterers, Inc.

Food Service Contract 1986-87
Dear Mr. Odio:
This letter is to approve the extension of the 1983-86 food service contract through
October 31, 1996, to allow for the awarding of a new food service contract for
1986-87. A new food service contract, approved by our office, must be in place
before the new 1986-87 Agreement can be processed. Failure to approve a food
service contract immediately could jeopardize the reimbursements for your
sponsoring organization effective October 1, 1986. The total reimbursements for
last year were approximately $42,500.
This will also confirm our recommendation to reject the low bid basedon poor
performance by the vendor and to approve the next .to low bid. It is the
responsibility of the sponsoring organization to admnisister the Child Care Food
Program in accordance with the federal regulations. Federal regulations
226.6(cX7); 226.21, Food Service Management Companies; and 226.22, Procurement
Standards outline these responsibilities. Please let me her from you as soon as the
award for the 1986-87 Food Service Contract is recommended. Approval by this
office is necessary before acceptance.

The United States Department of Agriculture provides -funds to the
Florida Department of Education for contracting with local public and
private aqancies to provide meals and or snacks to children partici-
pating in day care programs .
Greater ;iiarii Caterers is the current Food vendor for `55-086 Fiscal
Year. Satisfactory service has been provided by this firm, with no
substitutions or deviations from the contract or specifications dur-
ing the entire contract year.
The bid from Greater Miami Caterers Incorporated for $81,691.20 pro-
vides for the purchase of Lunch, and all non 'food expendable items
such as plastic forks, spoons, napkins, cups, plates, garbage bags,
to the used in serving meals .
We anticipate having at least 255 children participate each day, in
the program.
in addition bids were sent to nine (a) Hispanic, seven (7) Black and
AO six (6) Non -minority Firms. Two Hispanic firm: responded, with Diet -
craft Incorporated submitting the lowest bid.
It is the recommendation of the Deportment of Parks, Recreation and
Public Facilities that the bid . from Dietcraft, Inc., be rejected for
failure to perform in accordance with the terms and .conditions of
previous contracts; failing to maintain delivery time limits provided
in the contract during their last service period, Fiscal year '84-
085, and because of their performance during the 19BG summer lunch
program. (Documentation is attached)
Therefore, we recommend that the •bid from Greater Miami Caterers be
accepted.

We are continuing to receive numerous�cornplaints from
Metro -Dade and the City of Miami about.your performance
as vendor for the Sumter Food Service Program in Dade
County.
The majority of the problems seem to be -centered around
the timing of the truck deliveries to each of the sites..
Also, there have been reports of no deliveries to some
-sites and/or deliveries made too late in the day for ser
vice. Some sites have been forced to purchase lunches on
the outside so that their children could have something to
eat. You will, of course, be billed for.these outside
;purchased lunches by the sponsor.
!After the first week "of the program, we expect the delivery
'schedules to become routine. Daily.deliveries to sites
'should not,vary more than.15 to 20 minutes each day.
You gave me a truck delivery schedule during my last trip.;
.,.to Miami (July 8 - 11, 1986) and assured me that you had
8 trucks -and 8 truck routes operating and your list indicated
the time of deliveries to each site. Is this schedule -still
-accurate? It is absolutely crucial to the success of the
Dade Summer Program that your deliveries of meals be made
'at the specified and agreed upon times.
I would recommend that you take immediate steps to assign
additional supervision over your truck drivers (supervisors
should possibly accompany the drivers on their runs) to insure
that your times are adhered to and that you are receiving
t accurate feed back from your drivers.
Deviation from your contractual obligations with the spon
sors involved can result in your not being registered to

it' has been brought to the attention the lack of sandwich variety
being serve to all parks this year.
Most sandwiches are bologna and similar process meat and cheese•
with the type bread only changing from. day to day_
Children are getting repugnant of the sam�•or similar meat served
each and every day. A menu has not been issued like previous'
years to facilitate the expected menu of the day and to keep track

