SANS R ASSOCIATES, INC., IN THE AMOUNT OF S` 3.380.00 FOR CITYWIDE SANITARY SEWER REPLACEMENT PROJECT - WYNDWOOD; REJECTING ALL BIDS RECEIVED JUNE 24, 1986 114 CONNECTION WITH SAID PROJECT; AND FURTHER AUTHORIZING THE CITY MANAGER TO READVERTISE FOR NEW BIDS. WHEREAS, sealed bids were received June 24. 1986. for CITYWIDE SANITARY SEWER REPLACEMENT PROJECT - WYNDWOOD; and WHEREAS, aster determination of the low bidder, a contract was awarded to E. Sans R Associates, Inc., it the amount of $43,380.00 for constritction of said project, by Resolution No. 86-533, dated July 10, 1986; and WHEREAS, subsequent to the award of a contract, E. Sans 6 Associates, Inc. has repeatedly indicated its inability to supply the insurance coverage necessary to successfully execute the contract documents in compliance with City requirement%; and WHEREAS, the City has notified E. Sans A Associates. Inc., that failure to execute the contract in the time allowed may Jesuit in the cancellation of the same; and IMEREAS, over sixty (60) days have elapsed since the opening of the bids for this project, and all other bids received at that time cannot reasonably be considered still binding; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: — Section 1. Resolution 86-533 adopted July 10, 1986, which authorized the City Manager to execute a contract with E. Sans & Associates, Inc., in the proposed amount of $43,380.00 for CITYWIDE SANITARY SEWER REPLACEMENT PROJECT - WYNDWOOD, is hereby rescinded. Section 2. All bids submitted on June 24, 1986, in connection with the CITYWIDE SANITARY SEWER REPLACEMENT PROJECT - WYNDWOOD project are hereby rejected. Section 3. The City Manager is hereby authorized to readvertise for new bids for the CITYWIDE SANITARY SEWER REPLACEMENT PROJECT - WYNDWOOD project. Odio City Manager ENCLOSURES: RECOMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution rescinding the resolution which awarded a contract to E. Sans & Associates, Inc., for the project named Citywide Sanitary Sewer Replacement Project - Wyndwood, rejecting all bids submitted June 24, 1986 in connection with said project; and further authorizing the City Manager to readvertise for new bids. BACKGROUND: The Department of Public Works has analyzed the need to rescind the contract which exists between the City of Miami and E. Sans b Associates, Inc., for Citywide Sanitary Sewer Replacement Project - Wyndwood. The proposed resolution rescinds said contract and permits the solicitation of new bids. Bids were received June 24, 1986 for Citywide Sanitary Sewer Replacement Project - Wyndwood. As stated in tabulation of bids, the $43,380.00 bid of E. Sans & Associates, Inc., was the lowest responsible bid for the total bid of the proposal, and a contract was awarded to said firm on July 10, 1986. New Florida statutes regarding insurance coverage and premiums have made it extremely difficult for some contractors to obtain the necessary insurance, as required to adequately protect the City's interests. After several months of meetings with personnel from various City department directly involved in the processing of the contract to resolve problems, the contractor has notified the Department of Public Works that his firm cannot provide the necessary coverage for this project. In an effort to obtain more favorable bids, and after exhausting all alternatives to award a contract to a responsible and responsive bidder, it will be to the advantage of the City to rescind the prior resolution and readvertise the project.
