Dougherty Regulatory Ordinance - ',� City Attorney RmRwc4ity Commission Agenda 10/23/86 (1) tNCLOiYRgt At the request of Vice -Mayor Dawkins, we have prepared the attached ordinance which places a limitation on the time for making a motion to reconsider any legislative item which has been acted upon by the City Commission. Under the proposed ordinance. no motion to reconsider can be made after the first regular meeting following the date such Commission action was originally taken. AN ORDINANCE PROVIDING THAT ACTIONS OF THE CITY COMMISSION INCLUDING- THE DENIAL OR APPROVAL OF APPLICATIONS PERTAINING TO AMENDMENTS TO THE ZONING CODE, COMPREHENSIVE PLAN, OR ELEMENTS THEREOF, SHALL NOT BE THE SUBJECT OF A MOTION TO RECONSIDER WHICH IS MADE SUBSEQUENT TO THE FIRST REGULARLY SCHEDULED CITY COMMISSION MEETING FOLLOWING THE DATE SUCH ACTIONS RAVE BEEN TAKEN; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notwithstanding any City Code provision to the contrary, actions of the City Commission including the denial or approval of applications pertaining to amendments to the Zoning Code, Comprehensive Plan, or elements thereof shall not be the subject of a motion to reconsider which is made subsequent to the first regularly scheduled City Commission meeting following the date such actions have been taken. Section 2. It is the intention of the City Commission that the provisions of this ordinanoe shall become and be made a part of the Code of the City of Miami. Florida, as amended, which provisions may be renumbered or. relettered and that the. word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 3. All ordinances, code sections, all parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 4. Should any part or provision of this Ordinanoe be declared by a court of competent jurisdiction to be invalid. the same shall not affect the validity of the Ordinance as a whole.