1. The letter from the food programs office of the Florida
Department of Education to the City of Miami recommended
disqualification of Dietcraft based on alleged "past
poor performance" has been rescinded. The Commissioner
of Education has informed City Manager Caesar Odio
that the City is not precluded from making an award
to Dietcraft and that funding would not be withheld
if the City were to award the contract to Dietcraft.
2. A distinguished expert has opined that approximately
two-thirds of the alleged violations cited by parks
and recreation employees as evidence of "poor
performance" are totally and completely unfounded.
The affidavit of Dr. Lendal Kotschevar is attached.
He states that more often than not the allegations
made by City officials were evidence of good performance,
not evidence of poor performance.
3. Dietcraft has obtained evidence that its competitor
for this contract is not a minority -owned company as
had been indicated to the City. The Articles of
Incorporation certified by the Florida Department
of State, and a letter from Metropolitan Dade County's
Minority Procurement Director indicate that the
competitor misled the City about its minority status.
4. The complaints against Dietcraft were unfairly
exaggerated: "Complaints" against the 1984 Summer
Program Vendor in two days were double the number of
high temperature "complaints" against Dietcraft for
the entire 8-week 1986 summer program.
5. Dietcraft has initiated proceedings in Tallahassee
to invalidate the unauthorized and unfair
disqualification policies of the food service office.
Dietcraft has initiated proceedings before an
Administrative Hearing Officer and has petitioned for
the adoption of administrative rules to assure that
the food service office will not in the future take
arbitrary and capricious action with respect the funding
of food service contracts.
6. Dietcraft has presented to the City letters of
recommendation from many of its customers confirming
- that Dietcraft has provided outstanding and conscientious
service for many years through and including 1986.

BEFORE ME, the undersigned authority, personally
appeared Dr. Lendal Kotschevar who, upon being duly sworn,
deposes and says:
1. fly name is Dr. Lendal Kotschevar. I hold
a Ph.D degree from Columbia University and four other
university degrees, two bachelors and two masters, from
another university. I have published 13 textbooks and dozens
of scholarly articles related to food production and
preparation. Two of my textbooks are used around the world
in industry and academe.e--
2. I have served as a consultant to many of
America's largest companies in the hospitality industry,
including Pillsbury, General Mills, General Foods, and
Standard Brands. At one time, I served as a consultant
to the United Nations and, by personal invitation, to Pope
Paul in connection with the Pope's address to the Congress
on Hunger held in Rome in the late 19601s.
3•. Prior to making this affidavit, I examined
invoices reflecting the temperatures at which Dietcraft,
Inc. delivered juices, milk, and sandwiches to parks and
recreation sites in the City of Miami in connection with
a 1986 summer lunch program. I also reviewed a listing
of the instances in which employees of the Parks and
Recreation Department, City of Miami, cited Dietcraft for

having delivered juices, milk and sandwiches at temperatures
designated as "too low" by such employees,
4. I have reached an opinion as to whether or
not the food and beverage temperatures which were cited
on the attached list as having been "too low" were, in fact,
outside: the bounds of generally accepted standards for the
delivery of foods and beverages under similar circumstances.
5. 1 have determined that the 122 deliveries
cited as having been "too Tow" were well within the generally
accepted standards. Sandwiches for delivery and service
in large volume are routinely and appropriately frozen during
storager shipments, and upon delivery. The beverage
temperatures cited, however, those that are near or below
32° are not necessarily indicative that the milk and juices
were frozen. Such matters freeze at temperatures that may
be lower than 32°, the point at which standing water may
freeze under certain atmospheric conditions.
6. The temperatures of the foods and beverages
listed in the attachment to this affidavit are indicative
of the retention of wholesomeness. The applicable federal
standard is wholesomeness, i.e. "fit for human consumption."
7. I have reviewed invoice number 22403 related
to the delivery by Dietcraft, .Inc. delivery on July 10, 1986
at 10:30 a.m. of sandwiches and beverages to Curtis Park.
It is noted in the September 30, 1986 staff recommendation
to the City Commission that the sandwiches were "rotten."
Based upon my experience in the food service industry and
as a scholar, I can affirmatively assert that there are
a variety of reasons that might cause the discoloration
of foods, even the appearance of spotting or green coloration
that are not indicative of "rotten" food. The phenomenon
of iridescence on meat may be caused by the presence of
riboflavin or other substances that do not indicate ••
rottenness.

