HomeMy WebLinkAboutR-86-0887J-86-938 10/29/86 RESOLUTION NO. 86--881 A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE WITH THE PROPERTY OWNER FOR ACQUISITION OF REAL PROPERTY LOCATED AT 2610 N.W. 25TH AVENUE IN THE CITY OF MIAMI, LEGALLY DESCRIBED AS THE SOUTH 20 FEET OF LOT 2, AND NORTH 20 FEET OF LOT 3, BLOCK 2 OF GROVEL410, AS RECORDED IN PLAT BOOK 11 AT PAGE 54 OF DA DE COUNTY PUBLIC RECORDS; TO BE ITSED FOR THE DF:VELOPNENTT OF AFFORDABLE HOUSING FOR LOW AND MODERATE INCOME FAMILIES; FURTHER AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO PROCEED TO CLOSE ON THE, SAID PROPERTY AFTER EXAMINATION OF THE ABSTRACT AND CONFIRMATION OF OPINION OF TITLE, SAID ACQUISITION COSTS TO BE PROVIDED FROM THE GENERAL OBLIGATION HOUSING BOND FUND. WHEREAS, in November of 1983, the Melrose Nursery site was acquired for the development of housing affordable to low and moderate income families; and WHEREAS, Metropolitan Dade County serving as the City's acquisition agent did not acquire a single family dwelling located in the southeast corner of the site at 2610 N.W. 25th Avenue; and WHEREAS, the City of Miami is interested in acquiring the subject property which is not under public ownership;and WHEREAS, appraisals have been obtained and efforts to secure the property for valid public and municipal purposes through negotiations should be undertaken by the City; and WHEREAS, funds from the general obligation Housing Bond Fund are available for defraying cost of said acquisition; and WHEREAS, the City policy for negotiated purchase in lieu of condemnation and for observing Federal Uniform Relocation Standards will apply solely to the said property; NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: SECTION 1. The acquisition of the parcel of land located at 2610 N.W. 25th Avenue and which is particularly and legally described in the attached rxhShit A is hereby authorized for acquisition by way of negotigted purchase. Basis of Just Compensation: The City offer represents the full amount of just compensation for the property and all interest therein to be acquired. Thie offer represents the average of the appraised Fair Market Value of the subject property made by two (2) competent professional appraisers. The subject property has been inspected by the City and by the independent appraisers. FAIR MARKET VALUE IS DEFINED AS: The price estimated in terms of money: which a property would bring if exposed for sale in the market with a reasonable time allowed in which to find a purchaser buying with the knowledge of all the uses and purposes to which it is adopted and of which it is capable. Any decrease or increase in the Fair Market Value of real property to the date of valuation caused by the public improvement for which such property is acquired, or by the likelihood that the property would be acquired for such improvement, other than that due to physical deterioration within the reasonable control of the owner, has been disregarded in determining the compensation for the property by the City and its appraisers. The City of Miami's appraisal and determination of just compensation do not reflect any consideration of, or any allowance for, any relocation assistance and payments which the occupants, the owner or tenants, are entitled to receive under Title II of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970. 7. November 13, 1986 It is respectfully recommended that the City Commission adopt the attached resolution authorizing the acquisition of a single family dwelling located at 2610 N.W. 25th Avenue through a negotiated purchase for the purpose of developing affordable housing in the City of Miami. BACRGROU" : The Housing Conservation and Development Agency recommends the acquisition through negotiated purchase, of a single family dwelling Located at 2610 N.W. 25th Avenue. In November of 1983, the Melrose Nursery site was acquired for the development of housing affordable to low and moderate income families. It was later discovered that a single family dwelling located in the southeast corner of the Melrose Nursery property was not acquired by Metropolitan Dade HUD, which served as the City's acquisition agent. In an effort to acquire the last remaining property not under public ownership on the Melrose Nursery site, the City retained the services of two appraisers in order to determine the fair market value of the property. The appraisers retained by the City, Gene B. Gracer and Rennes Rolle -Dawson, determined the fair market value of the property to be $15,000 and $25,000, respectively. A purchase offer of $20,000 is recommended subject to City Commission approval. Funds are available from the general obligation Housing Bond Fund to cover the cost of acquiring the subject property.
