HomeMy WebLinkAboutR-86-0881J-86-930 10/30/86 RESOLUTION NO. 86-881 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE USE PERMIT, IN A FORM ACCEPTAPLE TO THE CITY ATTORNEY, WITH BARRY SHARPE, ALLOWING HIM TO REMAIN AS PROPERTY MANAGER AND CONTINUF TO COLLECT RENTALS FROM TENANTS ON PROPERTY PURCHASED FROM, HIM BY THE CITY OF MIAMI, AS LEGALLY DESCRIBED IN EXHIBIT A, FOR A PERIOD NOT TO EXCEED SIX (6) MONTHS, CONTINGENT UPON THE FOLLOWING CONDITIONS AS CONTAINED HEREIN. WHEREAS, the City has made an offer to purchase property located at 2262-66 West Flagler Street to be used in conjunction with the South District Police Substation; and WHEREAS, the owners, Barry Sharpe, et al, (OWNERS) have agreed to accept the City's offer, provided that, after execution of the sale and subject to City Commission approval, they be allowed to collect rent from the tenants until such time as City y desires to take possession, not to exceed six (6) months, and have further agreed to provide the City with (a) disclaimers and (b) proof from the tenants that the premises will be vacated promptly at City's request, and said OWNERS have agreed further 1 to have these documents placed in escrow before the closing and transfer of title; and WHEREAS, OWNERS understand that they are not allowed to contract with any new additional tenants; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to execute a Revocable Use Permit, in a form acceptable to the City CITY COMMISSION MEETING OF NOV 13 1966 )N No. %4cu sq Attorney, to allow Barry Sharpe to continue to collect rental from tenants on premises located at 2262-66 West Flagler Street, Miami, Florida, contingent upon the following conditions: a) Barry Sharpe shall provide City with disclaimers and proof that tenants will vacate premises promptly at City's request; b) At the time of or prior to closing, Barry Sharpe shall put such documents in escrow; e) Barry Sharpe shall not contract with any new tenants. Od to REFERENCES: City Manager ENCLOSURES: Recommendation It is respectfully recommended that the City Commission adopt the attached resolution authorizing the execution of a Revocable Use Permit with Barry Sharpe, in a form acceptable to the City Attorney, to allow him to remain as property manager and collect rents from the tenants in occupancy after the City has purchased through negotiated settlement the property located at 2262-66 West Flagler. Street, as authorized by Resolution 86-289 and 86- 290. This property is located within the site designated for the construction of the South District Police Substation. Background The General Services Administration Department has made an offer to purchase the property owned by Barry Sharpe, et al, pursuant to resolutions 86-289 and 86-290. As such, the offer has been tentatively accepted by the property owner contingent upon the City allowing Barry Sharpe to remain as property manager and to benefit from the collection of rents, for at least six months after the date of closing. By authorizing the City Manager to execute a Revocable Use Permit to allow Barry Sharpe to remain as t the property manager for the property, the City of Miami will acquire the property owned by Barry Sharpe, et al, without spending additional monies beyond the sum amount as prescribed by Resolution 86-289 and 86-290, which amount is $225,000.