the effect that there was a green tinge on the sandwich
but than there was no odor, the explanation for the appearance.
of green matter on the sandwich in question is consistent
with phenomena which are not indicative of rottenness,
9. The opinions of parks and recreation employees
regarding the alleged impropriety of the "low temperatures"
are not based on scientific evidence or principles. Their
inference that meat coloration necessarily indicated
unwholesomeness also is scientifically unsubstantiated.
10. The examples cited by City parks and recreation
employees more often than not indicate good performance,
not poor performance.

The number of complaints against Dietcraft have
been unfairly exaggerated. The parks and recreation staff
reported, for example, 3,229 high temperature "complaints"
against Dietcraft during the Summer 1986 Lunch Program.
They did not mention how this number was derived: multiplying
the number of alleged high temperature deliveries (31) times
the number of meals. Hence, the number of "complaints" was
exaggerated by over 100 times.
when these "complaints" are put into numerical
perspective, the unfairness of staff's presentation becomes
more evident. The contract for the 1986 summer lunch program
called for the delivery of 525,000 lunches and 125,000 snacks,
consequently the number of high temperature "complaints"
was less than 1/2$ of the total of 650#000 deliveries.
To put matters into even better perspective,
in only two days, during the 1984 summer lunch program,
there were 6,745 "complaints" (involving unacceptable beverage
substitutions), double the number of high temperature
complaints made by Dietcraft during the entire 8-week 1986
Summer Lunch Program. The attached memoranda, obtained
pursuant to the Florida Public Records Act, pertain to the
1984 program.

Mercy, Herman and Millie were notified and informed that they were
out of compliance with Menu Requirements which clearly specified
chocolate milk everyday. Marion Henry of Food and Nutrition Service
- was also notified.
In addition, North Glades Park had 70 spoiled sandwiches (off a
color and foul smelling). Florida Memorial had 19. Monitor Joy
_- Hepburn brought these back to the office for evidence. I offered
to take them back to Construction for proof. Herman said there
was no need and that we will be credited.

DEPARTMENT OF EDUCATION,
DIVISION OF PUBLIC SCHOOLS,
Respondent.
Pursuant to Section 120.56, Florida Statutes,
Dietcraft, Inc., petitions to determine the invalidity of
unpromulgated rules of the Department of Education, Division of -
Public Schools and states:
1. Petitioner, Dietcraft, Inc. ( Dietcraft") is a
food processor and caterer which has provided service to schools,
day care centers, and summer nutrition programs for over a —
decade in South Florida. In the summer of 1986, Dietcraft
served over 400,000 lunches during an eight -week period as part
of a federally funded program administered by the Florida
Department of Education, Division of Public Schools, Child Care
and Summer Food Programs Office ("Food Programs Office").
2. The Food Programs Office has unwritten policies
regarding the eligibility, selection, certification, and
decertification of companies that seek to provide food service
on behalf of municipalities, counties and private organizations
that receive federal funds through the Food Programs Office.
Its employees insinuate themselves into local governmental
contract award processes, give directives regarding the
eligibility and ranking of competing companies, make findings
regarding the computation of bids, and make unilateral
declarations regarding the fitness of companies to perform.
They take all of these actions without any rules duly '
promulgated pursuant to the Florida Administrative Procedure Act j
and without affording companies due process of law.
3. The operational methods of the Food Programs
Office threaten the integrity of local governmental competitive
bidding processes because the Office neither articulates nor
adheres to any well defined, published, or coherent standards
for its assessment of the qualifications or responsiveness of
companies that bid on food service contracts funded through the
Office. Rather, the Office gives precipitous and unilateral
directives regarding the qualifications and responsiveness of
competing vendors after the opening of bids. Such methods
militate strongly against the aims of competing bidding.
4. Two recently rendered edicts of the Food Programs
Office manifest the existence of unwritten policies having the
effect of law and the application of those policies to the
detriment of Dietcraft. On October 14, 1986, three months after
the opening of bids and on the eve of the meeting wherein the
City of Miami was to consider whether to award to the low
bidder, Dietcraft, the Food Program Office declared that
Dietcraft should be ineligible to receive the contract.
5. Even though Dietcraft submitted the low bid in
connection with the City of Miami's food service contract Number
576, the Food Programs Office declared that the contract should
be awarded to the only other bidder based on alleged past "poor
performance" by Dietcraft. The Food Program Office reinforced
its declaration by cautioning the City of Miami that the Office
retained ultimate authority to approve or disapprove the
contract for funding. A copy of the October 14, 1986 letter
from the Food Programs Office to the City of Miami is attached
hereto as Exhibit "A".
6. The October 14, 1986 letter reflects the existence
of an unwritten, unarticulated policy purporting to establish a
standard for the assessment of the adequacy of past performance
by vendors. The letter also shows that the Office has applied
that policy to Dietcraft with the effect of inducing, if not
compelling, the City of Miami to reject Dietcraft's low bid.

