FILE NOS. C-86-516 AND C-86-517, RESPECTIVELY, FOR THE ESTABLISHMENT OF TRANSITIONAL USE OFFICES NOT SELLING MERCHANDISE ON THE PREMISES AT 2100 AND 2101 SOUTHWEST 33RD AVENUE, MIAMI, FLORIDA; AND ADOPTING AND INCORPORATING THE FINDINGS OF THE PLANNING DIRECTOR. 1 WHEREAS, the Miami Zoning Board at its meeting of October 20, 1986, Item No. 8, Resolution No. ZB 120-86, by a 8 to 1 vote, upheld the Planning Director's Decision of August 26, 1986, denying Class C Special Permits, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to confirm the denial of said Class C Special Permits. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Zoning Board to uphold the Planning Director's decision to deny Class C Special Permits, File Nos. C-86-516 and C-86-517, respectively, for the establishments of transitional use offices not selling merchandise on the premises at 2100 and 2101 Southwest 33rd Avenue, Miami, Florida, is hereby affirmed. C-86-516 and C- 86-617, denied by the Planning Director on August 26, 1986 for the establishments of transitional use offices not selling merchandise on the premises at 2100 and 2101 SW 33rd Avenue, Miami, Florida. DENIAL. In response to two applications or ass C Special Permits, file Nos. C- 86-516 and C-66-517 for the establishment of transitional use offices not selling merchandise on the premises at 2100 and 2101 SW 33rd Avenue, the Planning Department reviewed the plans, inspected the sites and subsequently disapproved the applications. Said applications included: zoning review and approval by the Zoning Chief Inspector for compliance to applicable zoning regulations. Even though Section 2501, inforpal notice and hearing, requires, no formal public ,. , notice in connection with Class C Special Permit procedures, the Planning Department Director requested from the applicant courtesy notifications to adjacent property owners. The applicant notified eight (9) adjacent property owners and two (2) of them presented objections to the Planning Oeparment. The applications were disapproved based on the following findings: ._y'2 4r. Proposed transitional office would create an adverse effect generally on adjoining and nearby properties and the neighborhood. The type of occupancy as proposed would not blend harmoniously with the existing character of the area and would not be compatible with other development in the neighborhood. An adverse effect would be created on a residential street, there is not adequate ingress and egress to the properties as related to pedestrian safety and convenience and in addition an overflow of traffic would disrupt existing conditions in the area as a result of the proposed office structures. Therefore, it is recommended that the appeals be denied as no merit can be attributed to the appeals that have been filed.
