RESOLUTION NO. 136-'94b.
A RESOLUTION AFFIRMING, WITH CONDITIONS, THE
INSTALLATION OF DRIVE-IN FACILITIES AT A
FINANCIAL INSTITUTION LOCATED AT
APPROXIMATELY 701 NORTHWEST 7 AVENUE (A/K/A
RED ROAD), MIAMI, FLORIDA, MORE PARTICULARLY
DESCRIBED HEREIN, AS PER PLANS ON FILE
SUBJECT TO LANDSCAPE PLAN APPROVAL BY THE
PLANNING DEPARTMENT AND ALL DEDICATIONS AS
REQUIRED BY THE PUBLIC WORKS DEPARTMENT AND
ZB RESOLUTION NO. 108-86; ZONED CR-2/7
COMMERCIAL RESIDENTIAL (COMMUNITY).
WHEREAS, the owner, Mauro Hernandez, desires to install
drive-in facilities in conjunction with his financial institution
located at approximately 701 N.W. 57th Avenue (A/K/A Red Road),
Miami, Florida, more particularly described herein; and
WHEREAS, the City Commission has determined that it wishes
to review all applications for the installation of drive-in
facilities, and
WHEREAS, the Miami Zoning Board at its meetinq of October 6,
1986, Item No. 5, following an advertised meeting, adopted
Resolution ZB 108-86, by an 8 to 0, vote granting a Special
Exception, subject to the approval of the City Commission, for
said installation; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
affirm the Zoning Board's approval of this Special Exception as
hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Commission hereby affirms the
decision of the Zoning Board in granting a Special Exception to
permit two (2) drive-in teller windows at the financial
institution located at approximately 701 Northwest 57th Avenue
(A/K/A Red Road), Miami, Florida, also described as a portion of

dedications as required by the Public Works Department; zoned CR-
2/7 Commercial Residential (Community); also subject to a time
limitation of twelve months in which a building permit must be
obtained.

It is required that a review be made of the
Zoning Board's decision to grant the Special
Exception, with approval by the City
Commission, to permit two (2) drive-in teller
windows at 701 NW 57 Avenue (A/K/A Red Road).
The Zoning Board, at its meeting of October 6, 19861, Item 5,, following an

Within the City generally, or within certain zoning dtatricta, certain structures, uses,
and/or occupancies specified in this orrdinance are of a nature requiring special and
intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special limitations, conditions, and safeguards which should
be applied as reasonably necessary to promote the general purposes of this Zoning
Ordinance, and, in particular, to protect adjoining properties and the neighborhood •
from avoidable potentially adverse effects. It is further intended that the expertise
and judgement of the Zoning Board be exercised in making such determinations, in
accordance with the rules, considerations and Umitations relating to Class D Special
Permits and Special Exceptions. (See Article 28.)
Formal public notice and hearing is not mandatory for Class D Special Permits, but is
mandatory for Special Exceptions. In other respects, these classes of special permits
are the some.
The Zoning Board shall be solely responsible for determinations an applications for
Class D Special Permits and Special Exceptions. AU applications in these classes of
special permits shall be referred to the director of the Department of Planning for his
recommendations and the director shall make any further referrals required by these
regulations.