7. The public statements by the director of the Food
Programe Office confirm that the office has unwritten policies.
The November 1, 1986 edition of The Miami Herald published
statements by two senior officials of the Food Program Office
regarding the application of these unwritten policies to
Dietcraft. The article stated that "John Decker, state
coordinator of the summer food program, said Dietcraft's
performance this summer was the third worst in the eight years
he has run the program." The article also stated that, "Elsie
Miller, director of the state's Child Care and Summer Food
Programs, said earlier this week that the state would not extend
the Friday deadline". In the article, Ms. Miller emphasized her
willingness to enforce the policy declarat:=ns of the Food
Programs office by warning the City of Miar,� that failure to
award the contract to Dietcraft's competitor places the City of
Miami officials, "in jeopardy of loosing their funding." A copy
of the newspaper article containing these statements attached as
Exhibit "B."
S. Just as the Food Programs Office intervened at the
eleventh hour in a City of Miami contract award decision, it
also intervened to declare that a contract under consideration
by Metropolitan Dade
County should
not go to Dietcraft.
The
office did so without
showing how
it calculated the total
bid
and without providing any warning or explanation to Dietcraft.
The Office intervened after the Dade County Commission had voted
to award the contract to Dietcraft. Copies of the letters from
the Food Program Office to Metropolitan Dade County are attached
as Composite Exhibit "C". A copy of Dade County's notice that
it rescinded the contract award based on the directive from the
Food Programs Office is attached as Exhibit "D".
9. The foregoing declarations of the Food Programs
Office, including the edict about ineligibilty of Dietcraft,
"based on poor performance," constitute "rules" within the
meaning of Section 120.52(14), Florida Statutes and judicial
decisions which interpret that section. EEQ., Department of
Administration v. Harvey, 356 So.2d 323, 325 (Fla. ist DCA 1977)
wherein the following is stated:
The breadth of the definition in Section
120.52(14) indicates that the legislature
intended the term to cover a great variety of
agency statements regardless of how the agency
designates thee. Any agency statement is a
rule if it "purports in and of itself to
create certain rights and adversely affect
others" ... or serves "by (its) own effect to
create rights, or to require compliance, or
otherwise to have the direct and consistent
effect of law." Citin McDonald v. Department
of Banking and Finance, 346 So.2d 569, 581
(Fla. 1st DCA 1977); Strauqhn v. O'Riordan,
338 So.2d 832 (Fla.1976); and Price wise
Buying Group v. Nuzum, 343 So.2d 115 (Fla.
1st DCA 1977).
The unwritten declarations of the programs :`rice fall squarely
within this definition of "rules",
10. In total disregard of the Administrative Procedure
Act and wholly uninhibited by any principles of due process or
fairness, the Food Programs Office has disrupted the competitive
bidding process, declared Dietcraft ineligible, and damaged the
reputation of a company that has been in business for over a
decade. The existence of federal regulations related to the
Office's programs does not relieve the office of the duty to
apply those federal regulations in accordance with Florida law.
See e.q., 7 C.F.R. 226.21(a). Officials of the Food Programs
Office have presumed to investigate, indict, convict, sentence,
and condemn a reputable family -owned company.
11. The declarations of the Food Programs Office have
not been adopted as rules pursuant to the Administrative
Procedure Act and are, therefore, void and unenforceable.
WHEREFORE, the petitioner respectfully requests that
the Director of the Division of Administrative Hearings enter a
finding that this petition complies with the requirements of
Section 120.56, Florida Statutes. The petitioner requests that
the Director assign a hearing officer to conduct a formal

