HomeMy WebLinkAboutR-86-0896J-c86-c725 0 0, RESOLUTION NO. 86-896 A RESOLUTION RESCINDING RESOLUTION NO. 86-589, ADOPTED JLfLY 10.1986, WHICH AUTHORIZED THE CITY MANAGER TO EXECUTE A CONTRACT WITH OCEAN BAY CONSTRUCTION, INC., IN THE AN;OUNT OF $84,995.00 FOR FORT DALLAS PARK PLAl_A - PHASE I; REJECTING ALL BIDS RECEIVED JUNE 17, 1986 IN CONNECTION WITH SAID PROJECT; AND FURTHER AUTHORIZING THE CITY MANAGER TO READVERTISE FOR NEW BIDS. WHEREAS, sealed bids were received June 17, 1986, for FORT DALLAS PARK PLAZA - PHASE I; and WHEREAS, after determination of the low bidder, a contract was awarded to Ocean Bay Construction, Inc., in the amount of $84,955.00 for construction of said project, by Resolution No. 86-589, dated July 10, 1986; and WHEREAS, subsequent to the award of a contract, Ocean Bay Construction, Inc. has repeatedly indicated its inability to supply the insurance coverage necessary to successfully execute the contract documents in compliance with City requirements; and WHEREAS, the City has notified Ocean Bay Construction, Inc., that failure to execute the contract in the time allowed may result in the cancellation of the same; and WHEREAS, three (3) months have elapsed since the opening of the bids for this project, and all other bids received at that time cannot reasonably be considered still binding; CITY COMMISSION MEETING OF i NOV 13 1986 g RESOLUTION No. REMARKS: i 0 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. Resolution 86-589 adopted July 10, 1986, which authorized the City Manager to execute a contract with Ocean Bay Construction, Inc., in the proposed amount of $84,955.00 for FORT DALLAS PARK PLAZA - PHASE I, is hereby rescinded. Section 2. All bids submitted on June 17, 1986, in connection with the FORT DALLAS PARK PLAZA - PHASE I project are hereby rejected. Section 3. Odi o '/'U/�j�J' C i ty Manager ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution rescinding the resolution which awarded a contract to Ocean Bay Construction, Inc., for the project named Fort Dallas Park Plaza - Phase I; rejecting all bids submitted June 17, 1986 in connection with said project; and further • authorizing the City Manager to readvertise for new bids. BACKGROUND: The Department of Public Works has analyzed the need to rescind the contract which exists between the City of Miami and Ocean Bay Construction, Inc., for Fort Dallas Park Plaza. The proposed resolution rescinds said contract and permits the solicitation of new bids. Bids were received June 17, 1986 for Fort Dallas Park Plaza - Phase I. As reflected in the tabulation of bids, the $84,995.00 bid of Ocean Bay Construction, Inc., was the lowest responsible bid for the total bid of the proposal, and a contract was awarded to said firm on July 10, 1986. New Florida statutes regarding insurance coverage and premiums have made it extremely difficult for some contractors to obtain the necessary insurance, as required to adequately protect the City's interests. After several months of meetings with personnel from various City department directly involved in the processing of the contract to resolve problems, the contractor has notified the Department of Public Works that his firm cannot provide the necessary coverage for this project. In an effort to obtain more favorable bids, and after exhausting all alternatives to award a contract to a responsible and responsive bidder, it will be to the advantage of the City to rescind the prior resolution and readvertise the project.
