HomeMy WebLinkAboutR-86-103816 41 J-86-1030 12/2/86 RESOLUTION NO. 86--1 i A RESOLUTION DIRECTING THE CITY CLERK TO TRANSMIT PROPOSED AMENDMENTS TO THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN AND ADDENDA (SEPTEMBER 1985), FOR THE AREA GENERALLY BOUNDED BY BISCAYNE BOULEVARD AND THOSE PROPERTIES EAST OF BISCAYNE BOULEVARD FRONTING ON THE LITTLE RIVER CANAL AND SOUTH LITTLE RIVER CANAL, AND FRONTING BISCAYNE BAY BETWEEN THE LITTLE RIVER CANAL AND SOUTH LITTLE RIVER CANAL; AND THAT AREA ON THE SOUTH BANK OF THE MIAMI RIVER BETWEEN THE NORTHWEST 17TH AVENUE BRIDGE AND STATE ROAD 838 BRIDGE, TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR COMMENT; ESTABLISHING PUBLIC HEARING DATES FOR CONSIDERATION OF AN ORDINANCE AMENDING THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN AND ADDENDA (SEPTEMBER 1985) FOR THE SUBJECT AREA BY CHANGING THE DESIGNATION FROM LOW DENSITY RESIDENTIAL, MODERATE HIGH DENSITY RESIDENTIAL, AND RESIDENTIAL COMMERCIAL TO SPECIAL USE; SUCH DATE BEING THURSDAY, FEBRUARY 28, 1987, AFTER 5:00 P.M. FOR SECOND READING; MAKING FINDINGS. WHEREAS, on November 19, 1986, the Miami Planning Advisory Board by Resolution PAB 51-86, by a vote of 9 to 0, RECOMMENDING APPROVAL of a proposed amendment to the Comprehensive Plan changing the designation of the subject properties from Low Density Residential, Moderate High Density Residential and Residential Commercial to Special Use; and WHEREAS, revised procedures in Section 163.3184, Florida Statutes mandate that proposed amendments to local Comprehensive Plans be forwarded to the Florida Department of Community Affairs for review, an action precedent to a zoning change in this instance; and WHEREAS, Zoning Ordinance 9500 contains certain time limitations; and WHEREAS, Subsection 3513 of Zoning Ordinance 9500 allows the Commission to establish dates certain for future public hearings without tolling the time limits between Board actions and City Commission actions; and WHEREAS, nothing contained in this Resolution shall be an endorsement of the proposed amendment to the Miami Comprehensive CITY COMMISSION MEETING OF DEC 11 19b6 SDI U110% r MARh, Neighborhood Plan and Addenda (September 1985) for the subject properties; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Clerk is hereby directed to transmit to the Florida Department of Community Affairs for comment, ten copies of a proposed amendment to the Miami Comprehensive Neighborhood Plan and Addenda (September 1985) for the subject properties. Section 2. The City Commission hereby establishes public hearing dates for consideration of an ordinance amending the Miami Comprehensive Neighborhood Plan and Addenda (September 1985), for the area generally bounded by Biscayne Boulevard and those properties east of Biscayne Boulevard fronting on the Little River Canal and South Little River Canal, and fronting Biscayne Bay between the Little River Canal and South Little River Canal more particularly described as Lots 1-64, less parcel A, BELLE MEADE ISLAND, as recorded in Plat Book 40 at Page 89 of the Public Records of Dade County, Florida; Lot 82, WASHINGTON PLACE, as recorded in Plat Book 20 at Page 54 of the Public Records of Dade County, Florida; Lots 1-18, Block 3, NEW BELLE MEADE, as recorded in Plat Book 40 at Page 45, as recorded in the Public Records of Dade County, Florida; Tracts 12 and 16 and Lots 1-9, Block 16, BELLE MEADE REVISED, as recorded in Plat Book 38 at Page 7, as recorded in the Public Records of Dade County, Florida; Lots 1-7, Block 26, BELLE MEADE FIRST ADDITION, as recorded in Plat Book 21 at Page 66, of the Public Records of Dade County, Florida; Lots 1, and 9-27, Block 1, AQUAMARINE, as recorded in Plat Book 19 at Page 60 of the Public Records of Dade County, Florida; Lots 4 and 5, BROSIUS SUBDIVISION, as recorded in Plat Book 79 at Page 12 of the Public Records of Dade County, Florida; Lots 12-21, Block 5, HAYNSWORTH VILL, as recorded in Plat Book 44 at Page 54 of the Public Records of Dade County, Florida; Lots 1-17, Block 22, SHORE CREST, as recorded in Plat Book 10 at Page 