hearing on an expedited basis and futher requests that a final
order be entered determining that said males are invalid.

This letter is to approve the extension of the 1983-36 food service contract through
October 31, 1986, to allow for the awarding of a new food service contract for
198647. A new food service contract, approved by our office, must be in place
before the new 1986-87 Agreement can be processed. Failure to approve a food
service contract immediately could jeopardize the reimbursements for your

Dear Mr. Pittaluga:
On September 17, 1986 gay office advised you that your Proposal was awarded a
Contract under Bid N 688-9/30/87 for Food Catering Service based on actions
taken by Metropolitan Dade County's Board of County Commissioners on
September 16, 1986.
Subsequent to those two dates, the State of Florida Department of Education,
which provides reimbursement to Dade County's Community Action Agency for
the Food Catering Service, notified the County Manager's Office that the
Award of the Bid "shall be made to the low Bidder" (see the attached letter
of September 18, 1986). This notification was forwarded to the Board of
County Commissioners for their information.
Based on the notification from The Florida Department of Education, the
Board of County Commissioners, at a duly authorized meeting conducted on

petitions for an administrative hearing to determine that the
Department of Education has taken final agency action that
detrimentally affects the substantial interests of Dietcraft,
Inc. as set forth below;
1. Petitioner, Dietcraft, Inc. ("Dietcraft") is a
food processor and caterer which has provided service to schools,
day care centers, and summer nutrition programs for over a
decade in South Florida. In the summer of 1486, Dietcraft
served over 400,000 lunches during an eight -week period as part
of a federally funded program administered by the Florida
Department of Education, Division of Public Schools, Child Care
and Summer Food Programs Office ("Food Programs Office"). -
2. The Food Programs Office has unwritten policies
regarding the eligibility, selection, certification, and
decertification of companies that seek to provide food service
on behalf of municipalities, counties and private organizations
that receive federal funds through the Food Programs Office.
Its employees insinuate themselves into local governmental
contract award processes, give directives regarding the
eligibility and ranking of competing companies, make findings
regarding the computation of bids, and make unilateral
declarations regarding the fitness of companies to perform.
They take all of these actions without any rules duly
promulgated pursuant to the Florida Administrative Procedure Act
and without affording companies due process of law.

