A RESOLUTION CONFIRMING ORDERING
RESOLUTION N0. 86-898 AND AUTHORIZING
THE CITY CLERK TO ADVERTISE FOR SEALED
BIDS FOR THE CONSTRUCTION OF EAST
LITTLE HAVANA HIGHWAY IMPROVEMENT -PHASE
II IN EAST LITTLE HAVANA HIGHWAY
IMPROVEMENT DISTRICT -PHASE II H-4528.
WHEREAS, at the City Commission Meeting of November 13,
1986, Resolution No. 86-898 was passed which ordered a highway
improvement identified as EAST LITTLE HAVANA HIGHWAY IMPROVEMENT -
PHASE II in EAST LITTLE HAVANA HIGHWAY IMPROVEMENT DISTRICT -
PHASE II H-4528; and
WHEREAS, pursuant to due public notice, a public hearing
was held before the City Commission on December 11, 1986, as to
any objections to the confirmation of Resolution No. 86-898 which
resolution ordered EAST LITTLE HAVANA HIGHWAY IMPROVEMENT -PHASE
II in EAST LITTLE HAVANA HIGHWAY IMPROVEMENT DISTRICT -PHASE II H-
4528; and
WHEREAS, no objections to the confirmation of said highway
improvement were sustained by the Commission, it is therefore in
order for the Commission to confirm said ordering resolution and
authorize the City Clerk to advertise for sealed bids for the
construction of said improvement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 86-898 dated November 13, 19869
which ordered EAST LITTLE HAVANA HIGHWAY IMPROVEMENT -PHASE II in
EAST LITTLE HAVANA HIGHWAY IMPROVEMENT DISTRICT -PHASE II H-4528
is hereby confirmed.

Resolution Confirming Ordering
Resolution for East Little
Havana Highway Improvement -
Phase II
It is respectfully recommended that the City Commission adopt the
attached resolution confirming the ordering resolution for East
Little Havana Highway Improvement - Phase II H-4528 and
authorizing the City Clerk to advertise for sealed bids for the
construction of said improvement.
BACKGROUND:
The Department of Public Works, after studying the area and
considering the wishes of its residents, and in a continuing
effort to serve all residents of the City of Miami, is proposing
an assessable improvement under Section 56 of the Charter of the
City of Miami described as East Little Havana Highway
Improvement - Phase II H-4528. This district is located in the
area bordered by S.W. 1 Street, S.W. 8 Street, S.W. 8 Avenue and
S.W. 12 Avenue.
The condition of certain street rights of way in this portion of
Little Havana has deteriorated. The pavement is narrow, in poor
condition and/or out of grade; side parkways are in poor
condition; and drainage problems exist. All of these problems
will be corrected on the streets included in East Little Havana
Highway Improvement - Phase II H-4528. The proposed construction
will include asphaltic pavement, concrete sidewalk, concrete
curbs and/or gutters, storm drainage facilities and landscaping.
East Little Havana Highway Improvement - Phase II is included in
the City of Miami's 1986-92 Capital Improvement Program. The
construction of this improvement will be funded by Highway and
Storm Sewer General Obligation Bond Funds. The estimated total
cost of this project is $2,100,000.
This project was ordered at the November 13, 1986 Commission
meeting. It is now in order to confirm the ordering resolution
and authorize the City Clerk to advertise for sealed bids for the
construction of said improvement.

Members of the City Commission
On October 21, 1986 the Department of Public Works held an
evening, neighborhood meeting at Manuel Artime Community Center
Auditorium, 900 S.W. 1 Street, to explain the proposed
improvements to the 369 affected property owners. Ten people,
representing nine properties within the proposed improvement
district, attended the meeting. Only two property owners at the
meeting expressed opposition to the proposed project. One of the
property owners, who expressed the sentiments of several others,
said he was in favor of the project and was willing to pay the
assessment. However, he was concerned about having to pay an
assessment and the length of time for construction.
This City project, unlike the State's S.W. 7 Street project,
should be completed in a timely manner. On this project, only
five blocks can be under construction at one time and the
contractor will be assessed liquidated damages of approximately
$1,800 per day for every day he exceeds the specified contract
time.
