A RESOLUTION AFFIRMING, WITH CONDITIONS, THE INSTALLATION OF DRIVE-IN FACILITIES AT A FINANCIAL INSTITUTION LOCATED AT APPROXIMATELY 701 NORTHWEST 7 AVENUE (A/K/A RED ROAD), MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED HEREIN, AS PER PLANS ON FILE SUBJECT TO LANDSCAPE PLAN APPROVAL BY THE PLANNING DEPARTMENT AND ALL DEDICATIONS AS REQUIRED BY THE PUBLIC WORKS DEPARTMENT AND ZB RESOLUTION NO. 108-86; ZONED CR-2/7 COMMERCIAL RESIDENTIAL (COMMUNITY). WHEREAS, the owner, Mauro Hernandez, desires to install drive-in facilities in conjunction with his financial institution located at approximately 701 N.W. 57th Avenue (A/K/A Red Road), Miami, Florida, more particularly described herein; and WHEREAS, the City Commission has determined that it wishes to review all applications for the installation of drive-in facilities, and WHEREAS, the Miami Zoning Board at its meetinq of October 6, 1986, Item No. 5, following an advertised meeting, adopted Resolution ZB 108-86, by an 8 to 0, vote granting a Special Exception, subject to the approval of the City Commission, for said installation; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the Zoning Board's approval of this Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby affirms the decision of the Zoning Board in granting a Special Exception to permit two (2) drive-in teller windows at the financial institution located at approximately 701 Northwest 57th Avenue (A/K/A Red Road), Miami, Florida, also described as a portion of i tract 4, all of tracts 5, 6, and 7 and a portion of tracts 8, 9, 10, 111, and 12 of NORTHWEST SEVENTH STREET GARDEN HOMESITES, L0IssION ETING OFV 25 108�''' according to the plat thereof as recorded in Plat Book 40 at Page 28 of the Public Records of Dade County, Florida, (A/K/A Tentative Plat #1275 "Blue Lagoon") as per plans on file, subject to landscape plan approval by the Planning Department and all dedications as required by the Public Works Department; zoned CR- 2/7 Commercial Residential (Community); also subject to a time limitation of twelve months in which a building permit must be obtained. RESOLUTION ZB 108-86 AFTER CONSIDERING THE CITY'S FINDINGS AND RECOMN.ENDATIONS AND THE PROPOSALS OF THE APPLICANT, THE ZONING BOARD MOVED THAT THE REQUIREMENTS OF SECTION 2305 OF ORDINANCE 95009 AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, WERE SATISFIED BY RELEVANT EVIDENCE IN THE RECORD OF THE PUBLIC HEARING AS DEMONSTRATED BY THE PETITIONER AND THEREFORE GRANTED THE SPECIAL EXCEPTION, SUBJECT TO APPROVAL BY THE CITY COMMISSION, AS LISTED IN ORDINANCE 95009 AS AMENDED, SCHEDULE OF DISTRICT REGULATIONS, PAGE 4 OF 69 CR-2 COMMERCIAL -RESIDENTIAL (COMMUNITY) AND CR-1 COMMERCIAL -RESIDENTIAL (NEIGHBOR- HOOD), PRINCIPAL USES AND STRUCTURES, PERMISSIBLE ONLY BY SPECIAL PERMIT TO PERMIT TWO (2) DRIVE-IN TELLER WINDOWS AT 701 NW 57 AVENUE (A/K/A RED ROAD), ALSO DESCRIBED AS A PORTION OF TRACT 4, ALL OF TRACTS 59 6 AND 7 AND A PORTION OF TRACTS 8, 99 109 11 AND 12, NORTHWEST SEVENTH STREET GARDEN HOMESITES (40-28) P.R.D.C., A/K/A TENTATIVE PLAT #1275 "BLUE LAGOON", AS PER PLANS ON FILE, SUBJECT TO LANDSCAPE PLAN APPROVAL BY THE PLANNING DEPARTMENT; ZONED CR-2/7 COMMERCIAL - RESIDENTIAL (COMMUNITY). THIS SPECIAL EXCEPTION HAS A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED.