3. The operational methods of the Food Programs
Office threaten the integrity of local governmental competitive
bidding processes because the Office neither articulates nor -
adheres to anywell-defined, published, or coherent standards
for its assessment of the qualifications or responsiveness of
companies that bid on food service contracts funded through the
Office. }Lather, the Office gives precipitous and unilateral
directives regarding the qualifications and responsiveness of
competing vendors after the opening of bids. Such methods
militate strongly against the aims of competing bidding.
4. Two recently rendered edicts of the Food Programs
Office manifest the existence of unwritten policies having the
effect of law and the application of those policies to the
detriment of Dietcraft. On October 14, 1986, three months after
the opening of bids and on the eve of the meeting wherein the
City of Miami was to consider whether to award to the low
bidder, Dietcraft, the Food Program Office declared that -
Dietcraft should be ineligible to receive the contract. 1
S. Even though Dietcraft submitted the low bid in
connection with the City of Miami's food service contract Number
576, the Food Programs Office declared that the contract should
be awarded to the only other bidder based on alleged past "poor
performance" by Dietcraft. The Food Program Office reinforced
its declaration by cautioning the City of Miami that the Office
retained ultimate authority to approve or disapprove the
contract for funding. A copy of the October 14, 1986 letter
from the Food Programs Office to the City of Miami is attached
hereto as Exhibit "A".
6. The October 14, 1986 letter reflects the existence
of an unwritten, unarticulated policy purporting to establish a
standard for the assessment of the adequacy of past performance
by vendors. The letter also shows that the Office has applied
that policy to Dietcraft with the effect of inducing, if not
compelling, the City of Miami to reject Dietcraft's low bid.

7. The public statements by the director of the Food
Programs Office confirm that the office has unwritten policies.
The November 1, 39A6 edition of The Miami Herald published
statements by two senior officials of the Food Program office
regarding the application of these unwritten policies to
Dietcraft. The article stated that "Jahn Decker, state
coordinator of the summer food program, said Dietcraft's
performance this summer was the third worst in the eight years
he has run the program." The article also stated that, "Elsie
Miller, director of the state's Child Care and Summer Food
Programs, said earlier this week that the state would not extend
the Friday deadline". In the article, Ms. Miller emphasized her
willingness to enforce the policy declarations of the Food
Programs Office by warning the City of Miami that failure to
award the contract to Dietcraft's competitor places the City of
Miami officials, "in jeopardy of loosing their funding." A copy
of the newspaper article containing these statements attached as
Exhibit "B."
S. Just as the Food Programs Office intervened at the
eleventh hour in a City of Miami contract award decision, it
also intervened to declare that a contract under consideration
by Metropolitan Dade County should not go to Dietcraft. The
Office did so without showing how it calculated the total bid
and without providing any warning or explanation to Dietcraft.
The Office intervened after the DAe County Commission had voted
to award the contract to Dietcraft. Copies of the letters from
the Food Program Office to Metropolitan Dade County are attached
as Composite Exhibit "C". A copy of Dade County's notice that
it rescinded the contract award based on the directive from the
Food Program Office is attached as Exhibit "D".
9. The foregoing declarations of the Food Programs
Office, including the edict about ineligibilty of Dietcraft,
"based on poor performance," constitute "rules" within the

decisions which interpret that section. E.g., Department of
Administration v. Eiarve, 356 S0.2d 323, 325 (Fla. ist DCA 1977)
wherein the following is stated:
The breadth of the definition in Section
120.52(14) indicates that the legislature
intended the term to cover a great variety of
agency statements regardless of how the
agency designates them. Any agency statement
is a rule if it "purports in and of itself to
create certain rights and adversely affect
others" ... or serves "by [its] own effect to
create rights, or to require compI.iance, or
otherwise to have the direct and consistent
effect of law." Citin McDonald v. Department
of Banking and Finance, 346 So.2d 569, 581
(Fla. 1st DCA 1977); Strauqhn v. O'Riordan,
338 So.2d 832 (F1a.1976); and Price Wise
Buying Group v. Nuzum, 343 So.2d 115 (Fla.
1st DCA 1977).
The unwritten declarations of the programs office fall squarely
within this definition of "rules"
10. In total disregard of the Administrative Procedure
Act and wholly uninhibited by any principles of due process or
fairness, the Food Programs Office has disrupted the competitive
bidding process, declared Dietcraft ineligible, and damaged the
reputation of a company that has been in business for over a
decade. The existence of federal regulations related to the
Office's programs does not relieve the office of the duty to
apply those federal regulations in accordance with Florida law.
See e.g., 7 C.F.R. 226.21(a). Officials of the Food Program
Office have presumed to investigate, indict, convict, sentence,
and condemn a reputable family -owned company.
11. The declarations of the Food Programs Office have
not been adopted as rules pursuant to the Administrative
Procedure Act and are, therefore, void and unenforceable.
WHEREFORE, Dietcraft, Inc. Petitions the Department of
Education to transmit this Petition to the Division of
Administrative Hearing so that the Division may assign a hearing
officer to consider this Petition. Dietcraft further requests
that the hearing officer rule that the actions of the Department