23 of the Public Records of Dade County, Florida; -2 86-10 Trj SHORE CREST, as recorded in Plat Book 10 at Page 23 of the Public Records of Dade County, Florida, beginning ± 116.18' east and 5' south of the northwest corner of Lot 1, Block 20 and South ± 100' to the point; thence east parallel to the north line ± 147.52' to the point; thence northerly ± 12.19' to the point in the west right-of-way line northeast 8th Court and continue northerly ± 16.41'; thence by curve to the left running northerly ± 91.67' to the point ± 5' south of the north line Lot 1; thence ± 100' to the point of beginning; SHORE CREST, as recorded in Plat Book 10 at Page 23 of the Public Records of Dade County, Florida, beginning on the northwest corner of Lot 1 east ± 50' south to the north bank of Little River and west ± 2.43' north along the west line to the point of beginning; and SHORE CREST, recorded in Plat Book 10 at Page 23 of the Public Records of Dade County, Florida, to the east ± 50' of the beginning northwest corner of Lot 1 east ± 100' south to the north bank of Little River and west ± 52.43' north along the west line to the point of beginning of Block 20; Lots 1-8 and 15, Block D and Lots 24-31, Block E, COMMERCIAL SHORE CREST, as recorded in Plat Book 17 at Page 16, of the Public Records of Dade County, Florida; and Lot 4, Block 20, SHORE CREST, as recorded in Plat Book 10 at Page 23 of the Public Records of Dade County, Florida; and that area on the south bank of the Miami River between the Northwest 17th Avenue Bridge and State Road 836 Bridge, more particulary described as Lots 1, 2, 3, 4, 5. 6, 7, and 8, Block 1, GROVE PARK and Lots 1, 2, 3, 4, 5, 6, and 7, Block 2, GROVE PARK, as recorded in Plat Book 5 at Page 66 of the Publio Records of Dade County, Florida and that portion of Lot 3 lying south of the right-of-way, LAWRENCE GROVE, as recorded in Plat Book 2 at Page 55 of the Public Records of Dade County, Florida and that portion of Lot 2 lying south of the right-of-way, Block 1, OAK TERRACE, as recorded in Plat Book 6 at Page 126 of the Public Records of Dade County, Florida, by changing the designation from Low Density Residential, Moderate High Density Residential, and Residential Commercial to Special Use; such date being Thursday, February 26, 1987 after 5:00 P.M. for second reading. -3- 86-10 9 C Section 3. REQUEST To amend the Comprehensive Plan in the area of the Little River Canal, and Miami River at Grove Park, to reflect a special use designation. BACKGROUND Florida legislation requires that proposed plan amendments in excess of 3 acres be forwarded to the State of Florida Department of Community Affairs for 90-day review and comment before local government can adopt a plan amendment. It is being separately proposed that a zoning overlay district (SPI-18) be established and applied to the underlying zoning districts in the area of the Little River Canal, and Miami River at Grove Park to prohibit house barges. Establishment and application of this overlay zoning district would necessarily result in differentiating between underlying zoning district and those otherwise identical zoning districts outside the overlay district. This subtle differentiation is not apparent on the Comprehensive Plan. Therefore, the Planning Department finds that a plan amendment is appropriate. PAB 11/19/86 86 -1.Q 3N, I tem #4 Page 1 ANALYSIS The most appropriate plan designation in special use; any other redesignation would not alert the public that only one use is being excluded from otherwise identical plan designations. The proposed ordinance amendment should be approved on 1st reading and referred to DCA for 90-day review and comment; the plan amendment ordinance should then be scheduled for 2nd reading on March. RECOMMENDATIONS PLANNING DEPT. Approval. PLANNING ADVISORY BOARD At its meeting of November 19, 1986, the Planning Advisory Board adopted Resolution PAB 51-86 by a 9 to 0 vote, recommending approval of the above. 89 replies in favor and 27 objections received by mail. 32 proponents and 29 opponents were present at this meeting.