Petitioner, Dietcraft, Inc., pursuant to Section
120.54(5), Florida Statutes formally petitions the Department of
Education, Division of Public Schools to adopt administrative
rules.
1. Petitioner has been a food service vendor on
behalf of schools, day care centers, and recreation programs in
South Florida for over a decade. Its offices are located at
8775 N.W. 13th Terrace, Miami, Florida 33172.
2. Petitioner has provided food service as part of
federally funded programs that are administered through the
Department of Education, Division of Public Schools, Child Care
and Summer Food Programs Office (the "Office"). The Office has
recently declared in an unpromulgated administrative rule that
Dietcraft should not receive a contract from the City of Miami
based on alleged "poor performance."
3. Dietcraft seeks to have the office establish rules
which govern the circumstances under which a vendor's
performance may render a vendor ineligible to participate.
Moreover, Dietcraft seeks to have the Office adopt rules
respecting certification, decertification, bid evaluation,
vendor assessment, and the range of other policies that the
Office has established wholly without any rules duly adopted
pursuant to the Florida Administrative Procedure Act.
4. The adoption of rules pertaining to such matters
would provide all competing vendors a fair chance to demonstrate
their qualifications and would assist the Office in making
determinations regarding vendors in a way that does not

Jeopardize the rights of vendors, sponsoring organizations, or
the the ultimate recipients of the services provided by vendors
such as Dietcraft.
5. Dietcraft has a particular interest in having

invalidate the existing unpromulgated rules. Accordingly,
Dietcraft requests that it be made a party to rule -making
proceedings so that it may exercise all rights made available to
parties pursuant to the Florida Administrative Procedure Act.
WHEREFORE, Petitioner respectfully requests that the
Department of Education, Division of Public Schools implement
this petition by immediately initiating rule -making proceedings.

1986 SUMMER RECREATION PROGRAM/CITY OF -LAKE WORTH.
During our recent Summer Program, our provider this
year was DIETCRAFT, INC.; a company we found to be
excellent as well as effective in every facet of meet-
ing and providing the needs of our area children.
The cooperation and courteous manner in which DIET -
CRAFT handled our Program is well worth the recommen-
dation I shall mention to our city officials for
possible use in the 1987 Program.

food and menues has been according to State Nutrition Department

Dietcraft, Inc. has served the City of Miami Springs
Nutrition Programs since 1976 through subcontracts awarded by
the City's competitive bid process and approved by the Area Agency
on Aging, the monitoring agency for distribution of Title III funds.
Over the past ten years, Dietcraft has complied with Federal,
State and local requirements governing the Elderly Nutrition
Program and has provided the City with daily catering service
for both Congregate and dome Delivered Meal Programs.
Currently, Dietcraft, Inc. serves approximately 110 meals
daily to participants of the Senior Center and is responsible
for the preparation, packaging, quality assurance, and delivery
of 40 meals per day to the homebound residents of the area.
Utilizing a four-cycle menu plan that has been approved by the
State of Florida's Dept. of Aging and Adult Services' Nutritionists
Dietcraft has continued to provide quality meals and service
to the elderly participants of our programs.
Dietcraft has been responsive to the daily changes made
in the food quantities ordered, to changes made in the delivery
addresses of our homebound clientele and in adjusting their
recipes to suit different ethnic groups.
In consideration of their overall past performance,
quality of product, and willingness to cooperate, we anticipate
inviting Dietcraft, Inc. to bid their services for future
program needs. If further verification of Dietcraft's ability
